PERFORMANCE WORK STATEMENT

Performance Work Statement Audio Visual Support, Maintenance and Lifecycle

1.0 Scope:

This Performance Work Statement (PWS) provides for onsite Information Technology (IT), Audio Visual (AV), Unified Communications (UC) and Video Teleconference (VTC) support personnel to the Naval Cyber Defense Operations Command (NCDOC).

2.0 Place of Performance/Delivery:

Place of performance will be:

NCDOC Head Quarters (HQ), Building 112, Suffolk, VA NCDOC COOP Site, Naval Operations Base – Norfolk, Norfolk VA Others as directed by Contract Office Representative (COR)

3.0 Background:

NCDOC is committed to providing and supporting the highest level of quality, availability and performance of collaboration services and systems. The Operations Watch Floor and the Conference Room VTC units are mission-critical systems which are essential for NCDOC personnel to satisfy mission objectives.

Building 112 and the current COOP site at NRL are a mixture of legacy systems transitioned from previous commands and prior NCDOC locations that have been reinstalled at the current NCDOC Suffolk complex under pressure of moving deadlines. With the exception of the Alternate Watch Floor (AWF), all NCDOC systems are analog and have reached the end of their lifecycle.

To ensure critical compatibility and interoperability, NCDOC will require consistent and continuous AV/IT/VTC support for the near future. Continuity of support will ensure uniform guidance, consistent project management, and enterprise documentation, and Standard Operation Procedures (SOP) repository management. Installation, maintenance and user-support is expected to be a continuing requirement as technology matures and adjustments are made to the Cyber Defense Mission in response to the ongoing evolution of cyber-warfare. It is critical that NCDOC remains flexible and technologically current to maintain an advantage against malicious intent against U.S. Navy networks.

4.0 Functional Areas:

4.1 Stereoscopic (3D) Software Support:

Provide Subject Matter Expert (SME) on the existing Mechdyne AWF Stereoscopic 3D software Packages and System Automation tools.

The current packages are:

3D Visualization Packages Mechdyne Conduit for Google Earth Mechdyne Conduit for ArcGis Mechdyne Conduit for Google Sketch Up Mechdyne vGeo Mechdyne getReal3d for Unity

System Automation Mechdyne Connection Portal

The SME will be embedded in the NCDOC operations staff to assist in loading and displaying data stereoscopically (3D) for group analysis on the AWF. The SME will also consult with NCDOC staff regarding best practices for displaying, manipulating and disseminating stereoscopic (3D) content.

Maintain configuration management plan to track changes, coordinate with NCDOC N6 for software patches/revisions, insure software is installed/configured according to DISA STIG and find root cause of problems.

Perform diagnostic test and repair to correct all stereoscopic (3D) equipment/system and software malfunctions or deficiencies, as required to maintain peak operational performance.

4.2 Design Services:

Provide A/V technical expertise through all phases of lifecycle management of A/V systems and their impact on the Command’s mission objectives.

4.3 A/V Hardware Support Services:

on existing subsystems and systems located on both the watch floor and the alternative watch floor, to ensure that replacement of outdated equipment with new technology will fully utilize existing equipment to reduce cost.

Maintain the configuration management plan to track changes, releases, and conduct root cause analyses of problems.

Provide A/V-specific technical assistance to test, troubleshoot, isolate fault and repair new and existing A/V systems and equipment. Perform adjustments, alignments and calibrations of all A/V equipment to ensure system-level capability.

Install and upgrade system hardware/software as required to maintain peak operational performance.

Perform diagnostic test and repair to correct all equipment/system and software malfunctions or deficiencies to maintain peak operational performance.

Update relevant Standard Operating Procedures, diagrams, or other documentation, as required.

4.4 Computer Networking Support Services:

Provide A/V-specialized technician support as an operator/technician to assist with day-to-day operation of currently installed A/V systems and configurations to minimize loss of production and ensure critical mission objectives are met.

Research standard networking systems to determine suitability for use with A/V systems to better utilize the existing equipment to meet NCDOC operational requirements.

Provide A/V-specific hardware support to configure, interface, maintain and troubleshoot A/V networks.

Provide A/V-specific software support to ensure smooth operation of A/V networks, availability of applicable commercial programs, and program development.

Provide A/V-specific network management to ensure operability and functionality of all A/V systems.

Augment operation team during periods of operator-shortage due to absence or during surge in operational demand.

Perform system upgrades (hardware, software, firmware and/or configuration).

Update relevant Standard Operating Procedures, diagrams, or other documentation, as required.

