About this file

This is a Justification and Approval for Other Than Full and Open Competition (J&A) document for a contract modification issued by the U.S. Department of Homeland Security, U.S. Customs and Border Protection (CBP).

CBP proposes to modify an existing contract to expand deployment of a Persistent Surveillance Detection (PSD) system along the U.S. southwestern border. The modification will extend the existing PSD systems by approximately 30 miles along the southwestern border to provide tunnel detection and mitigation capabilities to the U.S. Border Patrol. The contractor will deliver a fully developed PSD system capable of continuous, real-time monitoring and detection of potential tunnel threats in designated operational environments. The system will integrate advanced sensor technologies including acoustic sensors to ensure comprehensive situational awareness and will feature robust data processing and analytics capabilities leveraging machine learning algorithms to autonomously identify, classify, and prioritize potential threats. The PSD will be scalable, interoperable with existing DHS systems, and capable of operating in diverse environmental conditions including extreme weather and low-visibility scenarios. The contractor is responsible for engineering, procurement, installation, maintenance, training, technical support, cybersecurity compliance, and system deployment. Deliverables include technical documentation, test and evaluation reports, and final system deployment within the agreed timeline.

The contract is Firm Fixed Price, funded under OB3A & Procurement Construction and Improvements, with a three-year base period from FY26 to FY29 followed by two one-year option periods spanning FY29 and FY30. The J&A cites 41 U.S.C. 3304(a)(1) as statutory authority for sole-source justification, determining that only one responsible source exists to avoid duplication of unrecoverable costs and unacceptable delays in fulfilling agency requirements. CBP determined no exception to the Buy American Statute applies. An announcement is planned for posting on SAM.gov with an estimated publication date of April 2026.

Justification & Approval for Other Than Full and Open Competition Template v3.8 (Nov 2025) budget out-years. Additionally, the Government will work with awarded vendors to mitigate proprietary software and algorithmic copyright issues that may reduce competition in the future. These software changes would be necessary in order to allow OIT to perform the network and security monitoring required for an Authority to Operate (ATO).
