Attachment 1 Statement of Work (SOW) Dual Cartridge Electronic Control Weapons
1. BACKGROUND:
1.1. The Department of Homeland Security (DHS), Customs and Border Protection (CBP), Law Enforcement Safety and Compliance Division (LESC) has a requirement for the procurement of Dual Cartridge Electronic Control Weapons (ECW), accessories, and cartridges for operational and training use.
1.2. Relevant components within and outside of DHS may include but are not limited to the following listed in Table 1.2, below. This contract will be awarded and administered by U.S. Customs and Border Protection (CBP).

2. SCOPE:
2.1. This Statement of Work delineates the required characteristics and performance criteria for Dual Cartridge ECW, accessories, and cartridges for U.S. Customs and Border Protection (CBP), Department of Homeland Security (DHS).
2.2. This statement of work further delineates the item requirements for compatibility with the current stock of operational CBP ECW devices. Those items will be identified in the Technical Requirements section of this Statement of Work.
2.3. Vendor shall provide additional administrative and logistical support, including but not limited to customer service support, shipping and handling (FOB destination), and invoicing/payment support.
2.4. Vendor shall provide manufacturer’s technical specifications for items required for submission. Specifications shall address all technical requirements listed within this document.
3. APPLICABLE DOCUMENTS:

4. TECHNICAL REQUIREMENTS:
4.1. General Requirements
4.1.1 All items specified in sections 4.2, 4.3, 4.4, and 4.5 shall be permanently marked with individual and legible serial numbers.
4.2. Dual Cartridge Electronic Control Weapon Kit (Black)
4.2.1 This item shall include one Dual Cartridge Electronic Control Weapon. The ECW housing shall be constructed of high-impact polymer and shall be black in color. It shall meet or exceed the IEC 60529 IPx2 rain standard. It shall meet or exceed the MIL-STD-810G Method 510.5, Procedure 1 dust standard. It shall incorporate an ambidextrous, two-position safety switch. It shall be capable of operating between the temperatures of -4°F to 122°F. It shall feature dual cartridge bays that are capable of deploying the cartridges outlined in Sections 4.9, 4.10, 4.11, and 4.12. Dual lasers shall provide visual reference of the impact point for both the top and bottom probe of the cartridge. It shall also feature warning arc capability that provides an audible warning without deploying a cartridge. The device shall provide key system details to the user via a Critical Information Display (CID). It shall be configured in Manual Mode only, which requires the user manually cycle between cartridge bays. This item shall meet or exceed the characteristics of the Axon Taser X2 ECW.
4.2.2 This item shall also include a one-year manufacturer’s warranty that guarantees repair or replacement of defective devices.
4.2.3 This item shall also include one non-rechargeable battery that is capable of powering the Dual Cartridge Electronic Control Weapon. The battery shall not include a camera or automatic shutdown feature. It shall be capable of powering 500 deployment cycles. This item shall meet or exceed the characteristics of the Axon Taser X2 Tactical Performance Power Magazine.
4.3. Dual Cartridge Electronic Control Weapon Kit (Black)
4.3.1 This item shall include one Dual Cartridge Electronic Control Weapon. The ECW housing shall be constructed of high-impact polymer and shall be black in color. It shall meet or exceed the IEC 60529 IPx2 rain standard. It shall meet or exceed the MIL-STD-810G Method 510.5, Procedure 1 dust standard. 4.4. Dual Cartridge Electronic Control Weapon Kit (Yellow)
4.4.1 This item shall include one Dual Cartridge Electronic Control Weapon. The ECW housing shall be constructed of high-impact polymer and shall be yellow in color. It shall meet or exceed the IEC 60529 IPx2 rain standard. It shall meet or exceed the MIL-STD-810G Method 510.5, Procedure 1 dust standard. It shall incorporate an ambidextrous, two-position safety switch. It shall be capable of operating between the temperatures of -4°F to 122°F. It shall feature dual cartridge bays that are capable of deploying the cartridges outlined in Sections 4.9, 4.10, 4.11, and 4.12. 4.5. Dual Cartridge Electronic Control Weapon Kit (Yellow)

4.5.3 This item shall also include one non-rechargeable battery that is capable of powering the Dual Cartridge Electronic Control Weapon. The battery shall not include a camera or automatic shutdown feature. It shall be capable of powering 500 deployment cycles. This item shall meet or exceed the characteristics of the Axon Taser X2 Tactical Performance Power Magazine.
