General Information

INTRODUCTION

This document contains a Request for Offer (RFO) for Sack Lunch vendors for the Department of Forestry and Fire Protection’s (CAL FIRE) 2016 fire season.

The RFO is directed at a defined group of Offerers that may have interest in becoming a supplier for the provision of sack lunches intended for consumption by line firefighters and camp personnel. This RFO will enable Offerers to reflect their interest, submit detailed product descriptions for different constituents of sack lunches, provide company information and identify their approach to successfully meet all the needs of this project.

PURPOSE OF RFO

The purpose of this RFO is to obtain and gather information regarding nutritional value, complete product descriptions including package size and varieties, and ingredients specificity for each component of Fire Line and Camp Sack Lunches from all interested Offerers and service providers. This RFO also serves as a platform for Offerers to demonstrate how they plan to meet the stringent requirements listed in the attachments.

BACKGROUND DESCRIPTION OF REQUEST

A study done by USDA Missoula Technology and Development Center on the nutritional needs of firefighters shows that wildland firefighters are endurance athletes who engage in arduous work throughout a long work shift. Supplemental high-energy foods delay fatigue and further enhance immune function while maintaining the ability to think and make decisions during hard work. This study confirms that firefighters on the line need more nutrition than personnel working in an incident base camp. Line firefighters need an average of 4200 calories, 575 – 818 grams of carbohydrates and 82 grams of protein per day for a 180 pound person in a 24 hour period. The sack lunch is meant for approximately a 12 hour shift, and is not intended to be the line personnel’s only source of food during a shift. Camp personnel need an average of 1800 calories per day for a 180 pound person.

COPYRIGHT

By submitting a response, the Offerer agrees that CAL FIRE may copy the response for purposes of facilitating the evaluation or to respond to requests for public records. The Offerer represents that such copying will not violate any copyrights in the materials submitted.

Attachment F - Financial Preparedness

All vendors should consider their financial soundness before doing business with the State of California. A vendor must have enough funds in reserve to sustain their operational ability while waiting for payments from the State.

“The State of California, by law, requires State agencies to pay properly submitted, undisputed invoices within 45 calendar days of initial receipt.

Government Code section 927(b).”

However, during a declared Fire Season, payment of invoices can be delayed an additional 30 days by law, for a total 75 days. Government Code 927.11 (a).

CAL FIRE reserves the right to choose the method of payment for each order delivered.

The default method of payment is via check; CAL FIRE may use the State’s credit card program (CAL-Card) to pay for orders, if CAL FIRE personnel deem it an appropriate method of payment; CAL-Card is not the default method of payment and is NOT guaranteed. The use of the CAL-Card may result in the vendor incurring extra merchant fees. These fees and any other costs associated with accepting CAL-Card as a method of payment must not be passed onto CAL FIRE directly, and should be considered when quoting purchases and/or bid opportunities.

I hereby certify, as an authorized agent of the company, my business has the financial soundness during a declared fire season and/or when providing services to CAL FIRE during an incident.

STD. 204 (REV. 6/03) REVERSE

Requirement to Complete Payee data Record, STD. 204

A completed Payee Data Record. STD. 204, is required for payments to all non-governmental entities and will be kept on file at each State agency. Since each State agency with which you do business must have a separate STD 204. on file, it is possible for a payee to receive this form from various State agencies.

Payees who do not wish to complete the STD. 204 may elect to not do business with the State. If the payee does not complete the STD. 204 and the required payee data is not otherwise provided, payment may be reduced for federal backup withholding and nonresident State income tax withholding. Amounts reported on Information returns (1099) are in accordance with the Internal Revenue Code and the California Revenue and Taxation Code.

Enter the Payee’s legal business name. Sole proprietorships must also include the owner’s full name. An individual must list his/her full name. The mailing address should be the address at which the payee chooses to receive correspondence. Do not enter payment address or lock box information here.

Check the box that corresponds to the payee business type. Check only one box. Corporations must check the box that identifies the type of corporation. The State of California requires that all parties entering into business transactions that may lead to payment(s) from the State provide their Taxpayer identification Number (TIN). The TIN is required by the California Revenue and Taxation Code Section 18646 to facilitate tax compliance enforcement activities and the preparation of Form 1099 and other information returns as required by the Internal Revenue Code Section 6109(a).

The TIN for individuals and sole proprietorships is the Social Security Number (SSN). Only partnerships, estates, trusts, and corporations will enter their Federal Employer Identification Number FEIN).

Are you a California resident or nonresident?

A corporation will be defined as a “resident” if it has a permanent place of business in California or is qualified through the Secretary of State to do business in California.

A partnership is considered a resident partnership if it has a permanent place of business in California. An estate is a resident if the decedent was a California resident at time of death. A trust is a resident if at least one trustee is a California resident.

For individuals and sole proprietors, the term “resident” includes every individual who is in California for other than a temporary or transitory purpose and any individual domiciled in California who is absent for a temporary or transitory purpose. Generally, an individual who comes to California for a purpose that will extend over a long or indefinite period will be considered a resident.

However, and individual who comes to perform a particular contract of short duration will be considered a nonresident.

Payments to all nonresidents may be subject to withholding. Nonresident payees performing services in California or receiving rent, lease, or royalty payments from property (real or personal) located in California will have 7% of their total payments withheld for State income taxes. However, no withholding is required if total payments to the payee are $1,500 or less for the calendar year.

For information on Nonresident Withholding, contact the Franchise Tax Board at the numbers listed below:
