S&ME Project No. 4226-18-101
Dear Ms. Hreha:
S&ME, Inc. (S&ME), herewith submits this Accurate Jurisdictional Determination Request for an Upland
Determination on an approximate 235-acre land parcel located west of US Highway 25 and south of Old Laurens
Road in Hodges, South Carolina (Site, Exhibit 1). A total of 11 jurisdictional tributaries, 7 jurisdictional wetlands, and one other jurisdictional Waters of the U.S. (WOUS) were observed at the Site for a total of 3.49 acres of jurisdictional waters.
Preliminary Jurisdictional Assessment
S&ME conducted a delineation of the jurisdictional waters on the Site on August 22 and 23, 2018. The Site is identified as seven tax parcels and a portion of an eighth as 6839-003-983, 6829-870-959, 6829-814-999, 6920-
725-034, 6829-971-959, 6829-935-957, 6930-042-124, 6920-883-325 (portion of parcel) for an approximate total of 235 acres according to Greenwood County tax records. The Greenwood County area had received approximately 1.39 inches of rainfall within the previous 48 hours of the field reconnaissance.
Jurisdictional Tributary 1, an unnamed tributary to the Dudley Creek, runs along the eastern portion of the Site.
Jurisdictional Tributary 1 is a small creek averaging four linear feet in width along the section contained within the
Site boundary. The banks are generally stable with a channel substrate consisting of sand, gravel, and muck. The channel had clear water with some visible silt associated with rains earlier in the week. An observed ordinary high water mark (OHWM), sediment sorting, wrested vegetation, and wrack lines were observed within the channel.
Flowing water was present in the channel. The tributary originated on the Site, flowed generally southeast to northwest 2,568 linear feet, exiting the Site through a culvert along the northern boundary. The tributary is bisected by a gravel access road midway along its length as it runs through a reinforced concrete pipe (RCP) under the road bed.
Wetland 2 (0.17 acre), a forested wetland, was located within a shallow drainage feature abutting Jurisdictional
Tributary 1 located in the southern portion of the Site near the start of the tributary. Hydric soils and hydrology were observed within the wetland. Groundwater recharge from a seep located at the southern terminus of the wetland was observed.

Jurisdictional Wetland 3 was located within the littoral fringe of Other Jurisdictional WOUS 1, a 1.79 acre open water pond. Jurisdictional Wetland 3 is approximately 0.65 acre in size and is located within the overall drainage of Other Jurisdictional WOUS 1. Hydric soils and hydrology were observed within the wetland. The wetland is located within an active agricultural pasture and has been impacted by livestock ingress and egress from the resource.
Several small tributaries and wetlands feed Jurisdictional Tributary 1, including:
Jurisdictional Tributary 2, a small seep approximately 1 foot in width and 42 linear feet in length with relatively stable banks. The tributary exhibited an OHWM, wrested vegetation, and hydric soils within the channel. No flow was observed in the channel.
Jurisdictional Tributary 3 is located in the original tributary channel behind the dam of Other Jurisdictional
WOUS 1. The channel was approximately 4 feet in width and exhibited an OHWM and contained water within the channel. Overall length was 82 linear feet as it flowed from the base of the dam into
Jurisdictional Tributary 1.
Jurisdictional Tributary 4 is located in a steep drainage and exhibited an OHWM. The tributary is approximately 2 feet in width, and runs for approximately 35 linear feet before it meets Jurisdictional
Tributary 1.
Jurisdictional Tributary 5 is approximately 417 linear feet in length and approximately 3 feet in width. The tributary is confined to a steep drainage pattern with unstable banks displaying differing degrees of erosion along its length. The channel exhibited an OHWM, sediment sorting, and wrested vegetation.
Jurisdictional Wetland 4, is located adjacent to the confluence of Jurisdictional Tributary 5 and
Jurisdictional Tributary 1. The wetland is 0.02 acre in size and displayed hydric soils, hydrology, and hydrophytic vegetation.
Jurisdictional Wetland 5, a 0.02 acre feature abuts Jurisdictional Tributary 1. The wetland is located in a recently harvest logging operation. Hydric soils, hydrophtic vegetation, and hydrology were observed within the wetland.
Jurisdictional Wetland 6 is located within an existing utility Rights-of-Way (ROW). The wetland is approximately 0.04 acre in size and hydric soils, hydrophytic vegetation, and hydrology were observed.
The wetland is located directly upstream of an existing RCP that flows beneath a gravel access road.
Jurisdictional Tributary 11, an unnamed tributary to the Dudley Creek, runs along the western portion of the Site.
Jurisdictional Tributary 11 is a small creek averaging six to eight linear feet in width along the section contained within the Site boundary. The banks are generally stable with a channel substrate consisting of sand, gravel, small cobble, muck, and bedrock. The channel had clear water with some visible silt associated with rains earlier in the week. An OHWM, sediment sorting, wrested vegetation, and wrack lines were observed within the channel.
Flowing water was present in the channel. The tributary originated off the Site, flowed generally south east to north west 2,008 linear feet, exiting the Site along the northern boundary.
Several small tributaries and wetlands feed Jurisdictional Tributary 11, including:
Jurisdictional Tributary 10, a small stream approximately four feet in width and 848 linear feet in length with relatively stable banks. The tributary was contained within a shallow drainage feature and exhibited an OHWM, wrested vegetation, and hydric soils within the channel. The channel substrate included sand, Accurate Jurisdictional Determination Request

Jurisdictional Tributary 6 receives flow from Jurisdictional Tributary 10. Jurisdictional Tributary 6 is a small creek approximately four feet in width and 1,426 linear feet in length. The tributary was confined within a steep drainage pattern and displayed an OHWM, wrested vegetation and sediment sorting. The tributary was fed by several smaller tributaries including; Jurisdictional Tributary 7 (27 linear feet), Jurisdictional
Tributary 8 (61 linear feet), and Jurisdictional Tributary 9 (27 linear feet). Tributaries 7-9 had observed
OHWM, and hydric soils within the channel.