4.6. Dual Cartridge Electronic Control Weapon Battery: This item shall be capable of powering the current CBP Dual Cartridge ECW. It shall also be capable of powering all ECW outlined in this Statement of Work. This item shall meet or exceed the characteristics of the Axon Taser Tactical Performance Power Magazine.
4.7. Dual Cartridge Electronic Control Weapon Holster (Right-Handed): This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. The holster shall be capable of automatically engaging the X2 safety when reholstered. It shall be black in color and shall be configured as a cross-draw holster. It shall also incorporate a detachable belt feature with a clamshell design to allow for quick detachment from a duty belt. It shall meet or exceed the characteristics of the Blackhawk X2 ECW Holster.
4.8. Dual Cartridge Electronic Control Weapon Holster (Left-Handed): This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. The holster shall be capable of automatically engaging the X2 safety when reholstered. It shall be black in color and shall be configured as a cross-draw holster. It shall also incorporate a detachable belt feature with a clamshell design to allow for quick detachment from a duty belt. It shall meet or exceed the characteristics of the Blackhawk X2 ECW Holster.
4.9. 25 Foot Live Smart Cartridge: This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. It shall deploy two probes tethered with conductive wire to a distance of 25 feet. It shall meet or exceed the characteristics of the X2 – 25 ft Live Smart Cartridge.
4.10. Inert Simulation Smart Cartridge: This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. It shall not contain nor deploy probes. It shall allow for functionality of the Dual Cartridge ECW and provide accurate simulated data via the ECW CID. It shall meet or exceed the characteristics of the X2 – Training Inert Simulator Cartridge.
4.11. 25 Foot Training Smart Cartridge: This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. It shall deploy two probes tethered with non-conductive wire to a distance of 25 feet. It shall meet or exceed the characteristics of the X2 – 25 ft Non-Conductive Training Smart Cartridge.
4.12. Dual Cartridge ECW Dataport Download Cable: This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. It shall allow for deployment data to be uploaded onto a computer. It shall meet or exceed the characteristics of the Axon Dataport Download Cable.
4.13. Simulation Training Suit (Black): This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. It shall not allow X2 training cartridge probe penetration to the wearer. It shall include one pair of Sim Suit Gloves and one Helmet. It shall meet or exceed the characteristics of the Axon Simulation Training Suit Compatible with X2 Training Cartridges and Sim Suit Gloves.
4.14. Simulation Suit Gloves (Black): This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. It shall not allow X2 training cartridge probe penetration to the wearer. It shall meet or exceed the characteristics of the Axon Sim Suit Gloves.
4.15. Simulation Training Helmet: This item shall be compatible with the current CBP Dual Cartridge ECW. It shall also be compatible with all ECW outlined in this Statement of Work. It shall not allow X2 training cartridge probe penetration to the wearer. It shall meet or exceed the characteristics of the Axon Simulation Training Hemet.
4.16. Dual Cartridge ECW Inert Training Device: This item shall be a replica of the Dual Cartridge ECW and shall be powered by the battery outlined in Section 4.5 of this Statement of Work. It shall not be capable of deploying cartridges. It shall feature a functioning safety switch, CID, and Aiming Lasers. It shall meet or exceed the characteristics of the Axon Blue Laser Pointer – X2.
5. ADMINISTRATIVE REQUIREMENTS
5.1. Quality Control (QC) and Quality Assurance (QA)
5.1.1 Any changes in design or color of any device require Contracting Officer Representative (COR) and Contracting Officer (CO) notification prior to shipment of the subject item.
5.1.2 Devices and accessories which fail any portion of the vendor’s (including manufacturer’s) QC processes shall be rejected and not shipped. No further attempts shall be made to correct or otherwise remediate a device or accessory which has failed any portion of the QC testing for purposes of delivery.
5.1.3 The Government may conduct periodic random QA testing of devices and/or accessories produced to ensure items meet performance requirements for which the contract was awarded.
5.1.4 QA may or may not be conducted by Government personnel at a Government-owned facility.
5.1.5 Devices and/or accessories which fail QA testing may be sent back to the vendor, at no cost to the Government, and replaced with an equal amount of new supplies. If a second or subsequent failure (for the same test) occurs within the same batch, this will be considered a batch failure. The vendor shall be notified by the COR, in writing, of the nature of the failure, defect, or deficiency and the vendor shall replace the entire batch at no cost to the government.
5.1.6 Vendor shall take corrective action within seven (7) calendar days of written notification of any non-conformance. Corrective action shall include shipping of replacements for all defective, deficient, or suspect devices and/or accessories. The vendor shall also provide a written failure analysis plan to the COR within 7 calendar days of written notification. A completed failure analysis report, to include preventative measures, shall be submitted to the COR within 60 calendar days of notification of non-conformance.
5.2. Warranties
5.2.1 Vendor shall warrant all products contained in this contract to be free of defects. Vendor further warrants that the product conforms to all applicable requirements as outlined within this Statement of Work and guarantees that the product will maintain useful shelf life under reasonable storage conditions (both CONUS and OCONUS) for a period of five (5) years from the date of product acceptance.
5.2.1.1. The only exceptions to this requirement are Sections 4.2 and 4.4 of this Statement of Work that require only a 1-year warranty for the ECW.
5.2.2 The vendor shall provide to the COR a single point of contact (including name, phone number, and email address) who will handle all warranty claims occurring under this contract.
5.2.3 The vendor shall utilize FEDEX, UPS overnight, or other trackable next day service for all warranty shipments to the government. Ground service may be used for return shipping. Exemptions may be authorized by the COR on a case-by-case basis. All shipping charges associated with warranty claims (both to and from the Government) shall be the vendor’s responsibility.
5.3. Government Access of Contractor’s Facility
5.3.1 The vendor shall permit the Government to conduct quality control inspections of the vendor’s facility (including production facility) to ensure manufacturing consistency and quality of products ordered and delivered.
5.3.2 The authorized inspection team shall be identified in writing by the COR or the CO.
5.3.3 The minimum advance notice of inspection shall be three business days.
5.3.4 Inspections may include all aspects of manufacturing, testing, quality control, and packaging.
5.4. Production Capacity
5.4.1 The Government requires that a vendor have the capacity to manufacture and/or deliver a minimum of 4,000 X2 ECW per quarter and 100,000 cartridges per quarter.
5.4.2 The Government reserves the right to verify the company’s ability to produce and/or deliver at an acceptable level in accordance with the requirements. This may include a pre-award site visit.
5.4.3 Orders for devices and/or accessories in excess of the minimum production capacity indicated above shall be shipped in accordance with instructions in any resultant delivery order.
5.5. Distribution Authorization
5.5.1 With proposal submission, the vendor (if not the manufacturer) shall provide a letter from the manufacturer indicating it is an authorized distributor/retailer of the device, cartridges, and accessories. Unauthorized distributors and retailers are unacceptable and will not be considered.
5.6. Shipping: All items are to be shipped Freight on Board (FOB) destination.
5.6.1 Shipping locations may be centralized or may include individual locations throughout CONUS, Alaska, Hawaii, and Puerto Rico, and Canada.
5.6.2 Shipping methods for each location may be specified by CBP at the delivery order level and may vary depending on location, quantity of items, and receiver’s ability to handle freight shipments.
5.6.3 All shipments shall be trackable. Tracking information shall be provided to the COR (or designate) upon request.
5.6.4 The vendor shall provide advanced notice of shipping via email 2 business days prior to each shipment. Notification shall be sent to the COR or the designate, and to the local recipient for each shipping location. The local recipient’s name and contact information will be included on the delivery location spreadsheet that will be provided at the award of the contract/delivery order.
5.7. Packaging
5.7.1 Material shall be packaged, packed and marked for shipment in such a manner that will ensure acceptance by common carriers and safe delivery at destination.
