About this file

This is a Scope of Work document for polygraph examination services to be provided to the Dallas Area Rapid Transit (DART) Police Department. The scope details two primary service categories: polygraph examinations of sworn and non-sworn applicants for employment, and polygraph examinations of persons involved in criminal or internal affairs investigations. For applicant examinations, the vendor must conduct exams within forty-eight hours of request and accommodate same-day testing for out-of-town applicants approximately two times monthly with thirty days' advance notice. For investigation-related examinations, the vendor must be able to conduct exams within twenty-four hours of request. All examinations must include video and audio recording maintained for at least two years, electronic pre-polygraph questionnaires, written results reports delivered within twenty-four hours, and comply with Texas Occupations Code Chapter 1703 requirements. The vendor must maintain an office within twenty-five miles of DART Police Headquarters in Dallas and be available during normal business hours (8am-5pm, Monday-Friday), with availability for weekend examinations not to exceed five percent of all requested examinations.

The vendor must employ currently licensed polygraph examiners holding certificates or diplomas from certified or accredited polygraph examiner courses and in full compliance with Texas licensing requirements. All examination reports must be made electronically available to designated department personnel and must include detailed findings on deceptions indicated, inconclusive responses, admissions of criminal conduct or negative employment experience, and applicant rebuttals. The vendor must maintain confidentiality of all department documents and cannot release questionnaires or investigation-related materials to any unauthorized individuals or entities. The contract is subject to DART's standard purchase order terms and conditions, with Net 30 payment terms, FOB Destination shipping, and time of delivery being essential to the order with potential for default termination if delivery specifications are not met.

Scope of Work Polygraph Examinations

Under this scope of work, a licensed Polygraph Examiner will provide the following services to Dallas Area Rapid Transit (DART) for the polygraph examination of DART Police Department sworn and non-sworn applicants and of persons involved in a criminal or internal affairs investigation.

Polygraph Examination of sworn and non-sworn applicants

1. Prior to a polygraph examination being conducted on an applicant, the department will have the applicant complete a “Pre-Polygraph Questionnaire” and a designated department employee will review and discuss the applicant’s answers to the questionnaire with the applicant to narrow the applicant’s answers as much as possible.

2. Upon the department requesting an appointment for a polygraph examination of an applicant, the polygraph examiner must be able to conduct the polygraph examination of the applicant within forty-eight (48) hours of the request.

3. Approximately two (2) times each month, the department conducts entrance exams for out of town applicants and sends those who pass the entrance exam and interview for their polygraph exam on the same afternoon, so that they do not have to travel back to Dallas on a different day. The department will notify the polygraph examiner’s office at least thirty (30) days in advance of these testing dates. However, because it is impossible to know exactly how many applicants will pass testing and interviews, the department will not be able to reserve an exact number of appointments in advance.

The department can estimate how many out of town applicants may pass testing interviews, but an exact number will not be known until testing and interviewing is completed. The polygraph examiner’s office must be able to perform polygraph exams on the afternoon of testing days on all out of town applicants who pass testing and interviews, under these circumstances.

4. The vendor must allow appointments to be scheduled using an online scheduling system, because some scheduling will be conducted after normal business hours. The online scheduling system must show available appointments and the capability to reserve an appointment time from the available times.

5. The polygraph examiner must explain and must obtain the applicant’s signature on any waivers required by the polygraph examiner regarding release of the information obtained during the polygraph examination.

6. The polygraph examiner must provide the means for the applicant to complete a pre-polygraph questionnaire electronically.

7. The polygraph examiner will review the questionnaire with the applicant and determine if the applicant has made or needs to make any disclosures, admissions, or additions.

If any disclosures, admissions, or additions need to be made to the questionnaire, the polygraph examiner will have the applicant make such revisions to the questionnaire and indicate which items were revisions.

