About this file

This is a Form 200.321 Affirmative Steps document issued by McLean County Fiscal Court outlining federal contracting requirements under 2 CFR 200.321 for small and minority business participation. The document establishes mandatory affirmative steps that contractors, including engineers and subcontractors, must implement to ensure qualified minority businesses, women's business enterprises, and labor surplus area firms are considered and utilized whenever feasible. The required actions include placing qualified enterprises on solicitation lists, actively soliciting these enterprises as potential sources, dividing total project requirements into smaller tasks or quantities when economically feasible to maximize participation, and establishing delivery schedules that encourage participation by these enterprises. Contractors are also directed to utilize support services from organizations such as the Small Business Administration and the Minority Business Development Agency of the Department of Commerce to facilitate compliance with these requirements.

This form applies to McLean County Fiscal Court's procurement of Certified Residential Real Estate Land Appraiser services in the State of Kentucky for floodplain acquisition projects involving approximately 20 residential properties. The affirmative steps requirements mandate that all contractors and subcontractors proactively identify and engage small, minority-owned, and women-owned businesses as potential sources for work on the project. Compliance with these federal requirements is non-negotiable and must be demonstrated throughout the contracting process, with the county ensuring that disadvantaged enterprises have meaningful opportunities to participate in the appraisal services procurement.
