The protest time limitations, however, will not be extended by attempts to resolve a potential protest with the Contracting Officer.
(c) The filing of a protest with the ODRA may be accomplished by mail, overnight delivery, hand delivery, or by facsimile or if permitted by order of the ODRA, by electronic filing. A protest is considered to be filed on the date it is received by the ODRA during normal business hours. The ODRA's normal business hours are from 8:30 am to 5:00 pm Eastern Time.

(End of provision)
L.4 NUMBER OF AWARDS
The Government anticipates awarding one contract resulting from this Screening Information Request (SIR). However, the Government reserves the right to award no contract at all if the Government determines that awarding no contract is in the Government’s best interests.
L.5 EXPENSES RELATED TO OFFEROR SUBMISSIONS
This SIR does not commit the Government to pay any costs incurred in the preparation of any submission or conducting any demonstrations, tests or in making necessary studies or designs for the preparation thereof or to acquire or contract for any services.
L.6 FALSE STATEMENTS
Proposals must set forth full, accurate, and complete information as required by this solicitation, including attachments. The penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001.
L.7 COMMUNICATIONS WITH OFFERORS
Communications with Offerors may take place, if deemed necessary and appropriate by the CO, and may occur throughout the source selection process. The purpose of communications is to ensure there are mutual understandings between FAA and the Offerors on all aspects of the procurement. Information disclosed as a result of oral or written communication with an Offeror may be considered in the evaluation of an Offeror’s submittal(s).
The FAA may hold one-on-one meetings with individual Offerors and one on one communications may continue throughout the process, as required, at the FAA’s discretion. Communications with one Offeror does not necessitate communications with other Offerors.
Certain communication topics may necessitate amendments to the FAA’s final SIR and/or the Offeror’s submittals. If this is the case, all competing Offerors will be advised of the changes and the CO will establish common cut-off dates for any and all necessitated amendments. However, if communications with Offerors do not result in any such amendments, the FAA is not required to request or accept any Offeror revisions.
L.8 INFORMATION OF AWARD
Written notice to unsuccessful Offerors and contract award information will be promptly released.
L.9 DISPOSITION OF ELECTRONIC PROPOSALS
Electronic proposals will not be returned.
L.10 INSTRUCTIONS TO OFFERORS
This section provides general guidance for preparing proposals, as well as specific instructions on the format and content of the proposal.
(a) The Offeror’s proposal must include all data and information requested by these instructions and must be submitted in accordance with these instructions. The Offeror must comply with all requirements as stated in the SIR. For example, if the submission of qualifications data and references to show the minimum experience specified for the type of work being contracted for is not provided, the Government may reject the offer provided.
(b) The proposal must be clear and concise, and must include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal must not simply restate or rephrase the Government’s requirements, but rather provide convincing rationale to address how the offeror intends to meet these requirements. Offerors must assume that the Government has no prior knowledge of their facilities and experience, and will base its evaluation on the information presented in the offeror’s proposal.
(c) Alternate offers will not be considered unless this SIR authorizes their submission; i.e. offers for supplies or services other than those specified will not be considered.
(d) Offerors are expected to examine, read, and understand all of the provisions of this SIR in their entirety including all instructions and the terms and conditions as stated in the SIR. Failure to do so will be at the Offeror’s risk.
(e) This document constitutes a formal SIR/RFO for which an award may be made without further discussions/negotiations. Offerors are to consider all terms and conditions contained in the formal SIR/RFO in preparation of the proposals set forth herein.
L.10.1 Compliance with Instructions Offerors must comply with all instructions in Section L when developing proposals. Failure to comply with the instructions may result in a determination that the Offeror’s proposal is non-compliant. This determination will be made at the sole discretion of the Government.
Proposals must conform to all incorporated AMS clauses and provisions and be prepared in accordance with this section. To aid in the evaluations, proposals must be clearly and concisely written as well as neat, indexed (cross indexed as appropriate), and logically assembled. All material submitted must be directly pertinent to the requirements of this SIR.
1. Offerors must submit factual and concise written information as requested as well as substantiated cost and pricing information to provide a basis for sound evaluation by the Government. Proposals that merely offer to conduct a program in accordance with the Government's requirements, as described under the Statement of Work (SOW), Section C, may be determined as unacceptable, as could those proposals that merely paraphrase Section C, or which use nonspecific phrases such as “in accordance with standard procedures” or “well known techniques.” Additionally, a weakness or deficiency may be found.
2. Omission of, or vague responses to, the requirements of this solicitation may render a proposal incomplete, as it relates to the requirements of the solicitation, and therefore may cause it to be found unacceptable for further consideration.
