About this file

This is a mandatory registration notification from the New York State Department of Labor regarding contractor and subcontractor requirements for public work projects in New York. Effective December 30, 2024, all contractors and subcontractors bidding on or performing construction work on public work projects or private projects covered by Article 8 of the Labor Law must register with NYSDOL under Labor Law Section 220-i. The law applies to private projects covered by Labor Law Sections 224-a (public subsidy funded projects), 224-d (renewable energy systems), 224-e (broadband projects), 224-f (climate risk-related and energy transition projects), and roadway excavations. Contractors are defined as any entity entering into a contract to perform construction, demolition, reconstruction, excavation, rehabilitation, repair, installation, renovation, alteration, or custom fabrication. Subcontractors are defined as entities subcontracting with a contractor for similar work subject to Article 8 of the Labor Law. Contractors must register before submitting new bids or commencing new work on covered projects on or after December 30, 2024, while subcontractors must register before commencing new work on covered projects on or after that date. Contractors are responsible for verifying that any subcontractors they engage are registered.

NYSDOL encourages all contractors and subcontractors to register as soon as possible to obtain a Certificate of Registration to avoid negatively impacting bidding periods or project schedules. Registration information and the registration portal are available through the NYSDOL Public Work Contractor and Subcontractor Registry landing page at https://dol.ny.gov/public-work-contractor-and-subcontractor-registry-landing. This requirement directly impacts the related SUNY Oswego term contracts solicitation for trades including concrete/masonry, landscaping, and paving, which explicitly requires all bidders to register with NYSDOL before submitting bids for the sealed proposal process with a deadline of July 30, 2025.
