About this file

This is a Non-Collusion Affidavit form required by Dauphin County, Pennsylvania for submission with proposals in response to the Request for Proposal for Beverage Vending Machines. The affidavit must be executed by the member, officer, or employee of the bidding firm who is responsible for making final pricing decisions. According to the Pennsylvania Anti-bid Rigging Act (62 Pa.C.S.A. 4501 et seq.), submission of a completed Non-Collusion Affidavit is mandatory, and failure to file the affidavit in compliance with the instructions will result in disqualification of the bid. Proposals must be submitted electronically via PennBid by 4:00 pm ET on Friday, October 16, 2026, and the affidavit form is available on the Pennsylvania Department of Community and Economic Development website.

The affidavit requires the signatory to certify that bid prices have been developed independently without consultation or communication with other bidders, that prices have not been disclosed to competitors, that no attempts have been made to induce other firms to refrain from bidding or submit noncompetitive bids, and that the bidding firm is not currently under investigation by any governmental agency and has not been convicted or found liable in the past four years for any act involving conspiracy or collusion with respect to bidding on public contracts. Any misstatement in the affidavit is treated as fraudulent concealment, and bid rigging and false sworn statements in connection with bid submission are unlawful and subject to criminal prosecution. In the case of a joint venture, each party must submit a separate affidavit and be identified in the bid documents.

2. This Non-Collusion Affidavit must be executed by the member, officer or employee of the bidder who makes the final decision on prices and the amount quoted in the bid.

3. Bid rigging and other efforts to restrain competition, and the making of false sworn statements in connection with the submission of bids are unlawful and may be subject to criminal prosecution. The person who signs the Affidavit should examine it carefully before signing and assure himself or herself that each statement is true and accurate, making diligent inquiry, as necessary, of all other persons employed by or associated with the bidder with responsibilities for the preparation, approval or submission of the bid.

4. In the case of a bid submitted by a joint venture, each party to the venture must be identified in the bid documents, and an Affidavit must be submitted separately on behalf of each party.
