Customs and Border Protection Office of Border Patrol (OBP)
Tucson Sector Statement of Work (SOW)
Bottled Water
1. BACKGROUND
The U.S. Customs and Border Protection (CBP), Office of Border Patrol (OBP), Tucson Sector (TCA) has a requirement for the delivery of bottled water to various Border Patrol locations throughout southern Arizona. The sizes and quantities of bottled water may increase or decrease due to changes in apprehensions. The locations are subject to change based on operational needs of OBP.
2. SCOPE
The Tucson Sector Border Patrol requires bottled water in 16.9 ounce, 1 liter, 1 gallon and 5 gallon sizes. Individual bottles are to be delivered by the Contractor in cases, crates, lots or pallets. The Tucson Sector anticipates the approximate usage of 900,000 gallons over a five year period (approximately 180,000 gallons each year). This is an approximate total and may not reflect what is actually requested due to weather, apprehensions and operational requirements. CBP intends to establish a single-award Blanket Purchase Agreement (BPA) to fulfill this requirement. It is anticipated that the first delivery may be required within 24 hours of award date.
3. TASKS
The Contractor shall complete the following tasks as required to comply with this SOW.
3.1 The Contractor shall provide all labor, transportation and equipment to deliver potable bottled water as required to all U.S. Border Patrol locations listed in Appendix A. The sizes and quantities of water as well as the locations are subject to change due to operational needs of OBP.
3.2 All bottles must have sanitized bottle neck seals and be of a non-shatter type plastic material. The bottles may include labels of any type or no labels at all.
Bottles may be ribbed or smooth and made of any thickness of plastic as long as the quantities of water is delivered to the locations requested.
3.3 The Contractor shall provide fresh potable drinking water that is colorless, odorless, tasteless, and of a quality not less than that prescribed in the Guidance for Drinking Water Quality, published by the United States Environmental Protection Agency (EPA) under its Drinking Water Standards program. The Contractor shall be responsible for identifying and providing water from a source that meets all local and federal government requirements.
3.4 The Contractor may deliver water in cases, crates, lots, pallets or cardboard or shrink-wrapped packaging at the Contractor’s discretion as long as the types and amounts of water are delivered to the locations listed in Appendix A. When water is delivered in 5 gallon bottles or crates, the Border Patrol will make every effort to return crates to the Contractor but will not be responsible for any unreturned crates.
The Contractor assumes all risk when delivering water in crates.
3.5 Delivery dates shall be once or twice a month to each location depending on the season and mission requirements. Summer deliveries (April through September) of water are anticipated to be double the winter deliveries (October through March).
Deliveries are accepted between the hours of 0800 and 1500 only. No deliveries on Saturdays, Sundays or Holidays. The Contractor shall notify the Contracting Officer’s Representative (COR) if there will be any delays or changes to the delivery schedule.
3.6 Unloading and loading (delivery and pick-up) of water and materials at each location shall be the responsibility of the Contractor. No Government equipment or personnel will be provided at any location for the placement and pick-up of the water requirements. The Contractor shall be responsible for ensuring the water is delivered directly to the drop-off point designated at time of award unless otherwise coordinated with the COR and Station POCs. If the drop-off points are not clear for delivery, the Contractor is not obligated to deliver the water.
3.7 The Contractor shall deliver emergency supplies of water on an as-needed basis and as directed by the COR. Delivery of emergency water shall be made within 24 hours of notification from the COR. Emergency water supply is intended to support emergency delivery orders in situations when potable water is not available due to extra numbers of detainees, severe weather conditions, breaks in water main, or contaminated underground water wells. The Government does not require the Contractor to maintain a stock outside the normal quantities since the Government is unable to determine in advance, if and when these supplies may be required.
The total quantity ordered will depend on the level and duration of the emergency.
Any emergency requests will be followed up with a modification if needed. The Border Patrol also reserves the right to pay for these emergency requirements by Government purchase card or convenience check.
4. DELIVERABLES
The Contractor shall deliver water within (14) days of the ordering date, at the agreed upon date and time to the locations listed in Appendix A. All location Checkpoint areas are subject to relocation based on operational needs within a 5 mile radius. Advance notice (24 Hours) will be provided by the Government to the Contractor for these contingencies.
4.1 Monthly Reporting
The Contractor shall be responsible for submitting a report of delivered water to the COR and Contract Specialist (CS). The report shall be broken down by individual Stations and contain the sizes and quantity of water ordered during that month, the date of the delivery, and the cost of the water. The Contractor’s monthly invoice is acceptable, if it contains all of the needed data.
4.2 Key Personnel
Contractor shall provide both a single and a secondary/back-up Point of Contact (POC) for all contract requirements to include telephone number and email address. The Contractor shall have a system available to permit the Government to contact the Contractor 24 hours per day, seven (7) days per week, in order to support the needs of the contract actions.
5. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION
None.
6. FUNDING
This BPA does not obligate any funds nor authorize any services. The Government is obligated only to the extent of funds obligated on authorized Delivery Orders issued under this BPA by the BPA Contracting Officer (CO).
Accounting and appropriation data will be provided at the Delivery Order level.
The volume of purchases through this BPA will have no minimum limit. The Government is under no obligation to any BPA holder to purchase any specified quantity of products. A fixed price per bottle is required to include any delivery fees and taxes.
7. BPA CEILING
The BPA will have a total ceiling amount of $950,000.00. The Tucson Sector may issue orders for up to $250,000.00 at any one time.
8. PRICE REDUCTIONS
The Contractor may offer on this BPA at any time, temporary, one-time, or intermittent price reductions of any product listed in the BPA Price Sheet.
9. ORDERING
Ordering of bottled water above the threshold of $3,000.00 will be accomplished by the issuance of funded Delivery Orders written from the BPA guidelines.
Requests for delivery may be initiated and coordinated by the COR or Station POCs.
10. PLACE OF PERFORMANCE
Locations as outlined in Appendix A.
11. PERIOD OF PERFORMANCE
The period of performance for this Blanket Purchase Agreement (BPA) shall be for five
(5) years from date of award.
Throughout the period of performance, the BPA will be reviewed by the Government in conjunction with the Contractor for any updates or required changes. This will be completed each year at the anniversary date of the award of the BPA. The Government may cancel this BPA at any time during those review periods based on the needs and requirements of the Government. However, if it decided at the anniversary period to cancel the BPA, any current and ongoing Delivery Order will be continued until the Delivery Order period of performance is completed, unless otherwise terminated.
Delivery Orders placed against the BPA shall be written for no longer than 12 months at any one time, subject to no more than six (6) months of extended service based on the needs and requirements of the Government.
