STATEMENT OF WORK

1. Introduction: The requiring activity is Norfolk Naval Shipyard (NNSY), Portsmouth, Virginia. NNSY currently requires a firm, fixed price contract for Preventive Maintenance Program (PM) and Remedial Maintenance for Forging Equipment located inside Buildings 163 and 510 at NNSY.

2. Performance: The contractor shall provide all technicians, transportation, equipment, parts, tools, materials, supervision and all other items / services necessary to perform on-site Preventive Maintenance Program (PM) and Remedial Maintenance for eleven (11) pieces of Forging Equipment listed in Table 1. The Statement of Work (SOW) services shall consist of all the major maintenance checks and services that are recommended by each manufacturer along with any necessary reactive services to minimize machine down time.

3. Equipment Specifications: Contractor shall perform Preventive Maintenance Program (PM) and Remedial

Maintenance for the Forging Equipment listed in Table 1.

3.1. Addition or removal of machines shall be available through bi-lateral agreement throughout duration of contract.

Addition of additional machines shall be priced as needed according to machine type. Proposals shall be generated as needed for additional machines.

4. Contractor Responsibilities:

4.1. "Per FAR 22.102-1(a) entitled "Safety", Contractors are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard cognizance must follow Federal and State OSHA requirements; Norfolk Naval Shipyard OSHE Program Manual, NAVSHIPYDNORINST P5090.2 requirements;

OSHE Control Manual (OSHECM) requirements; or safety requirements for site specific location of the contract."

4.2. Preventive Maintenance (PM) for Forging Equipment:

4.2.1. Contractor shall provide an annual Preventive Maintenance Program. The program shall consist of all the major maintenance checks recommended by each manufacturer. All comprehensive checks shall be made by factory-trained technicians on all Mechanical and Electrical systems coupled with all recommended standard checks.

4.2.2. Contractor shall provide Norfolk Naval Shipyard with a preventive and comprehensive diagnostic report that provides an overall assessment of machine condition and performance.

4.2.3. Performance tests shall provide an automatic diagnosis of all press functions. Each error shall be ranked according to its significance to overall performance, safety and conformance to NFPA requirements alongside the error value.

4.2.4. The Preventive Maintenance Program shall apply to each piece of Forging Equipment listed in Table 1.

At a minimum preventative maintenance, checks and services shall include the following as applicable:

