SECTION V

SCOPE OF SERVICES

ANNUAL CONTRACT TO PROVIDE INSURANCE AGENT/BROKER SERVICES

5.1 PURPOSE AND BACKGROUND:

The purpose of the Request for Proposal (RFP) is to seek proposals from qualified firms for TPA Services to ensure the prompt and equitable disposition of auto liability claims for Chatham County’s risk management program. This is a key partnership for Chatham County Risk Management’s program.

Chatham County was incorporated in 1777 and is governed by nine (9) Commissioners including one (1) Chairman. The County encompasses 632 square miles and has a population of approximately 308,000 citizens.

In 2024, Chatham County Fire Department officially began operations as a County department. Chatham County Health Department is a department of the State of Georgia, however, the County provides vehicles for their business use. Additional non-county entities may utilize a County vehicle at the direction of the Chatham County Board of

Commissioners, MOUs, by contract, or other legal requirements. The County currently has approximately 2,300 full, part-time, and seasonal employees.

Chatham County does not purchase Commercial Automobile or Commercial General Liability insurance but has chosen to retain(self-insure) this exposure and fund any losses from operating revenue or reserves.

This RFP is for auto liability claims only and includes both at-fault and not-at-fault collisions. It does not include any other claims made against the County. All other claims (road hazard, property damage, non-auto-related injury, etc.) will remain with the Risk Manager.

Chatham County utilizes a TPA for workers’ compensation program administration and is not a part of this RFP. The selected TPA will be required to work closely with the workers’ compensation TPA for potential subrogation recoveries. The workers’ compensation TPA is CorVel Corporation.

In the calendar year 2025, Chatham County had a combined 62 motor vehicle accidents.

• 22 At Fault

• 40 Not at Fault

5.2 CHATHAM COUNTY INTERNAL PROCEDURES:

Risk Management services are administered and monitored through the Occupational Safety, Risk Management, and Disabilities Services Department. The Risk Manager and Director will be the point of contact for Chatham County.

Legal counsel resides with the Chatham County Attorney’s Office. The Chatham County Attorney’s Office will assign representation if needed for litigation. Fleet Operations maintains decision authority for County-owned assets regarding preferred repair shops.

Chatham County relies on the doctrines of public and official immunity as its primary claims defense. Each claim is evaluated on a case-by-case basis, and the County asserts any and all defenses permitted by law. The immunity defense does not apply to the use of licensed vehicles. The County retains the liability and physical damage exposure (Except for high-value vehicles) related to vehicles and adjusts these claims in-house. Adjudication responsibility is currently shared between the Risk Manager and the County Attorney.

Chatham County does purchase physical damage only coverage for high-value vehicles (Fire Apparatus and Mobile Emergency Command Centers). Coverage is currently placed with VFIS. Tail claims will reside with Chatham County Risk Management. This RFP is for claim handling from the date of the contract forward.
