MONTOUR TOWNSHIP BOARD OF SUPERVISORS IB-2
facilities involved, and the difficulties and restrictions attending the performance of the CONTRACT. The BIDDER shall thoroughly examine and familiarize himself with the CONTRACT DOCUMENTS. The CONTRACTOR by the execution of the CONTRACT shall in no way be relieved of any CONTRACT obligation due to his failure to receive or examine any form or legal instrument or to visit the site and acquaint himself with the existing conditions. The OWNER will be justified in rejecting any claim arising from the CONTRACTOR'S failure to fully inform himself of CONTRACT conditions. Examination of the site may be arranged by contacting Michelle DeStefano at (570) 784-4222.
4.2 BIDDERS must satisfy themselves of the accuracy of the estimated quantities in the BID Schedule by examination of the site and a review of the DRAWINGS and SPECIFICATIONS including ADDENDA. After BIDS have been submitted, the BIDDER shall not assert that there was a misunderstanding concerning the quantities of WORK or of the nature of the WORK to be done.
4.3 The BIDDER shall satisfy himself as to the conditions to be encountered overhead, on the surface, and underground. Information provided in the CONTRACT DOCUMENTS is approximated and not guaranteed, and the BIDDER assumes all risks in its usage.
4.4 BIDDERS are hereby advised that before drilling any holes or excavating any test pits for the purpose of satisfying themselves as to underground conditions, they must secure permission in writing to do such drilling or test pit excavation from authorized officials of the OWNER, governmental bodies and agencies having jurisdiction, and in addition, from private property owners.

5. BID COMPLIANCE WITH REGULATORY CONSTRUCTION REQUIREMENTS
5.1 BIDDERS shall ascertain all governmental and utility requirements with respect to trench and structure excavations, tunnel construction, blasting, equipment, materials, labor, safety and sanitation, and shall base their BID prices on full compliance therewith.
5.2 In the case where subsurface public or privately owned utility pipelines, cables or structures exist within the construction area, BIDDERS shall ascertain from each owner its rules, regulations and requirements relative to support and protection of such. BIDDERS will be assumed to have included in their BIDS pertinent costs and expenses for the above including risks, loss and damage due to such rules, regulations and requirements.
5.3 BIDDERS are required to bring to the attention of the ENGINEER any discrepancies between the design related in the CONTRACT DOCUMENTS and the above referenced regulatory requirements.
6. ADDENDA AND INTERPRETATIONS DURING BIDDING
6.1 Alterations of the CONTRACT DOCUMENTS during bidding will be addressed by ADDENDA, uploaded within PennBid’s “Documents” tab and an email notification sent to each prospective BIDDER. BIDDERS are required to acknowledge receipt of all ADDENDA in the space provided in the online Proposal Form. Failure to acknowledge receipt of all ADDENDA shall be considered just cause to reject the BID.
MONTOUR TOWNSHIP BOARD OF SUPERVISORS IB-3
6.2 BIDDERS requiring an interpretation of the CONTRACT DOCUMENTS, including ADDENDA, shall contact the ENGINEER via PennBid’s “Question” tab.
6.3 Interpretations or alterations of the CONTRACT DOCUMENTS resulting in the issuance of ADDENDA shall become part of the CONTRACT DOCUMENTS.
Oral or other interpretations or clarification will be without legal effect, with no responsibility on behalf of the OWNER or ENGINEER.
6.4 The CONTRACT DOCUMENTS contain the provisions required for the construction of the PROJECT. Information obtained from an officer, agent, or employee of the OWNER or any other person shall not affect the risks or obligations assumed by the BIDDER or relieve him from fulfilling any of the conditions of the CONTRACT.
7. BID SECURITY
7.1 Each BID must be accompanied by a BID Bond, on the form provided with this document, payable to the OWNER for ten (10%) percent of the total amount of the BID. A certified check may be used in lieu of a BID Bond.
7.2 BID Bonds shall be executed by the BIDDER and a corporate surety or sureties approved to do business in the Commonwealth of Pennsylvania and shall be satisfactory to the OWNER.
Approval by the OWNER shall be contingent, among other things, upon the listing of such corporate body or bodies in Department of the Treasury, Fiscal Service, Bureau of Accounts, Circular 570, latest revision, and a further requirement that the amount of the Bond does not exceed the underwriting limitation listed therein (without reinsuring companies) for such corporate body.
7.3 Attorneys-in-fact who sign BID Bonds must file with each Bond a certified and effective dated copy of their Power-of-Attorney.
