Justification for Other than Full and Open Competition
I. Agency/Contracting Activity.
DHRA Component: DoD SAPRO, 4800 Mark Center Dr., Suite 07G21, Alexandria, VA 22350 Contracting Activity: DHRA/DEOC/C&FO, 4800 Mark Center Dr., Suite 03E25, Alexandria, VA 22350
II. Nature and/or description of the action being processed.
Request approval to award a Firm Fixed Price contract to ASM Research LLC. This is a follow-on to existing contract H98210-17-D-0001 which expires on February 8, 2021. The period of performance will include a 12-month base period and four 12-month option years and is anticipated to be from February 9, 2021 to February 8, 2026.
III. Description of supplies/services required to meet agency needs (including the estimated value).
SAPRO requires continued contractor support services to assist in operating the DoD Sexual Assault Incident Database (DSAID). The vendor shall perform system management, further development/enhancements, and support for DSAID and the DSAID Document Management Module, on the Entellitrak platform. The vendor shall also perform continued operations, maintenance, and further development of the Enhanced Reporting Capability (ERC) on the MicroStrategy platform. In addition, the vendor will provide licenses for maintenance and upgrades to the application and software; migrate DSAID to the Defense Manpower Data Center (DMDC) cloud environment; respond to task orders for increased functionality as a result of additional requirements to include Congressional mandates; and to maintain the security posture of DSAIDs Risk Management Framework (RMF). The total estimated value of the contract is base plus options. Fiscal Year (FY) 2021 Operation and Maintenance (O&M) funds are programmed and expected to be received for the base period in the estimated amount of .
IV. Statutory authority permitting Other than Full and Open Competition.
10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
SAPRO requires a contractor that can provide services for DSAID with extensive, demonstrated expertise for two applications to meet DoD SAPRO’s legislative requirements: Entellitrak (Oracle 12c, Apache Tomcat, Java, and Secure File Transfer Protocol (SFTP)), and MicroStrategy (Structured Query Language (SQL) data warehouse to include Internet Information Services (IIS), SQL Server, and Extract, Transform, Load (ETL)).
Both Commercial Off-the-Shelf (COTS) products have been and are continually being customized extensively to meet required system modifications based on Congressional Sexual Assault Prevention and Response (SAPR) mandates and to meet DoD leadership SAPR policy requirements on the SAPRO mission (e.g., implementing the FY 2020 National Defense Authorization Act (NDAA) establishment of the U.S. Space Force (USSF) – SAPR data requirements into DSAID). ASM Research technical knowledge of the backend logic for Congressional reporting, Legal Officer Assignments, DSAID Use Cases, and DSAID specific code enables the ability to incorporate significant system changes with low risk of disruption in services (e.g., database structure, workflows, code, and SAPR reporting requirements). ASM has the unique capability to provide services for combining the platforms used for DSAID that no other vendors have been found to possess. Their in-depth knowledge of the database structure maintains DSAIDs five critical functional capabilities: reporting, data entry, weekly/daily data interfaces (four separate and secure data systems), SAPR case management, and SAPR business management. This expertise is also critical to maintain the current DSAID Authority To Operate (ATO) and concurrently prepare for an ATO in a new Defense Manpower Data Center (DMDC) cloud environment. Proper maintenance of DSAID is critical in enabling data accuracy and data protection.
DSAID’s procurement history, combined with the market research conducted for this procurement, has shown that ASM Research has been the only vendor thus far who has been found capable of meeting the requirement. This requirement has been procured three times in the past. Contract H9821010D0002 was awarded on August 17, 2010 on a competitive basis to ASM Research. Seven vendors submitted a proposal, but ASM Research was the only one to be found technically acceptable. Following H9821010D0002, bridge contract H9821016D0002 was award on a sole source basis to ASM Research. Following the bridge contract, on August 9, 2017, a three year Firm Fixed Price contract H98210-17-D-0001, was awarded to ASM Research. That contract was advertised on FedBizOpps for competitive proposals under NAICS code 541512 and was solicited on an unrestricted basis. ASM Research was the only vendor to submit a proposal.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
A Sources Sought Notice was posted on FedbizOpps from November 7 through December 5, 2019 under NAICS 541512 “Professional, Scientific and Technical Services / Computer Systems Design Services” and did not reveal potential sources other than the incumbent for this requirement.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Certified cost and pricing data are not required for this commercial purchase. The cost to the Government will be determined fair and reasonable using the techniques at FAR 15.404-1(b)(2).
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
A Sources Sought Notice was posted on FedbizOpps from November 7 through December 5, 2019 under NAICS 541512 “Professional, Scientific and Technical Services / Computer Systems Design Services”
The result of the posting resulted in three capability statements, one from the incumbent and two from small businesses. Initial capability statements had no indication the vendors, other than the incumbent, had the capability to support a critical major defense program utilizing Entellitrak and MicroStrategy such as DSAID. One vendor did not mention the critical requirement of Entellitrak or MicroStrategy or how it would maintain such systems. The second vendor provided loosely framed references to the critical software requirements which demonstrates their inability to articulate the criticality of this system.
Additional information was obtained from the two small businesses that submitted capability statements.
SAPRO sent out email requests to both firms for an opportunity to update their capability statements on March 12, 2020 with a suspense date of March 26, 2020. Only one vendor responded and provided an updated capabilities statement and described a partnership with a firm that had an “intimate” knowledge of the SAPRO organization. However, this firm last performed work for SAPRO as a subcontractor over 11 years ago before DSAID existed. The Government concluded this update still did not address the capabilities necessary for this procurement.
Additionally, the Director of the DHRA Small Business Office forwarded capability statements from three additional small businesses who expressed interest in this procurement on March 26, 2020. However, upon review, these three firms lacked the development, maintenance, or operations experience noted with Entellitrak or MicroStrategy.
The Contracting Officer forwarded a large business capabilities statement that expressed interest in this procurement. The capability review did not identify any development, maintenance, or operations experience with Entellitrak or MicroStrategy.
Additional market research was conducted via internet search engines for vendors that have experience with Entellitrak and MicroStrategy as well the other requirements listed and none were found.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
As mentioned in section V above, there has historically been no other capable vendors for this requirement.
X. List of sources, if any, that expressed interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
SAPRO will continue to monitor the market place for any new potential sources that may become available to meet this requirement. For new requirements, a thorough review of the marketplace will be conducted to ensure that any/all barriers to competition are identified and removed so that competition can be obtained to maximum extent practicable.