4.2.4.1. Hydraulic Power Unit (HPU):

4.2.4.1.1. Check oil level

4.2.4.1.2. Take oil sample and send to NNSY

4.2.4.1.3. Inspect motors and pumps, remove guards and inspect pump to motor connections and pump seals.

4.2.4.1.4. Check unit for oil leaks (valves, piping, hoses, etc.)

4.2.4.1.5. Change oil filters as needed

4.2.4.1.6. Inspect tank breather and replace if needed

4.2.4.1.7. Inspect heat exchanger and cooling system temperature and flush heat exchanger if needed

4.2.4.1.8. Remove and inspect oil tank magnetic trappers, clean, and re-install

4.2.4.1.9. Check accumulator pre-charge

4.2.4.1.10. Check system pressures

4.2.4.1.11. Replace hydraulic oil filters if needed.

4.2.4.2. Lubrication System and Manual Lubrication Points:

4.2.4.2.1. Check grease level and add grease if needed

4.2.4.2.2. Check lines and hoses for leaks and ruptures

4.2.4.2.3. Inspect lubrication pump for operation

4.2.4.2.4. Check manual lube points and lubricate as needed

4.2.4.3. Presses:

4.2.4.3.1. Inspect press frame for signs of damage

4.2.4.3.2. Check main ram for leaks and gland flange bolts for tightness

4.2.4.3.3. Adjust packing if needed

4.2.4.3.4. Inspect aux cylinders for leaks and operation

4.2.4.3.6. Inspect valves and manifolds for leaks or broken coils, wiring, etc.

4.2.4.3.10. Check guide clearances

4.2.4.4. Electrical Components:

4.2.4.4.1. LOTO Main breaker once power has been removed

4.2.4.4.2. Check for loose or damaged wiring on terminals

4.2.4.4.3. Check indicator lights

4.2.4.4.4. Check limit switches

4.2.4.4.5. Check pressure switches and pressure transducers

4.2.4.4.6. Check position feedback

4.2.4.4.7. Check controls PLC for faults or warnings

4.2.4.4.8. Check push buttons and selector switches

4.2.4.4.9. Check HMI screen for operation

4.2.4.4.10. Check Panduit covering and insulating covers are in place if used

4.3. Remedial Maintenance (RM) and Spare Parts Request:

4.3.1. The contractor shall provide remedial maintenance and repair on all Forging Equipment listed in Table 1.

Upon notification that the equipment is inoperative.

4.3.2. Remedial maintenance shall be performed and billed by the contractor as repairs are required and needed. Upon receiving notification from the Contracting Officer (KO) that equipment repair is necessary, the contractor shall troubleshoot the problem and provide the TPOC with a repair estimate.

4.3.3. Not-to-Exceed CLIN: Remedial maintenance CLINs are priced as a not-to-exceed type CLIN to allow the flexibility for repairs to be conducted as needed throughout the year. Any funding not utilized for parts or remedial maintenance services shall be returned to the government.

4.3.4. Remedial Maintenance Service Requirements: The equipment shall be repaired and maintained in accordance with OEM specification. The KO will approve all estimates prior to the repair parts ordered and repair work completed.

4.3.5. Remedial Maintenance Call during Performance Assurance (PA) service call: If remedial maintenance service is required while the PA technician is on site, every attempt shall be made to diagnose and fix the problem, provided the service does not impede on the technician’s ability to finish the scheduled PA for the week. If it is determined that the technician will not be able to perform the PA due to the remedial maintenance needed, another technician shall be called in to perform the necessary remedial maintenance.

4.3.6. Remedial Maintenance Service Response Time: The contractor shall respond on site within seven (7) workdays after notification by the Contracting Officer (KO). Workdays countdown begins the next business day after notification by the KO.

4.3.7. Urgent Request Response Time: The contractor shall respond on site no later than five (5) workdays after notification by the Contracting Officer (KO). Workdays countdown begins the next business day after notification by the KO.

4.3.8. Downtime Determination: Downtime will begin the next business day after the KO contacts the contractor’s representative, including answering services or by e-mail during working hours.

4.3.9. Service Call Ticket: Contractor shall establish a service call ticket that includes the date and time that the service call was received with the name and phone number of requestor. Service call ticket shall be available in electronic forms (PDF).

4.4. Replacement Parts and Materials:

4.4.1. The contractor shall use OEM parts or parts of equal quality in making repairs.

4.4.2. Replacement of Spare Parts: The contractor shall provide all materials needed to accomplish maintenance and repairs on all machines in support of scheduled annual maintenance.

4.4.3. Disposal of Replaced Parts: Non-consumable parts that have been removed from the equipment and replaced are the property of the Government. The contractor shall dispose of non-consumable parts removed from the equipment after receiving approval for disposal from the COR. The contractor shall dispose of consumable parts, such as gaskets and filters, IAW applicable Municipal, State, and Federal Regulations.

4.4.4. Estimated repairs, labor, and spare parts shall include a minimum of the following listed in Table 2.

4.5. Reports: At the end of each maintenance or repair visit, the contractor shall provide the TPOC with a written report (within 10 days) detailing services rendered. Report shall be available in electronic forms (PDF) and contain the following.

4.5.1. PM Reports: PM reports (CDRL A001) shall be completed and submitted for all of the machines listed in Table 1 within 10 calendar days after each PM Service. PM reports shall contain a minimum of the following:

4.5.2. Remedial Maintenance Repair Report: The contractor shall submit a comprehensive, detailed Remedial Service report (CDRL A002) within 10 calendar days after each remedial service for all unscheduled minor and major adjustments, repairs, emergency repairs, non-emergency repairs and repair resolution services. Unscheduled repair reports shall include a description of repairs completed, cost breakdowns of parts and labor, and all applicable information regarding tests, calibrations and/or measurements taken to verify repair and operation of the machine.