4.5 Operations and Maintenance Support Services:

Provide A/V-specific operation and maintenance of video/analog/digital cable plant systems;

A/V briefing and presentation, multimedia, audio, intercom and video teleconferencing systems.

Provide in-house refresher training to NCDOC personnel for operation and maintenance of the A/V systems.

Perform periodic maintenance, to ensure optimum performance of A/V systems. Perform diagnostics to determine current status of all elements of Command A/V installations.

Address any system performance issues observed by operators.

Update relevant Standard Operating Procedures, diagrams, or other documentation as required.

4.6 Unified Communications Services:

Provide A/V-specific technical staff as the Unified Communications (UC) Subject Matter Expert (SME) to support day-to-day operation of UC systems and configurations to minimize loss of production and ensure critical mission objectives are met.

UC systems are mission critical and must have 100% operational availability. These systems include, but are not limited to:

VOIP (currently unclassified only) Call/Session Managers Service Border Routers SIP Trunks to service providers Power Over Ethernet Switches End user handsets

VTC (unclassified and secure) Conference Room End points ISDN to IP Gateways Firewall Transversal Appliances

Provide A/V-specific hardware support to configure, interface, maintain and troubleshoot A/V networks.

Provide A/V-specific administration of the UC system(s) which include, but are not limited to:

New handset deployment User information changes/moves Phonebook administration Dial planes and gateway neighboring

Maintain configuration management plan to track changes, coordinate with NCDOC N6 for software patches/revisions, ensure software/hardware is installed/configured according to Defense Information Systems Administration Standard Implementation Guidelines (DISA STIG), and find root cause of problems.

Provide network management to ensure operability and functionality.

Perform diagnostic test and repair to correct all UC equipment/system and software/hardware malfunctions or deficiencies, as required to maintain peak operational performance.

Update relevant SOPs, diagrams, or other documentation, as required.

5.0 Personnel Requirements:

The contractor shall ensure personnel have current and valid professional licensing/certifications and comply with all federal, state and local environmental requirements and laws.

Contractor must meet and maintain the minimum qualification standards of their assigned Specialty Area and proficiency level as assigned under the qualifications of the Department of the Navy (DON) Cyberspace IT/Cybersecurity Workforce (IT/CSWF) and must be in accordance with Department of Defense (DoD) Directive 8140, which replaces DoD Directive 8570.01-M. An updated SECNAV M-5239.2 establishes mandatory procedures for the uniform identification, management, and qualification of the IT/CSWF.

Additionally, Contractor must participate in, at contractors expense, a continuous learning program as described in SECNAVINST 1543.2. A minimum of 40 hours of Cyber IT/CSWF related continuous learning must be annually documented and available to NCDOC's CSWF Program Manager and/or COR. All reporting Contractors must meet the requirements for their position as set forth in this PWS immediately upon arrival.

All personnel will possess:

6.0 Deliverables:

The contractor shall maintain the drawing packages to ensure system schematics/ diagrams showing all connections and configuration of devices/equipment are current.

The contractor shall maintain interconnecting cabling, interface cabling circuitry, and enclosure designs to reflect the current configuration.

The contractor shall maintain 3 and 5-year lifecycle plans, working with the government to gather technical requirements and manage impact on schedule, budget, resources, risk factors from changes in scope and objectives. These lifecycle plans shall include recommendations for expansion, upgrading, and/or obsolescence of the system, subsystem, elements and components.

7.0 Security:

All personnel must be U.S. citizen.

All personnel must have a fully adjudicated Top Secret Clearance, and be eligible for Sensitive Compartmented Information (SCI). Contractor personnel are required to be cleared at the SCI level, due to the work that must be performed on SCI Systems that are located in an SCI Facility.

Form DD-254 will be provided to authorize personnel assigned to NCDOC to proper security access levels.

All others who require access to the facility must be coordinated within 24 hours of date of arrival.

The contractor will be required to provide the following information to the COR on individuals requiring access to the facility:

All contractor personnel accessing the facility will be subjected to an onsite background check that may include fingerprint identification verification. Vehicles are subject to inspection.

Identification verification will be performed by a responsible security officer.

8.0 Government Furnished Information:

The Contracting Officer will appoint a Technical Point of Contact (TPOC) that will be the contractor’s point of contact for day-to-day operations. Name and contact information of the TPOC will be provided upon award.

9.0 Government Furnished Equipment:

The Government will not provide storage of any items unless coordinated with the TPOC.

The Government will not be responsible for any materials, equipment or any other items left in the facility.

