SUBSTITUTION PROCEDURES
1.01 REQUEST FOR SUBSTITUTIONS
A. Bidding Phase: Requests for substitution will be reviewed during Bidding for compliance with the Contract Documents, provided the substitution request is submitted in writing to the Architect/Engineer. The Architect/Engineer will consider a contractor’s or supplier’s request for substitution when the following conditions are satisfied. If the following conditions are not satisfied, the request may be returned without action, except to record noncompliance with these requirements:
1. Requested substitution is consistent with the Contract Documents and will meet or exceed the indicated results.
2. Substitution request is fully documented and properly submitted in accordance with this section, Section 01 25 00.
3. Requested substitution must be submitted no later than deadline for questions as identified in Section 00 21 00 Proposal Requirements.
4. Requested substitution has received necessary approvals of authorities having jurisdiction.
5. Requested substitution is compatible with other portions of the Work.
6. Requested substitution meets or exceeds the specified warranty.
7. All approved substitution requests will be reported by addendum.
B. Construction Phase: During the Construction Phase, the Owner and the Architect will consider substitutions of products in place of those specified, but only when the substitution will provide a clear benefit to the Owner, such as the same performance and quality at a lower cost, or better performance or quality at the same cost, or an improved construction schedule, or when the specified product is not longer being manufactured.
C. Submit a formal, written request for substitution. Substitutions indicated on or implied by submittal of shop drawings or manufacturer's product data will not be accepted, even if the Architect inadvertently "approves" the submittal.
D. Submit a separate written request of each Product, supported with a complete description of the proposed substitution, including product data, drawings, performance and test data and samples as appropriate, and with the following information:
1. Comparison of the qualities of the proposed substitution with those of the product specified.
2. Changes required in other components of the work because of the substitution.
3. Effect on the construction schedule and on the Contract Sum.
4. Cost data comparing the proposed substitution with the Product specified, and including incidental cost of modification to related work.
5. License fees or royalties, if applicable.
6. Availability of maintenance service and source of replacement materials.
E. By making a request for a substitution, the Contractor/Vendor/Manufacturer makes the following representations:
01 25 00 – Page 2 of 3 Substitution Procedures
1. The Contractor/Vendor/Manufacturer has investigated the proposed substitute product and determined that it is equal or superior in all respects to that specified.
2. The Contractor/Vendor/Manufacturer (as applicable) can and will provide at least the same warranty for the substitution that the specifications require for the product specified.
3. The cost data presented is complete and includes all adjustments to the Contract Price for the substitution and related work under this Contract, and the Contractor/Vendor/Manufacturer will make no claims for additional costs related to the substitution which subsequently become apparent.
4. The Contractor/Vendor/Manufacturer will coordinate the installation of the accepted substitute, making such changes as may be required for the Work to be complete in all respects.
F. If requested by the Architect, provide additional evidence leading to a reasonable certainty that the proposed substitution or deviation will provide a quality of result at least equal to that otherwise attainable.
G. In the event that specified items cannot be delivered to the job site and incorporated into the work in such quantities as to cause no delay, then the Contractor may request a substitution in the manner described above.
1. Should the accepted substitution provide a cost savings, the Contract Price shall be adjusted by change order with Owner receiving the benefit of the net savings.
2. No increase in the Contract Price shall be allowed on substitutions made after the 30 day submittal limit.
H. Inability to obtain specified items due to Contractor’s failure to place timely orders shall not be considered a reason for authorizing substitutions.
1.02 ARCHITECT’S/ENGINEER’S DECISION
A. The Architect/Engineer will review the proposed substitution for appearance, where relevant, as well as the performance, quality of construction, and consistency with design intent, and shall be the final judge on the acceptability of the proposed substitution.
1. The Contract Documents are intended to produce a building of consistent character and quality of design. All components of the building which are exposed to view, including visible items or mechanical and electrical equipment, have been selected to have a coordinated design.
a. The Architect/Engineer will judge proposed substitutions for their appearance and design as well as for other more objective characteristics such as measurable performance.
b. If required to do so by the Architect/Engineer, the Contractor shall furnish the substituted material in any color, finish, texture, or pattern which would have been available from the manufacturer, or one of the manufacturers, originally specified, at no additional cost to the Owner.
2. Products, manufacturers and vendors, in addition to those specifically listed, are acceptable for substitution when proven to the satisfaction of the Architect/Engineer that:
a. The quality level of the proposed manufacturer/vendor is equal to or better than the referenced manufacturer’s/vendor’s quality.
01 25 00 – Page 3 of 3 Substitution Procedures
b. The technical characteristics, including project requirements of function, design and physical dimensions, of the proposed product meets or exceeds that required on the drawings and in the specifications.
c. The use of the proposed product(s) shall not require major revisions in the Project to permit their use.
3. It is the Contractor’s responsibility to verify and demonstrate that the product he/she bid or the proposed (substitute) product he/she bid meets or exceeds the drawings and specifications at the time of shop drawing review.
a. If a proposed product is determined to be technically unacceptable as judged by the Architect/Engineer, the Contractor shall be required to supply products that meet the requirements stated on the drawings and in the specifications.
b. Under no circumstance will the Architect/Engineer be required to prove that a proposed product (substitution) is not equal to the project requirements.
c. The decision of the Architect/Engineer on such requests/proposals is final.
B. Additional Cost and Coordination
1. Based on the Architects/Engineers decision, the Contractor shall make any necessary modifications to the work and/or arrangements for the work to proceed in accordance with such decisions and the Project requirements.
2. Any additional cost in other work incurred as a result of a substitution shall be borne by the Contractor, including all costs, foreseen and unforeseen, for modifying other related materials/systems and the cost of any additional engineering or architectural fees required to accommodate the substitution.
3. Any additional coordination with other work incurred as a result of a substitution shall be the responsibility of the Contractor, including the work of other trades.
C. Contract Sum and Time
1. Changes in Contract Sum to the Owner shall be as previously stated in this Section 01 25 00.
