This document is a Disaster Related Grant Provisions attachment outlining 2 CFR Part 200 Uniform Guidance contract requirements and Federal Emergency Management Agency (FEMA) mandates applicable to the City of Bradenton's Water Treatment Plant and Drinking Water Distribution System Facilities Plan project. The City of Bradenton is soliciting a qualified engineering firm to develop a comprehensive 20-year facilities plan that addresses Florida Department of Environmental Protection requirements under Rule 62-552, F.A.C., and incorporates specific documentation addressing damage, impacts, loss of service, or disruption caused by Hurricanes Helene and Milton. The facilities plan must be completed by October 30, 2026, and the contract will be funded through the Supplemental Agreement – Helene and Milton (SAHM), a FEMA-supported disaster recovery funding mechanism.
The project is subject to extensive federal compliance requirements including Davis-Bacon Act wage provisions (if applicable), Equal Employment Opportunity mandates, debarment and suspension certifications, Byrd Anti-Lobbying Amendment certifications for contracts exceeding $100,000, Contract Work Hours and Safety Standards Act requirements, Clean Air Act and Federal Water Pollution Control Act compliance, procurement of recovered materials under EPA guidelines, prohibition on covered telecommunications equipment, domestic preference for U.S.-produced goods, and affirmative contracting requirements with small and minority businesses and women-owned enterprises. The contractor must provide access to records for audit by FEMA, the Comptroller General, and authorized representatives; comply with all applicable federal laws and executive orders; and grant the City paid-up, royalty-free licenses to all data and work products created during contract performance. Termination provisions allow the City to terminate for convenience with 30 days' notice or for cause with 10 days' cure opportunity, and the contractor may terminate only if the City fails to pay within 90 days or suspends the project beyond 90 days.
