About this file

The document is a Bidder Conference Communication regarding a reopened Equipment Site Lease Request for Response (RFR) issued jointly by the Executive Office of Technology Services and Security (EOTSS) and the Massachusetts State Police (MSP). The RFR has two primary purposes: to establish contractual relationships with communications tower vendors to allow EOTSS and MSP to enter into new leases at new sites (Part 1), and to obtain bids for additional targeted geographic areas (Part 2). The procurement may be active for up to 40 years, and additional geographic areas may be added through subsequent reopenings, which may be limited to Apparent Successful Bidders. Multiple awards are expected for both RFR Part 1 and Part 2. Companies must own or have authority over communications sites, be financially solvent, and meet all applicable laws and regulations to qualify. Typical site specifications include ground space, tower space, access to power and backhaul, and maintenance and security requirements.

Pricing and lease terms must be submitted, and the Commonwealth will give preference to sites offered at no cost or reduced rates. Supplier diversity requirements apply, with 25% of the bid evaluation focused on the supplier diversity plan. The bid submission deadline is March 10, 2023, at 3 PM ET, and the notice of Apparent Successful Bidder(s) is estimated to be issued on March 31, 2023.

The Commonwealth cannot agree to any changes to the Commonwealth Terms and Conditions for IT Contracts or to the Standard Contract Form.

Redlines of either document are grounds for disqualification.

Clarifications to the documents are permitted.

All requested clarifications to the IT Terms and Conditions must be clearly identified as such in the Bid response.

The Commonwealth anticipates entering into Master Service Agreements with a U09 Equipment Lease Agreement template attached.

This template will be used with each vendor under the contract.

Bidders should redline this document in lieu of providing their own lease agreement template This reopening does not impact the status of the current ASBs. Negotiations to enter into Master Service Agreements with each ASB will continue, independent of whether additional ASBs are named, or whether the existing ASBs opt to respond to the new Part 2.