7.4 BID Security will be applied by the OWNER towards damages in the event the BIDDER fails to execute and furnish Bonds as required in the GENERAL CONDITIONS of the SPECIFICATIONS and in accordance with the Public Works Contractor's Bond Law of 1967, or in the event an Award is made and the BIDDER fails to execute the CONTRACT and furnish evidence of insurance or Performance and Payment Bonds, or as otherwise provided herein. In the event that said BID Security is applied towards damages, the OWNER does not waive its right to bring further action against such BIDDER for any additional damages suffered because of failure of such BIDDER to comply with the terms of his BID Proposal.
8. MODIFICATION, WITHDRAWAL, AND WITHHOLDING OF BIDS
8.1 Bids may be withdrawn through the PennBid website at any time prior to the Bid Opening deadline. Once the Bid Opening deadline has passed, Bids can only be withdrawn with the consent of the OWNER. The time period to withdraw the electronic bid pursuant to 62 Pa. C.S.
Section 4604(c) shall be 48 hours.
9. SUBSTITUTIONS
9.1 Except as provided below, BIDS containing SUBSTITUTIONS or combinations of SUBSTITUTIONS will not be considered unless specifically authorized by the ENGINEER. When
MONTOUR TOWNSHIP BOARD OF SUPERVISORS IB-4
products of particular named manufacturers are specified, it is intended and shall be understood that the BID tendered includes those products.
A. Named Products: Products named (if any) first throughout the CONTRACT
DOCUMENTS constitute the ENGINEER'S design, and as such do not require approval prior to the date set for the receipt of BIDS.
B. NAMED SUBSTITUTIONS: Products of named manufacturers, other than the First named manufacturer, appearing throughout the CONTRACT DOCUMENTS are accepted as equal and do not require approval prior to the date set for the receipt of BIDS.
However, incidental changes and costs shall be the responsibility of the BIDDER and so reflected in the BID.
C. BIDDER'S SUBSTITUTIONS: Should BIDDERS desire to use products other than those named in the CONTRACT DOCUMENTS (if any), they shall submit to the ENGINEER the names of the manufacturers of such products together with descriptive information, drawings (including DETAIL SHOP DRAWINGS for similar installations), sketches or cuts, SPECIFICATIONS and experience record (including a list of at least three operating installations) of each such product. Submit such data in sufficient detail for the ENGINEER to determine if such products are equal to the named products. If such products are accepted the requirements of the previous section with regard to incidental costs shall apply. THIS INFORMATION MUST BE RECEIVED BY THE ENGINEER
FOURTEEN DAYS PRIOR TO THE DATE SET FOR THE RECEIPT OF BIDS.
UPON RECEIPT OF ANY SUCH SUBMISSION, THE ENGINEER WILL
DETERMINE WHETHER OR NOT THE PROPOSED PRODUCT IS AN APPROVED
EQUAL.
9.2 IN THE EVENT THE ENGINEER DETERMINES THAT A PROPOSED PRODUCT
IS AN APPROVED EQUAL, HE WILL ISSUE AN ADDENDUM SO NOTIFYING ALL
BIDDERS.
9.3 Where space is provided in the proposal form, the BIDDER shall indicate the manufacturer of the equipment upon which his BID is based.
10. BASIS OF BID – COMPARISON OF BIDS
10.1 Lump Sum Bid Format
A. Bidders shall submit a Bid on a lump sum basis for the Work described in the Bid Schedule.
B. The lowest responsive responsible bidder will be selected by the Owner based on the total of the lump sum bid amount for the proposal.
C. Discrepancies between words and figures will be resolved in favor of the words.
11. BID ACCEPTANCE AND REJECTION
11.1 The OWNER reserves the right, at its option, to waive any informalities, irregularities, defects, errors or omissions in any or all BID Proposals, as the OWNER may deem to be in its best interest.
MONTOUR TOWNSHIP BOARD OF SUPERVISORS IB-5
12. NOTICE OF INTENT TO AWARD
12.1 If following the review and comparison of BIDS, the OWNER shall determine to proceed with the PROJECT, it shall first issue a Notice of Intent to Award, on the form provided within these CONTRACT DOCUMENTS, to the apparent Lowest Responsible BIDDER.
13. CONTRACT SECURITY: PERFORMANCE AND PAYMENT BONDS
13.1 The party to whom the Notice of Intent to Award is given will be required to provide the Performance BOND and the Payment BOND within ten (10) calendar days from the date of receipt of the Notice of Intent to Award. The Notice of Intent to Award shall be accompanied by the necessary BOND forms, copies of which are provided within these CONTRACT DOCUMENTS.
In case of failure of the BIDDER to execute and deliver the Bonds, the OWNER may at his option consider the BIDDER in default, in which case the BID Bond accompanying the Proposal shall become the property of the OWNER.