5.7.2 Packages shall be clearly identified on the outer wrapping with the contract number and delivery/task order number, if applicable.
5.7.3 Pallets and associated packaging, when used for shipping, shall be fully enclosed and shall be stackable, allowing for a second complete pallet to be placed on top of a first complete pallet without structural problems or damage to the contents of either pallet.
5.8. Vendor Performance Conferences
5.8.1 Within 30 calendar days of contract award, the vendor shall host a pre-production meeting telephonically.
5.8.2 CBP and the vendor may meet in person once per year, commencing six months after production begins and continuing approximately every year thereafter. These performance conferences are to discuss contract issues, review technical and financial status of the contract, discuss vendor and Government performance, and to resolve any issues or problems as they may arise.
5.8.3 Government attendees may include the Contracting Officer, Contract Specialist, COR, representatives from the CBP components, and Law Enforcement Safety and Compliance (LESC) subject matter experts.
5.9. Reporting Requirements
5.9.1 A delivery order report should be sent (31 December, 31 March, 30 June, 30 September) to the COR of the contract on a quarterly basis. The report should include a cumulative line-item Excel spreadsheet of all delivery orders and include the following:
5.9.1.1. Name of purchasing agency/group
5.9.1.2. Delivery order number
5.9.1.3. Unit cost
5.9.1.4. Quantity of units on the delivery order
5.9.1.5. Value of delivery order
5.9.1.6. Current quantity of units shipped
5.9.1.7. Remaining number of units to be shipped; and
5.9.1.8. Total dollar amount spent against the contract to date
5.9.2 Warranty Work Report should be sent to the COR of the contract on a quarterly basis (31 December, 31 March, 30 June, 30 September). The report should include a line-item summary of all warranty activity as well as the numerical totals of claims received, total completed, and the average number of days required for completion. It shall be categorized by agency, purchasing group, or ordered chronologically by the date the vendor received notification. Each line in the report shall contain the following information:
5.9.2.1. Return merchandise authorization (RMA) #
5.9.2.2. Date vendor was notified
5.9.2.3. Date corrected item was shipped to vendor
5.9.2.4. Brief statement of problem
5.9.2.5. Brief statement of solution; and
5.9.2.6. Date shipped back to the Government
5.10. Media Statements
5.10.1 All press statements and releases related to the contract shall receive advanced written approval by the Contracting Officer and COR.
6. DELIVERABLES AND DELIVERY SCHEDULE
6.1. Orders shall be delivered to the addresses per the delivery location spreadsheet that will be provided at the award of the contract/delivery order. Items shall be shipped within 60 calendar days after receipt of order (ARO), unless otherwise specified in the delivery order.
6.1.1 Single orders for 14 or more ECW shall be delivered in boxes of 14 devices that are bulk packaged. Each box shall contain a printout of the serial numbers with barcodes of only the devices in the box. Boxes shall be visibly numbered for identification purposes (i.e., #1, #2, etc.).
6.1.2 For accountability purposes, the vendor shall provide a list of serial numbers with barcodes for each delivery order in which ECW are shipped. This list shall be separated by box number with serial numbers contained in each box listed in numerical order. The document shall also include vendor’s name and address, delivery order number, invoice number, sales order number (if separate), make and model of the launchers, unit cost, quantity, and total cost. This list shall be emailed, in a workable format such as Word or Excel, to the COR or designate at the time of shipment.
7. PERIOD OF PERFORMANCE
7.1. The ensuing contract will have a five (5) year ordering period from date of award of contract.
8. SECURITY
8.1. All work under this SOW is unclassified but may require secure handling of information designated as “For Official Use Only” (FOUO) and/or personally identifiable information (PII).
8.2. Vendor personnel who will perform work on the contract may be required to execute a non-disclosure agreement which must be delivered to the COR prior to commencing work in accordance with DHS policy for safeguarding FOUO information.
9. SPECIAL CONSIDERATIONS
9.1. Any future deviations from awarded items must be approved by CBP Law Enforcement Safety and Compliance and the Contracting Officer.
