FAR SUBPART 13.5 SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS � SOLE SOURCE JUSTIFICATION AND APPROVAL

Requiring Activity:

Strategic Weapons Facility Pacific (SWFPAC)

Description of Requirement:

This requirement is for security and law enforcement services in support of SWFPAC and Transit Protection Program (TPP) Bangor.

Authority: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5.

Amount:

1. Agency Contracting Activity:

N00406 � Naval Supply Fleet Logistics Puget Sound (NAVSUP FLC PS)

2. Description of Action:

Award of a firm-fixed-price, service contract on a sole source basis with WSP for security and law enforcement services in support of SWFPAC and TPP Bangor. The Government projects award for August 2022 and fiscal year 2022 Operations and Maintenance, Navy funds will be used.

This action is a follow-on to contract N0040617C0003. That contract was not competed under authority Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5. Paragraph, �Actions to Increase Competition� of the previous justification, stated: FLCPS has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, FLCPS will assess whether competition for future requirements is feasible. Those actions were not accomplished due to no other potential sources have been identified.

3. Description of Supplies/Services:

Provide support to the U.S. Navy High Value Unit Security by mitigating threats from land by patrolling key terrain terrain. Services will also provide for mitigating threats

This requirement is for a period of performance of one year plus four one-year option periods.

b. Reason for Authority Cited:

is a Washington state owned designed to open and close to allow civilian and military vessel passage. The only agency legally charged with traffic control, safety and security inspections, and trespass law enforcement is the Washington State Patrol.

5. Efforts to Obtain Competition:

The Contracting Officer shall publish the notices required by FAR 5.201.

6. Actions to Increase Competition:

Only WSP is capable of providing the required law enforcement services. There are no steps being taken at this time to increase competition beyond posting the solicitation to sam.gov.

7. Market Research:

Market research was conducted by the Contract Specialist on 15 March 2022. Results show that security and law enforcement services are not provided by any sources required per FAR Part 8.