L.10.2 Prospective Contractor Responsibility Determination Prior to any award, the CO must make a responsibility determination regarding the apparent successful Offeror. The following will be considered in that determination:
(a) Financial resources to perform the contract, or the ability to obtain them;
(b) Compliance with the required or proposed delivery or performance schedule, taking into consideration all commercial and Government business commitments;
(c) A satisfactory performance record;
(d) A satisfactory record of integrity and business ethics;
(e) Organization, experience, accounting and operational controls, or the ability to obtain them;
(f) Production, construction, and/or technical equipment and facilities, or the ability to obtain them;
(g) Qualification and eligibility to receive an award under applicable laws and regulations.
Notwithstanding the evaluation methodology outlined in this SIR, an Offeror must also be found responsible by the CO prior to the award of any resultant contract. The Offeror must submit the following information:
1. Sufficient information to demonstrate the financial capability to fund and perform a contract of this size and duration. This includes:
a. A Dun and Bradstreet Comprehensive Insight report, not more than six (6) months old;
b. Proof of existing Line(s) of Credit of at least $100,000 from a U.S. Banking Institution; and
c. Financial Statements that demonstrate the firm’s annual revenue for the last three (3) completed company fiscal years. Audited Financial Statements are preferred, but not required.
2. A description of all current or pending legal action(s) under Federal Government contracts within the past three (3) years in excess of $5M, claims, equitable adjustments, pending or ongoing cure notices, Terminations for Convenience, and/or Terminations for Default.
3. Identify if any member on your team has any active exclusions in System for Award Management (SAM) due to being debarred, suspended, proposed for debarment, or otherwise declared ineligible from receiving Federal contracts, certain subcontracts, and certain Federal assistance and benefits within the last three (3) years. Describe the circumstances surrounding the company/individual being placed on the list.
L.11 SOURCE SELECTION PROCESS
Offerors must ensure compliance with all requests for information contained within Section L of this SIR. The conduct of the evaluation; the framework of the evaluation process, evaluation factors and evaluation criteria, and their relative importance may be found in Section M of this SIR. The FAA intends to issue one Screening Information Request (SIR) that requests specific information from each Offeror and provides the evaluation criteria to be used by the FAA. In addition, the SIR contains a model contract (SIR Sections A-J) that has been prepared and provided electronically. Each Offeror submitting a proposal must review the SIR and return a firm offer to perform the contract, as well as agree to all terms and conditions contained in the model contract, should that Offeror be selected for contract award. During the source selection process, evaluation teams will evaluate each Offeror’s proposal, using information submitted to the FAA, presented in written form by each Offeror, or in the case of past performance, obtained from outside references and other points of contact.
SCHEDULE
The following represents the projected procurement schedule; however, it is for planning purposes only and is subject to change.
Final Sir Release : 11/02/2020 Questions to FAA Due: 11/09/2020 Responses to Questions: 11/20/2020 Proposals Due: 01/08/2021 Contract Award: 03/01/2021
L.12 PROPOSAL FORMAT AND SUBMISSION INSTRUCTIONS
L.12.1 Proposal Presentation
a. Proposals must be complete and conform to the instructions in this section; incomplete proposals or proposals which contain significant deviations may result in the exclusion of such proposals from further consideration. General statements that the Offeror understands the requirements of the work to be performed or simple rephrasing or restating of the FAA’s requirements will not be considered adequate and may result in lower evaluation scores or may be cause for rejection of the proposal.
All proposals will be screened initially for completeness, accuracy, and timeliness. A proposal that does not meet all three initial screening criteria may be excluded from the competition. It is the Offeror’s responsibility to ensure the completeness of the proposal.
Any data that may contain trade secrets, copyright data, and/or financial information which the Offeror or proposed subcontractors do not want disclosed for any purpose other than the evaluation of the proposal must be marked in accordance with AMS 3.2.2.3-16, “Restricting, Disclosing and Using Data (July 2004).”

Offerors are to provide a minimum of two and a maximum of four Past Performance Survey forms, Attachment J-2, to clients for contracts currently being performed or that have been completed within the last five (5) years, that are the most relevant to work required under this SIR. These MUST include the clients associated with the Audit Work Sample reports submitted under sub-factor 1.2 of the proposals. The Offeror must include a correct Government and/or industry point of contact, phone number, and email address. If the submitted audit reports are from a subcontractor, then the past performance questionnaires must address subcontractor performance. However, the prime contractor will still need to submit past performance surveys related to its prime performance. The number of surveys submitted applies to each contractor (individually).
Completed past performance questionnaires must be submitted directly to the Government by the Offeror's past performance customers by the proposal due date. ATTN: Kelly Chappelle, AAQ-410
Contracting Officer E-mail address: kelly.chappelle@faa,gov
The completed questionnaires must be received by the FAA no later than the due date for the reception of proposals. Each Offeror is responsible for any follow-up required ensuring timely submission of completed questionnaires.
The Government may conduct follow up communications and/or verifications with any of the people identified in the Past performance Questionnaire Records and/or the clients identified under Factor 1, SubFactor 1.1 for Organizational Experience.
