About this file
This is a contract terms and conditions document for the State of Maine's Department of Purchases establishing an annual sand bag supply contract for use by all Maine state agencies, municipalities, and political subdivisions. The contract calls for the supply of white woven polypropylene sand bags measuring 14" x 26" with ties and a UV rating of 1600 or better. The contract period is one year from the award date, with an option for the Director of Purchases to extend the contract for one additional one-year period at pricing and terms deemed in the State's best interest, contingent upon contractor consent. The estimated contract value is $15,000, though the actual value will be determined by quantities ordered by using agencies during the contract term. The contractor must establish a tiered price schedule based on order quantities: 1,000–4,999 bags, 5,000–9,999 bags, 10,000–19,999 bags, 20,000–28,999 bags, and 29,000 or more bags, with pricing to be determined by the bidder.
Pricing shall remain firm throughout the contract duration and must include all transaction charges with delivery on an F.O.B. Destination basis. The State of Maine is exempt from federal excise taxes and state sales taxes. The successful bidder must accept the State of Maine Procurement Card as a form of payment without applying surcharges, and pricing must be final regardless of payment method. Delivery orders up to $5,000 will be emailed directly to the vendor, while larger orders will be processed through the Division of Purchases for approval and encumbrance. The contractor may be required to provide the Director of Purchases with annual or more frequent detailed summaries of total purchases. The Division of Purchases reserves the right to cancel the contract with thirty days' written notice or immediately if the contractor fails to comply with contract terms. Bidders will be evaluated on their willingness to extend contract pricing to political subdivisions and school districts in Maine.