4.6. Warranty of Parts: All PM and RM maintenance and repairs shall carry the standard commercial warranty from the time of repair.

4.7. Quality Assurance (QA): The Government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This QASP is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards.

It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) (defect rate).

4.7.1. Quality Management System (QMS): The Contractor shall establish and maintain a complete QMS program in accordance with the provisions specified herein. The Contractor’s QMS program shall provide an effective and efficient means of identifying and correcting problems throughout the entire scope of operations. The Contractor's QMS program shall address:

4.7.1.1. Accurate documentation of work processes, procedures, and output measures.

4.7.1.2. A systematic procedure for assessing compliance with OEM specifications.

4.7.1.3. Accurate documentation of quality inspections and surveillance conducted throughout the execution of work.

4.7.1.4. Assessment-driven corrective actions and process adjustments as appropriate in a timely manner.

4.7.2. Quality Management (QM) Plan: The Contractor shall develop and submit a QM Plan (CDRL A003) per the (QASP) within 30 calendar days after award and within 7 calendar days of any changes. The QM Plan shall describe the QMS methodology and approaches used under this contract. If any changes are made during the period of performance, submit to the revised QM Plan to the COR. The COR will forward the revised QM Plan to the Contract Officer (KO) for acceptance. The Contractor’s QM Plan shall include, at a minimum, the following:

4.7.2.1. Policy and objectives of Quality Management System (QMS)

4.7.2.2. Quality organization

4.7.2.2.1. List of personnel

4.7.2.2.2. Responsibilities & lines of authority

4.7.2.2.3. Training and qualifications

4.7.2.3. Approach to assuring quality of services provided and conformance with OEM specifications

4.7.2.4. Methods and procedures for effective planning, operation and control of processes and performance of work

4.7.2.5. Procedures for inspection and surveillance of services

4.7.2.5.1. Scheduling and performance of inspection and surveillance

4.7.2.5.2. Measurement, data collection and analysis

4.7.2.5.3. Corrective action, preventive action, and continuous improvement

4.7.2.5.4. Oversight of subcontracted work

4.7.2.6. Documentation and records management

4.7.2.7. Communication with Government (customers)

4.7.3. Quality Inspection and Surveillance: The Contractor shall establish and maintain an inspection and surveillance system in accordance with the FAR Clause 52.246-4, INSPECTION OF SERVICES – FIXED PRICE, to ensure that the work performed conforms to the contract requirements. The Contractor shall document and maintain a file of all scheduled and performed inspections and surveillances, inspection and surveillance results, and dates and details of corrective and preventive actions. The quality inspection and surveillance file shall be the property of the Government and made available during the Government’s regular working hours. The file shall be turned over to the KO within five calendar days of termination of the contract.

4.7.4. Quality Inspection and Surveillance Report: The Contractor shall submit a copy of the Contractor Quality Inspection and Surveillance Report (CDRL A004) per the QASP within 30 calendar days of each Quality Inspection and Surveillance. The Contractor Quality Inspection and Surveillance Report shall include a summary and results of the quality inspection and surveillance events performed and assessment-driven corrective actions and process adjustments during the previous month. The Government may adjust the frequency of the submittal based on the Contractor’s quality of performance.

4.7.5. Quality Assurance Provisions: Equipment shall be operational and serviceable after completion of each service call. Prior to leaving the area, the contractor shall demonstrate to the COR, TPOC, or designated alternate that the equipment is operational and shall provide a Certificate of Completion (COC) attesting to the work completed meets all technical requirements. After maintenance and repairs have been completed, the contractor shall provide a Certificate of Completion (CDRL A005) attesting to the work completed meets all technical requirements and the COR, TPOC, or designated alternate will certify that the equipment performs to OEM standards and sign the service call ticket.