13.2 A Performance BOND and a Payment BOND, each in the amount of 100 percent of the CONTRACT PRICE, with a corporate surety approved by the OWNER, will be required in accordance with the Contract Surety provision of the GENERAL CONDITIONS. The Performance BOND and Payment BOND shall be in the forms included in these CONTRACT DOCUMENTS.
13.3 Attorneys-in-fact who sign Payment Bonds and Performance Bonds must file with each Bond a certified and effective dated copy of their Power-of-Attorney.
14. NOTICE OF AWARD
14.1 Within ten (10) calendar days after the approval of the Bonds, the OWNER will issue the Notice of Award. The Notice of Award will be accompanied by the necessary Agreement form.
Copies of these forms are provided within these CONTRACT DOCUMENTS. The party to whom the Notice of Award is given will be required to execute the Agreement and deliver it together with the CERTIFICATES OF INSURANCE to the OWNER within ten (10) calendar days from the date when the Notice of Award is delivered to the BIDDER. In case of the failure of the BIDDER to execute the Agreement, the OWNER may at this option consider the BIDDER in default in which case the BID BOND accompanying the BID shall become the property of the OWNER.
14.2 CERTIFICATES OF INSURANCE, indicating coverage as stipulated in Section 3 of the GENERAL CONDITIONS, shall be provided by the BIDDER with each executed copy of the Agreement. In the case of the failure of the BIDDER to provide proper CERTIFICATES OF INSURANCE, the OWNER may at its option consider the BIDDER in default in which case the BID Bond accompanying the BID shall become the property of the OWNER.
14.3 The OWNER shall Award the CONTRACT to the Lowest Responsible BIDDER or shall reject all BIDS within sixty (60) days of the date of BID Opening. If the Award is delayed by the required approval of a Government, agency, the sale of Bonds, or the Award of a grant, the OWNER shall reject all BIDS or Award the CONTRACT to the Lowest Responsible BIDDER within 120 days from the date of the BID opening. Thirty (30) day extensions of the date for the Award of the CONTRACT may be made by the mutual consent of the OWNER and the Lowest Responsible BIDDER.
MONTOUR TOWNSHIP BOARD OF SUPERVISORS IB-6
15. NOTICE TO PROCEED
15.1 The Notice to Proceed shall be issued to the CONTRACTOR within thirty (30) days of the Award of the Contract unless the time is extended by mutual written consent of the OWNER and the CONTRACTOR. A copy of the form of the Notice to Proceed is included within these CONTRACT DOCUMENTS. In the case the Performance Bond, Payment Bond, Agreement and/or the Certificate of Insurance submitted by the BIDDER do not meet the requirements of the CONTRACT DOCUMENTS and changes are to be made before it can be accepted by the OWNER, the BIDDER is obligated to accept an extension of the Date of Award of the CONTRACT and/or the Date of Issue of Notice to Proceed for that period of additional time required to furnish acceptable documents.
16. CONTRACT TIME
16.1 The number of days within which, or the date by which, the WORK is to be completed (the CONTRACT TIME) is set forth in the Agreement.
17. LIQUIDATED DAMAGES
17.1 Provisions for LIQUIDATED DAMAGES, if any, are set forth in the Agreement.
18. SUBCONTRACTORS
18.1 BIDDER'S attention is called to the provisions of the GENERAL CONDITIONS and SUPPLEMENTAL GENERAL CONDITIONS with regard to Subcontractors.
18.2 If requested by the OWNER, the BIDDER shall submit a list of all proposed SUBCONTRACTORS to be utilized on the PROJECT. Said SUBCONTRACTORS, including major suppliers, shall be subject to the same BID requirements and obligations as the BIDDER, and shall submit qualifications and certifications if requested by the OWNER.
18.3 If the OWNER after due investigation has reasonable objection to any proposed SUBCONTRACTOR, the OWNER may before giving the Notice of Intent to Award request the BIDDER to submit an acceptable Substitute without an increase in BID price. If the BIDDER declines to make any such Substitution, the CONTRACT shall not be awarded to such BIDDER, but his declining to make any such Substitution will not constitute grounds for sacrificing his BID Security. Any SUBCONTRACTOR to whom the OWNER or ENGINEER does not make written objection prior to the giving of the Notice of Award will be deemed acceptable to OWNER.
Such acceptance shall in no way relieve the BIDDER or SUBCONTRACTOR from any BID or CONTRACT obligation or responsibility.
19. COMPLIANCE WITH FEDERAL, STATE AND LOCAL LAWS
19.1 All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the PROJECT shall apply to the BID and CONTRACT throughout the BID and CONTRACT Period.
