Market research included a Request for Information posted on 29 May 2025, which received four vendor responses, with only Bell Techlogix deemed capable of meeting the requirements. The contract is funded by FY25 Navy Operations & Maintenance appropriations, and the MEEC contract is scheduled to expire on 31 July 2025, with future requirements expected to be subject to a competitive re-solicitation process.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source action is 41 U.S. Code § 1901(e)(2), Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by 10 U.S. C. § 3204(e) by FAR 13.501(a). Bell Techlogix, Inc., is the exclusive authorized reseller of Microsoft products for MEEC members; no other reseller is permitted to offer these products under MEEC.

5. Rationale Justifying Use of Cited Statutory Authority.

MEEC has maintained an agreement with Bell Techlogix, Inc. (hereafter, BTI) since 31 July 2018, under contract UMD #12477. This program enables MEEC institutions the ability to acquire desktop applications, operating system upgrades, and Microsoft Enterprise core Client Access Licenses at significantly reduced rates. The original contract was scheduled for a five-year term, spanning from 31 July 2018 through 31 July 2023.

However, it was subsequently extended through FY2024 and has now been extended through FY2025. BTI, was selected through a competitive Request for Proposal (hereafter, RFP) process, which adhered to the guidelines administered by the United States Military (hereafter, USM) Procurement Policies and Procedures on behalf of MEEC (RFP Number 83541-D).

This contractual relationship between MEEC and Bell Techlogix, Inc., grants exclusive rights for Microsoft education distribution within the State of Maryland, as authorized by the Maryland Higher Education Commission (MHEC). MHEC serves as Maryland’s higher education coordinating board and is responsible for establishing statewide policies for both public and private colleges.

The licenses and services provided under this agreement are exclusively designated for educational institutions within the region. They are specifically tailored for MEEC/Microsoft member institutions in Maryland-such as the United States Naval Academy (USNA)-and are critical to supporting USNA’s accreditation efforts and overall mission execution.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.

Both the requiring activity and contracting activity have performed market research for this requirement. Market research was performed through the review of historical purchase orders for same or similar requirements and discussions with the requiring activity. A Request for Information (RFI) was posted on 29 May 2025 with a closing date of 04 June 2025, this inquiry was presented to unlimited vendor’s.

Only four (4) timely responses were received in response. Of the four responses only one (1) vendor has the capability to provide the required supply. The following vendors provided responses to the Sources Sought/RFI posting:

Vendor Business Size Capable BHPE, LLC Small Business Not Capable- Not contracted through USM #12477 Bright Future Tech, LLC Small Business Not Capable- Not contracted through USM #12477 Bell Techlogix, LLC Large Business Capable- Contracted through USM #12477 Questivity, Inc. Small Business Not Capable- Not contracted through USM #12477

As noted in paragraph five (5) above, Bell Techlogix, Inc., (BTI) was awarded the MEEC contract though a competitive RFP process conducted in accordance with USM Procurement Policies and Procedures, with solicitations issued to all interested parties. Awarding this requirement to any other source would violate the terms and conditions of the MEEC Contract #12477 with BTI, which holds Department of Education accrediting jurisdiction over USNA. Such a violation would result in substantial duplication of prices to the Government, which cannot be offset through further competition. The BTI contract has already been awarded through a competitive process on behalf of MEEC and provides the lowest-priced bundled solution that meets USNA’s needs. Changing licensing providers at this phase is impracticable and would cause unacceptable delays in meeting the agency’s requirements.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated price to the Government for the supplies and services covered by this procurement is fair and reasonable. This procurement is a direct replacement for the annual renewal of the U.S. Naval Academy’s educational institution licensing and associated software assurance services for selected Microsoft software products, originally provided under Bell Techlogix, Inc.’s contract 12477 with MEEC. These products are uniquely bundled for MEEC within the State of Maryland and are critical to the USNA’s mission.

8. Actions to Remove Barriers to Future Competition.

The MEEC contract with Bell Techlogix, Inc., is scheduled to expire on 31 July 2025. Upon expiration, the requirement will be subject to a competitive re-solicitation process in accordance with the University System of Maryland (USM) Procurement Policies and Procedures. All eligible vendors will be afforded the opportunity to compete for the subsequent five-year contract with Microsoft.

As stated in Paragraph five (5), NAVSUP FLC Norfolk does not intend, at this time, to compete future contracts for the types of supplies/services addressed herein. Should a viable alternative source become available, NAVSUP FLC Norfolk will assess the feasibility of introducing competition for future requirements.

9. Contracting Point of Contact. The point of contact at NAVSUP Fleet Logistics Center Norfolk, Fleet Directorate is Trumeka King, Code 211.2, who may be contacted at (757) 443-1400, or by e-mail at trumeka.c.king.civ@us.navy.mil.