4.7.5.1. Disputes: Any disputes between the maintenance technician and the TPOC, or designated alternate regarding satisfactory performance will be immediately referred to the Contracting Officer (KO).

4.7.5.2. Repair vs Replacement: The contractor shall notify the TPOC if it is determined that repair of a machine would exceed the replacement cost of the same or comparable machine. The contractor shall not be expected to perform the repair if repair costs exceed the cost of replacement.

5. Shipyard Responsibilities: The shipyard will be responsible for the following.

5.1. Lifting and Handling work involving use of a crane.

5.2. Clean large amounts of oil, dirt, chips etc. from the machine.

5.3. Disposal of oil waste.

5.4. Providing any consumables upon request. Consumable items provided will include the following items:

5.4.1. Coolant

5.4.2. Oil

5.4.3. Grease

6. Certification of Work Requirements: TPOC will verify that quality of services are accomplished in accordance with paragraph 1 of this SOW after each service is complete.

7. Safety and Security: Contractor must secure access to the CIA.

7.1. Personal Protection Equipment (PPE). Contractors are required to provide their own PPE.

7.2. "Per FAR 22.102-1(a) entitled "Safety", Contractors are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard cognizance must follow Federal and State OSHA requirements and Norfolk Naval Shipyard OSHE Program Manual, NAVSHIPYDNORINST P5090.2 requirements or safety requirements for site specific location of the contract."

7.3. Initial Base Entry:

7.3.1. 30 days before arrival, contractor shall provide SECNAV 5512 data on all personnel expected to visit

NNSY. TPOC shall provide SECNAV 5512 forms upon request. The TPOC will endorsed the SECNAV 5512 form and forward to the NNSY Pass Office.

7.3.2. Personnel having existing valid base passes will be exempt from this requirement. Existing base passes must be valid for the duration of the expected visit.

7.4. Vehicle Entry: The company name shall be displayed on each door of the Contractor's vehicles in a manner and size that is clearly visible. All vehicles shall display a valid state license plate that complies with State Vehicle Code. Vehicles shall meet all other requirement of the State Vehicle Code, such as safety standards, and shall carry proof of insurance and state registration. Insurance and registration must be in the company’s name.

Passes will be issued for vehicles to enter the shipyard. A separate pass is required for

8. Critical time Constraints:

8.1. The Performance Assurance program shall be performed during working days between the hours of 7:20 AM and

3:50 PM excluding any federal holidays. Time periods outside of these boundaries may be negotiated on a case-by-case basis.

8.2. Schedule Services: The contractor shall schedule and perform PM Checks / services and Calibration. PM Checks and Calibration on the initial batch of IPE shall be conducted within 60 days after contract award. The contractor shall coordinate with the TPOC at least 14 working days prior to performing PM’s.

13. Travel Charge: All travel will be IAW Joint Travel Regulation and calculated at the prevailing JTR rates.

14. Defense Biometric Identification Systems (Dbids) For Installation Access:

Any new contractor, vendor or supplier requesting base access AFTER 31 May 2017 will be required to obtain a DBIDS credential. NCACS credentials will no longer be issued. Only DBIDS credentials will be issued to ALL contractors, vendors and suppliers seeking base access AFTER 14 August 2017.

Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions. The system provides a continuous vetting anytime the DBIDS card is scanned at an installation entry point.

If you currently have a Navy Commercial Access Control System (NCACS) card, the following is required to get a DBIDS credential:

• Present your NCACS Card and a completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center representative.

• The VCC will pull up your information in the computer, ensuring all information is current and correct.

• Once your information is validated, a temporary DBIDS credential is provided.

• Your temporary credential will have an expiration date, prior to which you will need to obtain your permanent DBIDS credential (~ 90 days).

• For each additional U.S. Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the Visitor Control Center.

• The representative will enter base access authorization and then you may proceed to work.

If you do NOT have an NCACS Card, the following is required to obtain a DBIDS credential:

• Present a letter or official document from my government sponsoring organization that provides the purpose for your access.