10.0 Service Contract Reporting (NMCARS 5237.102-90)

Services Contract Reporting (SCR) requirements apply to this contract. The contractor shall report required SCR data fields using the SCR section of the System for Award Management (SAM) at following web address: https://sam.gov/SAM/.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. FEDERALLY CONTROLLED FACILITIES, SENSITIVE INFORMATION,

INFORMATION TECHNOLOGY SYSTEMS OR PROTECTED HEALTH

INFORMATION

Executive Order 13467, Reforming Processes Related to Suitability for Government Employee, Fitness for Contractor Employees and Eligibility for Access to Classified National Security Information, Homeland Security Presidential Directive (HSPD)-12, requires government agencies to develop and implement Federal security standards for Federal employees and contractors. The 5 CFR 32 Part 157 in concert with DoD Manual 1000.13, Vol 1, implements the Federal Standards.

APPLICABILITY

This text applies to all DoD sponsored individuals who require CAC eligibility (or login and P/W if acceptable per contract) for: Physical access to DoD facilities or non-DoD facilities on behalf of DoD; Logical access to information systems (whether on site or remotely); or remote access to DoD networks that use only the CAC logon for user authentication, or access to sensitive and protected information. This applies to the Office of the Secretary of Defense (OSD), the Military Departments, the Office of the Chairman of the Joint Chiefs of Staff and the Joint Staff, the Combatant Commands, the Office of the Inspector General of the DoD, the Defense Agencies, the DoD Field Activities and all other organizational entities within the DoD (hereinafter referred to collectively as the "DoD Components").

Each contractor employee providing services at a Navy command under this contract is required to obtain a DoD CAC. Additionally, depending on the level of computer/network access, the contract employee will require a successful investigation as detailed below.

ACCESS TO FEDERAL FACILITIES

Per HSPD-12 and implementing guidance, all contractor employees working at a federally controlled base, facility or activity under this clause will require a DoD CAC. When access to a base, facility or activity is required contractor employees shall in-process with the Command's Security Manager (CSM) upon arrival to the command and shall out-process prior to their departure at the completion of the individual's performance under the contract.

START-UP PERIOD

All contractor resource onboarding documents must be submitted via the prime contractor. The prime contractor shall make all necessary preparations to assume full responsibility for productive performance as of the performance start date.

Note (1): Invoicing by the contractor will begin as of the commencement of the performance period of services and no reimbursement will be paid by the government for efforts expended during the start-up period.

Note (2): Foreign Nationals are not allowed access to the functional/system side of Enterprise Resource Planning (ERP).

ACCESS TO DOD INFORMATION TECHNOLOGY (IT) SYSTEM

In Accordance With (IAW) Secretary of the Navy (SECNAV) M-5510.30, contractor employees who require access to Department of the Navy (DoN) or DoD networks are categorized as IT-I, IT-II, or IT-III. The IT-II level, defined in detail in SECNAV M-5510.30, includes positions which require access to sensitive information. Sensitive information includes information protected under the Privacy Act, to include PHI. All contractor employees under this contract who require access to Privacy Act protected information are therefore categorized no lower than IT-II. IT Levels are determined by the requiring activity's Command Information System Security Manager (ISSM)/Information Assurance Manager (IAM).

Contractor employees requiring privileged or IT-I level access, (when specified by the terms of the contract) require a Single Scope Background Investigation (SSBI) or T5 or T5R equivalent investigation, which is a higher level investigation than the National Agency Check (NAC) with Law and Credit (NACLC)/T3/T3R described below. Due to the privileged system access, an investigation suitable for High Risk national security positions is required. Individuals who have access to system control, monitoring, or administration functions (e.g. system administrator, database administrator) require training and certification to Information Assurance (IA) Technical Level 1, and must be trained and certified on the Operating System (OS) or Computing Environment (CE) they are required to maintain.

Access to sensitive IT systems is contingent upon a favorably adjudicated background investigation. When access to IT systems is required for performance of the contractor employee's duties, such employees shall in-process with the Navy CSM and ISSM/IAM manager upon arrival to the Navy command and shall out-process prior to their departure at the completion of the individual's performance under the contract. Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy IT resources. The decision to authorize access to a government IT system/network is inherently governmental. The contractor supervisor is not authorized to sign the SAAR-N; therefore, the government employee with knowledge of the system/network access required or the Contracting Officers Representative (COR) shall sign the SAAR-N as the supervisor.

The SAAR-N shall be forwarded to the CSM at least thirty (30) days prior to the individual's start date. Failure to provide the required documentation at least thirty (30) days prior to the individual's start date may result in delaying the individual's start date.

When required to maintain access to required IT systems or networks, the contractor shall ensure that all employees requiring access complete annual Cyber Awareness training, and maintain a current requisite background investigation. The contractor's security representative shall contact the CSM for guidance when reinvestigations are required.

INTERIM ACCESS

The CSM may authorize issuance of a DoD CAC and interim access to a DoN or DoD unclassified computer/network upon a favorable review of the investigative questionnaire and advance favorable fingerprint results. When the results of the investigation are received and a favorable determination is not made, the contractor employee working on the contract under interim access will be denied access to the computer network and this denial will not relieve the contractor of his/her responsibility to perform.

DENIAL OR TERMINATION OF ACCESS

The potential consequences of any requirement under this clause including denial or termination of physical or system access in no way relieves the contractor from the requirement to execute performance under the contract within the timeframes specified in the contract. Contractors shall plan ahead in processing their employees and subcontractor employees. The contractor shall insert this clause in all subcontracts when the subcontractor is permitted to have unclassified access to a federally controlled facility, federally-controlled information system/network and/or to government information, meaning information not authorized for public release.

CONTRACTOR'S SECURITY REPRESENTATIVE

The contractor shall designate an employee to serve as the contractor's security representative.

Within three (3) work days after contract award, the contractor shall provide to the requiring activity's Security Manager and the Contracting Officer, in writing, the name, title, address and phone number for the contractor's security representative. The contractor's security representative shall be the primary point of contact on any security matter. The contractor's security representative shall not be replaced or removed without prior notice to the Contracting Officer and CSM.

BACKGROUND INVESTIGATION REQUIREMENTS AND SECURITY APPROVAL

PERFORMING SENSITIVE DUTIES

Navy security policy requires that all positions be given a sensitivity value based on level of risk factors to ensure appropriate protective measures are applied. Contractor employees under this contract are recognized as Non-Critical Sensitive [ADP/IT-II] positions when the contract scope of work require physical access to a federally controlled base, facility or activity and/or requiring access to a DoD computer/network, to perform unclassified sensitive duties. This designation is also applied to contractor employees who access Privacy Act and PHI, provide support associated with fiduciary duties, or perform duties that have been identified as National Security Positions. At a minimum, each contractor employee must be a US citizen and have a favorably completed NACLC or T3 or T3R equivalent investigation to obtain a favorable determination for assignment to a non-critical sensitive or IT-II position. The investigation consists of a standard NAC and a FBI fingerprint check plus law enforcement checks and credit check. Each contractor employee filling a non-critical sensitive or IT-II position is required to complete:

- SF-86 Questionnaire for National Security Positions (or equivalent Office of Personnel Management (OPM) investigative product)

- Two FD-258 Applicant Fingerprint Cards (or an electronic fingerprint submission

- Original Signed Release Statements

Failure to provide the required documentation at least thirty (30) days prior to the individual's start date shall result in delaying the individual's start date. Background investigations shall be reinitiated as required to ensure investigations remain current (not older than ten (10) years) throughout the contract performance period. The contractor's security representative shall contact the CSM for guidance when reinvestigations are required.

Regardless of their duties or IT access requirements ALL contractor employees shall in-process with the CSM upon arrival to the command and shall out-process prior to their departure at the completion of the individual's performance under the contract. Employees requiring IT access shall also check-in and check-out with the Navy command's ISSM/IAM. Completion and approval of a SAAR-N form is required for all individuals accessing Navy IT resources. The

SAAR-N shall be forwarded to the Navy CSM at least thirty (30) days prior to the individual's start date. Failure to provide the required documentation at least thirty (30) days prior to the individual's start date shall result in delaying the individual's start date.

The contractor shall ensure that each contract employee requiring access to IT systems or networks complete annual Cyber Awareness training, and maintain a current requisite background investigation. Contractor employees shall accurately complete the required investigative forms prior to submission to the CSM. The CSM will review the submitted documentation for completeness prior to submitting it to the OPM; Potential suitability or security issues identified may render the contractor employee ineligible for the assignment. An unfavorable determination is final (subject to SF-86 appeal procedures) and such a determination does not relieve the contractor from meeting any contractual obligation under the contract. The CSM will forward the required forms to OPM for processing. Once the investigation is complete, the results will be forwarded by OPM to the DoD Central Adjudication Facility (CAF) for a determination.

If the contractor employee already possesses a current favorably adjudicated investigation, the contractor shall submit a VAR via the JPAS or a hard copy VAR directly from the contractor's security representative. Although the contractor will take JPAS owning role over the contractor employee, the Navy command will take JPAS "Servicing" role over the contractor employee during the hiring process and for the duration of assignment under that contract. The contractor shall include the IT position category per SECNAV M-5510.30 for each employee designated on a VAR. The VAR requires annual renewal for the duration of the employee's performance under the contract.