8. The polygraph examiner will explain the polygraph examination procedures to the applicant.

9. The polygraph examiner will construct an appropriate exam to include control questions and to include questions regarding: the applicant’s employment experience;

the applicant’s military experience; the applicant’s theft from employers; the applicant’s criminal activities; the applicant’s convictions, arrests, or detentions; the applicant’s usage of marijuana; the applicant’s usage of illegal drugs; the applicant’s sales of illegal drugs; and the applicant’s prior law enforcement experience.

10. The polygraph examiner will conduct the polygraph examination. All polygraph examinations must be video and audio recorded, and these recordings must be maintained by the vendor for at least two years from the date of the exam. A copy of these recordings must be provided to DART within twenty-four (24) hours of a request.

11. Once the polygraph examination is completed, if the polygraph examiner determines that any deception is indicated, the polygraph examiner must, in accordance with Texas law, allow the applicant an opportunity (while not under a polygraph examination) to rebut the indicated deceptions.

12. Once the polygraph examination is completed and the applicant has provided any needed rebuttal to indicated deceptions, the polygraph examiner will then dismiss the applicant with any instructions provided by the department.

13. The polygraph examiner will prepare a polygraph results report that includes, but is not limited to:

a. the purpose of the polygraph examination;

b. a statement that the nature and reason of the polygraph examination was explained to the applicant and whether the applicant freely and willingly submitted to the exam;

c. an explanation regarding how the applicant’s identity was confirmed;

d. an explanation of the procedures for conducting the polygraph examination (i.e., construction of control questions and relevant questions);

e. a statement regarding whether the applicant followed the polygraph examiners instructions;

f. the relevant questions that were asked and the responses that were given;

g. a statement regarding whether any deceptions were indicated and if so, to which questions;

h. a statement regarding whether any questions had inconclusive responses and if so, to which questions;

i. a statement regarding whether any criminal conduct was admitted by the applicant, either before, during or after the polygraph exam;

j. a statement regarding whether any negative employment experience was admitted by the applicant, either before, during or after the polygraph exam;

k. a statement regarding whether any omissions on the Pre-Polygraph Questionnaire were admitted by the applicant, either before, during or after the polygraph exam;

l. a statement regarding whether any admissions or denials not contained in the Pre-

Polygraph Questionnaire were made by the applicant, either before, during or after the polygraph exam; and

m. the applicant’s rebuttal to any indicated deceptions.

14. The polygraph examiner will make the written polygraph results report electronically available (either by email or by posting to the examiner’s secure website) to the designated department personnel within 24 hours of conducting the examination.

15. If needed, the department may request that a “Post Polygraph Examination” be conducted to address specific issue(s), the truth of which have been unable to otherwise ascertain. The department will forward all documentation regarding the specific issue(s) in its possession. The polygraph examiner will construct an appropriate exam to include control questions and to include questions regarding the specific issue(s).

The polygraph examiner will then be required to comply with the requirements in steps 10 through 13 above.

16. If the polygraph examiner has a reasonable belief that the applicant has utilized any counter measure(s) with the intent to alter the polygraph examination results, the polygraph examiner must notify the designated department personnel within 24 hours and prepare a written report within 3 business days.

17. The polygraph examiner must comply with all rules and regulations of the Polygraph Examiners Act, Texas Occupations Code Chapter 1703.

18. The polygraph examiner must not release the department’s “Pre-Polygraph Questionnaire” or any other documents provided by the department to any individual or entity other than designated department personnel.

Polygraph Examination of persons involved in criminal or internal affairs investigations

1. Prior to a polygraph examination being conducted on a person involved in an investigation, the department will either: (1) have the person provide a written statement and have investigator’s notes taken from an oral interview with the person;

or (2) have investigator’s notes taken from an oral interview with the person, if the person refuses to provide a written statement.

2. Upon being called by the department requesting an appointment for a polygraph examination of a person involved in an investigation, the polygraph examiner must be able to conduct the polygraph examination of the person within twenty-four (24) hours of the request.

