Justification for Other than Full and Open Competition

1. Summary/Introduction:

Defense Logistics Agency (DLA) Energy is the Executive Agent for Bulk Petroleum and the contracting activity for petroleum products and services for the Department of Defense (DoD). In furtherance of this mission, the DLA Energy Bulk Petroleum Products Business Unit, Western Pacific and Middle East Team, fulfilled an unanticipated, short term requirement for truck transportation services for DLA Energy-owned fuel JA1 (Turbine Fuel, Aviation), JP8 (Turbine Fuel, Aviation), DF2/ADO (Diesel Fuel), and MOGAS (Motor Oil) from fuel supplier Kuwait Petroleum Company (KPC) to U.S. military installations within Kuwait, directly or indirectly.

This Justification and Approval (J&A) authorizes DLA Energy to meet that requirement through a sole source extension and modification of Contract SPE600-17-D-0474 (the “Contract”) with KGL Transportation Company KSCC (“KGL”), on an unusual and compelling urgency basis under Federal Acquisition Regulation (FAR) 6.302-2. The total estimated value of the Contract extension is $479,374.21 which increased the Contract value from $4,338,138.54 to $4,817,512.75. The Period of Performance for the Contract extension is March 1, 2020 – June 18, 2020. This unusual and compelling contract action was prompted by a disappointed offeror’s protest of the follow-on acquisition to the Contract.

2. Nature and/or description of the action being approved (FAR 6.303-2(b)(2)):

The action being approved is the sole source extension and modification of KGL’s Contract for truck transportation services for DLA Energy-owned fuel in Kuwait. The Contract modification authorized under this J&A is a 110-day, firm fixed price Contract extension. Defense Working Capital Funds will be utilized for this effort. This action is being awarded to KGL on a sole source basis due to unusual and compelling circumstances and the urgency of need.

3. Description of supplies or services required to meet the agency’s need (including estimated value) (FAR 6.303-2(b)(3)):

DLA Energy requires tank truck transportation of DLA Energy-owned JP8, JA1, MOGAS, and DF2/ADO to U.S. military customers in Kuwait from fuel supplier KPC locations, either directly or indirectly, for the period of March 1, 2020 through June 18, 2020. This involves driving fuel tank trucks to KPC production and/or storage facilities, downloading the fuel in the tank trucks, transporting the fuel within Kuwait, and finally, delivery of the fuel to storage tanks or facilities for United States military customers within Kuwait. The estimated total fuel quantities for which DLA Energy requires the above transportation and delivery during the period March 1, 2020, through June 18, 2020, are as follows:
