About this file

This document contains the contract terms, required forms, and certifications for the CIESC Region 9 Child Nutrition Cooperative's Request for Proposal (RFP) for K12 Food Distributor and Group Purchasing Organization services for the 2027-2028 school year across Indiana. The RFP solicits competitive sealed proposals from qualified food distributors to supply products and services to public agencies and educational institutions that are recipients of federal Child Nutrition Program funds. The document does not specify item quantities, response deadlines, site visits, bidders' conferences, or award dates; rather, it establishes the contractual framework and mandatory compliance requirements that all bidders must acknowledge and meet to be considered responsive and responsible. The contract term covers the 2027-2028 school year, with provisions allowing CIESC or participating School Food Authorities to terminate the agreement for convenience with thirty days' written notice, or immediately in cases of health and safety concerns, regulatory non-compliance, or serious food safety issues.

Pricing terms are not detailed in this document, though it specifies that vendors must operate on an allowable-cost basis with no payment exceeding actual, net allowable costs, and all end-user discounts, rebates, and credits must be returned to School Food Authority nonprofit accounts. The RFP includes mandatory set-asides encouraging participation by small, minority-owned, women-owned, and historically underutilized businesses, though such participation is not a condition of award. Vendors must comply with extensive federal and state requirements including USDA Buy American provisions, nondiscrimination statutes, E-Verify employment verification, debarment and suspension certifications, food safety and HACCP protocols, and various federal labor and environmental standards. Funding sources include federal Child Nutrition Program appropriations and state/local school food service accounts. All bidders must submit notarized Non-Collusion Affidavits, E-Verify declarations, debarment certifications, and if the contract exceeds $100,000, Byrd Anti-Lobbying Amendment certifications and Clean Air and Water Act compliance statements.

5. The Business Entity has verified that any subcontractors utilized to deliver services to the Governmental Entity through the Business Entity’s contract with the Governmental Entity use the E-Verify system and do not knowingly employ persons whose immigration status makes them ineligible to work for the subcontractor.