• Present valid identification, such as a passport or Real ID Act-compliant state driver's license.

• Present a completed copy of the SECNAV 5512/1 form to obtain your background check.

• Upon completion of the background check, the Visitor Control Center representative will complete the DBIDS enrollment process, which includes your photo, finger prints, base restrictions, and several other assessments; after all this is done, you will be provided with your new DBIDS credential.

• You may now proceed to work.

Participation in the DBIDS is not mandatory, and if the Contractor chooses to not participate, the Contractor's personnel will have to obtain daily passes, be subject to daily mandatory vehicle inspection, and will have limited access to the installation. The Government will not be responsible for any cost or lost time associated with obtaining daily passes or added vehicle inspections incurred by non-participants in the DBIDS.

15. Portable Electronic Devices (PEDS):

"In accordance with COMSUBLANT/COMSUBPACINST 2075.1C, the use of Portable Electronic Devices (PEDs) while in or on Department of Navy Submarine spaces are prohibited. A portable electronic device (PED) is defined as any non-stationary electronic apparatus with singular or multiple capabilities of, but not limited to recording, storing, and/or transmitting data, voice, video, or photo images (e.g., cell phones, laptops, tablets and wearable devices such as fitness bands and smart watches)."

16. Safety:

Per FAR 22.102-1(a) entitled "Safety", Contractors are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard cognizance must follow Federal and State OSHA requirements OSHE OSHECM Chapter Hazardous Energy Control (HEC) requirements or safety requirements for site specific location of the contract.

a. Contractors and Non-NNSY Government Agencies (NNGAs) are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard (NNSY) cognizance must adhere to Federal OSHA requirements for hazardous energy control IAW 29 CFR 1915.89 and must follow Hazardous Energy Control (HEC) procedures as identified in NAVSEA’s Occupational Safety, Health, and Environment Corporate Manual (OSHECM) Chapter 250 (latest revision), when performing work under NNSY contract. All HEC work to be performed by Contractors and NNGAs requires that NNSY Technical Points of Contact (TPOCs) and/or Contracting Officer’s Representatives (CORs) be notified of the HEC scope of work prior to starting work. Any changes or deviations in the initial scope of HEC work requires the NNSY TPOCs and/or CORs be informed of the change/deviation. Appendix 250.B-1 through B-3 of OSHECM Chapter 250 for multiple employer work identifies when Contractors and NNGAs are required to assign their Lockout/Tags-Plus Coordinator (LOTC) to coordinate HEC work with the cognizant NNSY LOTC. HEC locks shall be provided by the contractor or NNGA for their employees use. The HEC locks shall have red bodies with name labels or nametags affixed, identifying who installed the HEC lock(s) and a point of contact telephone number. HEC lock name labels and tags must be made of materials that will hold up to the environment to which they are exposed. HEC tags used for Tags-Plus HEC work shall be provided by the cognizant NNSY LOTC to the contractor or NNGA for their use if machinery, equipment, or systems (MES) cannot be locked out. OSHECM Chapter 250 Tags-Plus procedures will be strictly followed.

17. Afterhours Access:

Contractors are to go to Gate 15 and let the guards know they are to provide services/support via contract N4215821-P- SXXX. It would be helpful for them to have a copy of the contract. The guards at the gate will then call the Base Precinct and subsequently be escorted to Bldg. 1618 to have a badge made.

18. Authorization of Additional Work:

Any additional work outside the scope of this contract/purchase order shall have written authorization from the Contracting Officer prior to executing any additional work. Any work performed without the written authorization of the Contracting Officer shall be considered “At-Risk” and the government will have no legal obligation to pay for the work performed.

Pursuant to 13.004(b), once you have initiated performance of the work, this shall constitute your acceptance of the task order.

52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)

(a) Definitions. As used in this clause--

Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the

Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction

(CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices

(including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by

Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE

SERVICES OR EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered

Telecommunications Equipment or Services--Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror

Representations and Certifications-Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for

Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM)

(https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [] will, [] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--