3. An investigator will provide the relevant documentation to the polygraph examiner and will also be available to discuss the issues with the polygraph examiner, if needed.

4. The polygraph examiner must explain and must obtain the person’s signature on any waivers required by the polygraph examiner regarding release of the information obtained during the polygraph examination.

5. The polygraph examiner will discuss the issues with the person and, if needed, will review the written statement with the person.

6. The polygraph examiner will explain the polygraph examination procedures to the person.

7. The polygraph examiner will construct an appropriate exam to include control questions and to include questions regarding the particular issues.

8. The polygraph examiner will conduct the polygraph examination. All polygraph examinations must be video and audio recorded, and these recordings must be maintained by the vendor for at least two years from the date of the exam. A copy of these recordings must be provided to DART within twenty-four (24) hours of a request.

9. Once the polygraph examination is completed, if the polygraph examiner determines that any deception is indicated, the polygraph examiner must, in accordance with Texas law, allow the person an opportunity (while not under a polygraph examination) to rebut the indicated deceptions.

10. Once the polygraph examination is completed and the person has provided any needed rebuttal to indicated deceptions, the polygraph examiner will then dismiss the person.

11. The polygraph examiner will discuss with the investigator the polygraph results, immediately after conducting the examination.

12. The polygraph examiner will prepare a polygraph results report that includes, but is not limited to:

a. the purpose of the polygraph examination;

b. a statement that the nature and reason of the polygraph examination was explained to the person and whether the person freely and willingly submitted to the exam;

c. an explanation of the procedures for conducting the polygraph examination (i.e., construction of control questions and relevant questions);

d. a statement regarding whether the person followed the polygraph examiners instructions;

e. the relevant questions that were asked and the responses that were given;

f. a statement regarding whether any deceptions were indicated and if so, to which questions;

g. a statement regarding whether any questions had inconclusive responses and if so, to which questions;

h. a statement regarding whether any criminal conduct was admitted by the person, either before, during or after the polygraph exam;

i. a statement regarding whether any omissions in the person’s statement were admitted by the person, either before, during or after the polygraph exam; and

j. a statement regarding whether any admissions or denials not contained in the statement and/or investigator’s notes were made by the person, either before, during or after the polygraph exam.

13. The polygraph examiner will make the written polygraph results report electronically available (either by email or by posting to the examiner’s secure website) to the investigator within 24 hours of conducting the examination.

14. If the polygraph examiner has a reasonable belief that the person has utilized any counter measure(s) with the intent to alter the polygraph examination results, the polygraph examiner must notify the investigator in person immediately after conducting the examination, and prepare a written report within 3 business days.

15. The polygraph examiner must comply with all rules and regulations of the Polygraph Examiners Act, Texas Occupations Code Chapter 1703.

16. The polygraph examiner must not release any documents provided by the department to any individual or entity other than designated department personnel.

Requirements The vendor must require and ensure that all persons conducting polygraph examinations for DART be currently licensed polygraph examiners by the Texas Commission of Licensing and Regulation and be in compliance with all licensing and practice requirements set forth in the Polygraph Examiners Act, Texas Occupations Code Chapter 1703. The vendor must require and ensure that all persons conducting polygraph examinations for DART be able to provide a certificate or Diploma from a certified or accredited polygraph examiners completed course.

Location

Vendor must have an office located within twenty-five (25) miles of DART Police Headquarters (2111 S. Corinth Street Rd, Dallas, Texas 75203), due to designated department personnel sometimes accompanying persons to the polygraph examiner’s office.

Availability

Vendor must be open and available during normal business hours (8am – 5pm), Monday through Friday, when most polygraph examinations will be requested. However, given the unpredictable nature of police work, a polygraph examination may be required on Saturdays and Sundays, and the vendor must be available to conduct such examinations when requested. Weekend polygraph examinations will account for no more than five percent (5%) of all examinations requested.
