6. EVALUATION AND AWARD (PER FAR 52.212-2)

52.212-2 - Evaluation—Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0028)

The Government will award a single IDIQ contract resulting from this RFQ to the responsible Quoter IAW FAR 9.103 whose quote (including A completed copy of Attachment 3, Anti- Mafia Screening, conforming to the solicitation, will be most advantageous to the Government, price and other non-price factors considered. The solicitation, evaluation, and award procedures discussed in Revolutionary FAR Overhaul (RFO) Subpart 12.2 shall be utilized for this commercial requirement in order to facilitate a simplified and streamlined process.

Timely quotes received which possess flaws such as a missing certification or an acknowledgement of an amendment that does not contain material changes to the solicitation’s terms may be evaluated and considered by the Government if the Contracting Officer determines that consideration of the quote is in the Government’s best interest, no substantial activity has transpired in evaluating quotes, and other vendors would not be prejudiced. This discretion is entirely up to the Contracting Officer and in no way obligates the Government to consider flawed quotes. Should the Contracting Officer determine these three conditions to be met, a quoter may be given up to 24 hours to provide missing documentation from the time of notification by the Government. If 24 hours from the time of notification falls on a weekend, holiday, or after 5:00 PM local time (Naples, Italy), quoters shall submit the missing documents no later than 11:00 AM local time on the next business day. This exchange, if accomplished, does not constitute discussions, as defined below.

The three factors shown below in bold shall be used to evaluate quotes and determine which quote represents best value to the Government. These factors are not listed in order of importance, the Government is not assigning any relative weight or importance for any factor, and no sub-factors are being used. The Government intends to make an award without conducting any discussions. For the purposes of this solicitation, discussions mean any exchanges between the Contracting Officer and quoter which allow quoters to make material changes (price, technical, past performance information submittals…etc.) to their quote after the RFQ’s “quotation due date” has passed. If the Contracting Officer decides to allow any changes after this date, the Contracting Officer may limit, at their discretion, this opportunity to only those quoters determined to be the most competitive in terms of price and non-price factors. If accomplished, these most competitive quoters will be given a listing of all identified weaknesses/areas for improvement and deficiencies along with an equal amount of time to submit their revised quotes.

Source Selection, evaluation, exchanges, negotiation, and price analysis techniques/procedures found in RFO Part 15 are not being utilized for this solicitation.

Factor 1: Technical Capability. The Government will evaluate the offeror's technical quotation to assess the degree to which its Quality Control Plan demonstrates a clear ability to meet or exceed the requirements of the PWS. The Government will evaluate the offeror's technical quotation, addressing the area listed under “Volume I – Technical”, to assess the degree to which its Quality Control Plan demonstrates a clear ability to meet or exceed the requirements of the PWS, as compared to other quotations. An individual rating or score will not be assigned for this factor. A quotation demonstrating a more thorough and lower-risk approach compared to other quotations will be evaluated more favorably.

Factor 2: Past Performance. The Government will evaluate the quality of the quoter’s recent and relevant Past Performance to determine the likelihood of satisfactory performance of the solicitation's requirements as compared to other quoters. An individual rating or score will not be assigned for this factor. The Government reserves the right to consider Past Performance Information (PPI) provided by quoters and information obtained by the Government from any other sources so long as the PPI is both recent and relevant. PPI is recent if performed or completed within three years of the RFQ's issuance date. PPI is considered relevant if the nature of the work involved the procurement and delivery of chemical products.

If the past performance reference/contract was performed by a parent, affiliate, or subsidiary company, the quoter must specify how that entity will be involved in performance of this effort (personnel or resources from that entity which will be assigned to assist in performance of this effort) in order for such past performance to be considered and evaluated under this factor.

Factor 3: Price. The total price quotation will be evaluated for fairness and reasonableness in accordance with RFO 12.204. The total price will be calculated by adding the total prices for all ELINs at the estimated quantities for all five ordering years. The government will multiply the estimated quantity of each ELIN by the quoted unit price for all ordering years and sum the totals. This method ensures all quotes are evaluated fairly and in the same manner.
