JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.

2. Description of the Action Being Approved.
Award a sole source firm fixed-price contract to Mississippi Department of Rehabilitation Services for the purchase of Full Food Services in support of the Roy M. Wheat Dining Facility, Naval Air Station (NAS), Meridian, MS.
3. Description of Supplies/Services.
This requirement will provide all personnel, supervision, items and services necessary to perform full fold services at the Roy M. Wheat Dining Facility as specified in the Performance Work Statement (PWS) and the Quality Assurance Surveillance Plan (QASP).
This acquisition includes a one-year base period, four (4) one-year option periods and if needed, a six (6) Month Extension of Services per FAR Clause 52.217-8, with a total estimated value of

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(5), Authorized or required by statute. Pursuant to 20 USC 107 and 34 CFR 395.33(d), Federal property managing departments, agencies, and instrumentalities may afford priority in the operation of cafeterias by blind vendors on Federal property through direct negotiations with State licensing agencies whenever such department, agency, or instrumentality determines, on an individual basis, that such operation can be provided at a reasonable cost, with food of a high quality comparable to that currently provided employees.
5. Rationale Justifying Use of Cited Statutory Authority.
Pursuant to FAR 6.302-5(a)(2)(i), full and open competition need not to be provided for when a statute expressly authorizes or requires that the acquisition be made from a specific source.

Source Selection Information – See FAR 2.101 and 3.104 on Federal property shall be afforded when the Secretary determines, on an individual basis, and after consultation with the appropriate property managing department, agency or instrumentality, that such operation can be provided at a reasonable cos, with food of a high quality comparable to that currently provided employees, whether by contract or otherwise. The Contracting Officer has determined that the Mississippi State Licensing Agency has the proper sanitation practices, personnel, staffing, menu pricing and portion sizes, menu variety, budget and accounting practices, and proven history to perform these services.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
For the follow-on contract to N6883617P0132, a pre-solicitation synopsis was posted to beta.sam.gov on 20 July 2019, to announce the anticipated requirement, and to seek interested and capable business sources. The synopsis was used a form of market research. Additional market research was conducted by querying the SBA Dynamic Small Business Search portal, which revealed twelve (12) small businesses that may have the technical capability and relevant past performance history similar to those services required at NAS Meridian, MS. The Contract Specialist contacted three of those small businesses to gauge their interest in the requirement. In addition, the Mississippi State Licensing Agency requested direct negotiation per 20 USC 107 and 34 CFR 395.33(d). The request was based on a proven track record of proper sanitation practices, personnel, staffing, menu pricing and portion sizes, menu variety, budget and accounting practices, and satisfactory Contractor Performance Assessment Rating for the previous contract N6883617P0132.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth herein, NAVSUP FLC Jacksonville has no plans at this time to compete future contracts for the types of services covered by this document. However, should a follow-on be required to this award, the Government will again conduct and review market research and the applicable statues, to assess whether competition for future requirements is feasible.
