About this file
This document is a Questions & Answers (Q&A) file for RFP 2018-04-401, involving Socorro County and five other New Mexico counties (Catron, Cibola, Curry, Sierra, and Valencia) seeking legal representation for an opioid-related investigation and potential litigation. The counties are collaboratively issuing a Request for Proposal (RFP) to find special legal counsel to investigate and potentially litigate against opioid product manufacturers, marketers, and distributors. The counties are united in their primary concern of addressing significant substance abuse issues and want a law firm that can comprehensively track and report opioid-related expenditures, with flexibility on litigation strategy and potential filing venues (state or federal courts).
The Q&A document reveals that none of the participating counties have currently compiled comprehensive data on opioid-related costs, and they expect the selected law firm to guide them on information tracking and reporting. The counties are open to both joint and individual lawsuit filing approaches and want the selected firm to advise on the most beneficial strategy. Notably, while Nance, Pato, Stout will be the primary point of contact for most counties, Curry County will have a separate legal contact. The counties anticipate following the procurement schedule strictly and are seeking a proactive legal partner to help them recoup expenses and address the public health challenges posed by the opioid epidemic.

2018-04-401 Questions & Answers
1. Is there any particular strategy the County is looking for from the representation? Do the Counties have preference on where to file litigation (State or Federal)?
Socorro County does not want to limit any strategy, an amendment regarding strategy will be issued following the release of the Q&A. Socorro County does not have a preference on the filing of litigation with the State or Federally and will make that determination with the successful bidder. The offeror should consider both options and advise on the best way to proceed.
2. Why isn’t Mora County included within this RFP?
All counties are free to issue an RFP. Socorro County along with the Counties of Catron, Cibola, Curry, Sierra, & Valencia chose to issue an RFP together.
3. Was your County involved in the Tobacco Litigation that was issued a few years ago?
Some Counties were involved with the Tobacco litigation referenced directly, however, the Attorney General included all Counties when filing. Socorro County does not want to be beholden to someone, like the State of NM, litigating on their behalf and is issuing this RFP for representation.
4. Do you feel that the Counties are of one mind on this?
Absolutely. We believe the biggest concern for all six counties is the significant substance abuse seen throughout all Counties. Participating Counties have authorized Socorro County to take the lead in this process.
5. Will Nance, Pato, Stout be the point of contact for all agencies with this contract?
Yes, though the firm will not lead the litigation; they will be the point of contact for each of the agencies contracting from this RFP with the exception of Curry County. Curry County has a separate legal whom the contracted firm will need to contact.
6. Do damage models exist? What has each County done to keep track of these costs? Bernalillo has task forces to compile the information. Have the Counties done any cost tracking or are the Counties starting fresh.
At present the County has not compiled information to track the costs of opioid related expenditures. Every single County will have different data available; the firm will need to let the Counties know what information they require to properly report and track the costs.
7. Will the procurement schedule be followed to the T or is there a chance that oral presentations will be skipped as has been seen before?
The Counties anticipate that the schedule will be followed.
8. Do the Counties anticipate filing jointly in the same lawsuit or will each County like to file individually at their courthouse?
We expect the offeror to account for both circumstances and weigh the benefits and advise on best way to proceed.
