About this file

This is a Bidder/Contractor Responsibility Form issued by Tacoma Public Schools (School District #10) in Washington State, effective January 17, 2025, outlining mandatory contract requirements and compliance certifications that contractors must complete prior to receiving a purchase order. The form applies to the E-Rate 2026 Category 2 contract opportunity. Contractors must execute multiple submissions before work commences, including a Statement of Intent to Pay Prevailing Wages filed online with the Department of Labor & Industries, an Affidavit of Prevailing Wages Paid upon project completion, and proof of required insurance coverage naming the school district as an additional insured for at least $1,000,000 per occurrence. A Notice of Completion must be submitted by the District for all projects exceeding $35,000 before retainage can be released, which requires Letters of Release from the Department of Revenue, L&I, and Employment Security.

Retainage terms vary by project cost: projects under $150,000 allow contractors to either obtain a performance bond with 5% retainage withheld or waive the bond and accept 10% retainage; projects exceeding $150,000 require a performance bond with 5% retainage mandatory. Contractors must certify compliance with prevailing wage requirements under RCW 39.12 and the Davis-Bacon Act, registration with the Washington Department of Labor & Industries, current state unified business identifier numbers, industrial insurance coverage, employment security department registration, and state excise tax registration. Contractors must also verify they are not disqualified under RCW 39.06.010 or RCW 39.12.065(3), have not been found in willful violation of wage and hour laws within three years preceding the bid date, and for federally funded work, are not debarred or suspended from federal contracting. For projects exceeding $1,000,000, compliance with apprenticeship utilization requirements under RCW 39.04.320 is mandatory. Contractors must demonstrate either completion of Department of Labor & Industries training on public works requirements or three or more years of valid business licensing and three completed public works projects to satisfy RCW 39.04.350 and RCW 39.06.020 compliance.