BACKGROUND INVESTIGATION REQUIREMENTS AND SECURITY APPROVAL

PROCESS FOR CONTRACTORS ASSIGNED TO OR PERFORMING NON-SENSITIVE

DUTIES

Contractor employee whose work is unclassified and non-sensitive (e.g., performing certain duties such as lawn maintenance, vendor services, etc...) and who require physical access to publicly accessible areas to perform those duties shall meet the following minimum requirements:

- Must be either a U.S. citizen or a U.S. permanent resident with a minimum of 3 years of legal residency in the U.S. (as required by the Deputy Secretary of Defense DTM 08-006 or its subsequent DoD Instruction (INST)) and

- Must have a favorably completed NACI or T1 investigation equivalent including a FBI fingerprint check prior to installation access.

To be considered for a favorable trustworthiness determination, the CSR must submit for all employees each of the following:

- SF-85 Questionnaire for Non-Sensitive Positions

- Two FD-258 Applicant Fingerprint Cards (or an electronic fingerprint submission)

- Original Signed Release Statements

The contractor shall ensure each individual employee has a current favorably completed NACI or T1 equivalent investigation, or ensure successful FBI fingerprint results have been gained and investigation has been processed with OPM.

Failure to provide the required documentation at least thirty (30) days prior to the individual's start date may result in delaying the individual's start date.

Contractor and all Contractor personnel with access to or responsibility for XXXXXX of this contract shall comply with DoD Directive 8500.1E IA, DoDI 8510.01 Risk Management Framework (RMF) for DoD IT, DoD Directive 5400.11 DoD Privacy Program, DoD 5200.2-R Personnel Security Program and HSPD 12.

X.1 Be CAC ready at the IT Level II prior to reporting for work.

X.2 At minimum, all contractor personnel must possess/maintain a favorable Tier 3 investigation; formerly a NAC with Local Agency Check and Credit Check (NACLC). This requirement is critical in order to access the data base systems within NAVSUP. It is Contracting Companies; responsibility to ensure that 100% of the contractors have the Tier 3 investigation/IT Level II. In addition, interim approval of clearances is not authorized.

X.3 Be citizens of the U.S.

X.4 If at any time, any contractor person requiring a CAC is unable to possess/maintain an adjudicated Tier 3 investigation, the contractor shall immediately notify the NAVSUP COR to coordinate removal of such a person from work under this contract.

X.5 Contractor personnel with access to or responsibility for nonpublic government data under this contract must comply with HSPD-12 Personal Identity Verification (PIV) issuance requirements, known as the CAC for NAVSUP.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.

52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)

(a) Definitions. As used in this provision--

Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

Federal contracts and grants with total value greater than $10,000,000 means--

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).

Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The offeror ( ) has ( ) does not have current active Federal contracts and grants with total value greater than $10,000,000.

(c) If the offeror checked “has” in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:

(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:

(i) In a criminal proceeding, a conviction.

(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.

(iii) In an administrative proceeding, a finding of fault and liability that results in--

(A) The payment of a monetary fine or penalty of $5,000 or more; or

(B) The payment of a reimbursement, restitution, or damages in excess of $100,000.

(iv) In a criminal, civil, or administrative proceeding, a disposition of the matter by consent or compromise with an acknowledgment of fault by the Contractor if the proceeding could have led to any of the outcomes specified in paragraphs (c)(1)(i), (c)(1)(ii), or (c)(1)(iii) of this provision.

(2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.

(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management, which can be accessed via https://www.sam.gov (see 52.204-7).

Addendum to FAR 52.212-1 – Instructions to Offerors – Commercial

In addition to FAR 52.212-1, “Instructions to Offerors – Commercial Items” and any other instructions contained elsewhere in this solicitation, the following instructions are provided.

The Government intends to award a Firm Fixed Price (FFP) contract as a result of this solicitation in accordance with FAR Part 12 and FAR Subpart 13.5. Award will be made on a sole source basis in accordance with FAR Subpart 13.5 after the price is determined to be fair and reasonable. The Government intends to evaluate the quote and award a contract based on initial quote; therefore, the Offerors’s initial quote should contain the Offeror’s best terms from a price standpoint.

Quote shall be submitted no later than the time of solicitation closing date, quoter shall submit their quote via electronic submittal to matthew.d.crotts.civ@us.navy.mil. Only electronic submissions will be accepted.
