14.01 Lump Sums
A. Bidders shall submit a Bid on a lump sum basis for each Lump Sum Bid Item listed in the Bid Form.
B. The Bid for all Lump Sum Bid Items shall be included in the Total Base Bid.
14.02 Project Allowances
A. Bidders shall submit a Bid on a unit price or lump sum basis for each Allowance Bid Item listed in the Bid
Form.
B. For unit price allowances, the total of each Allowance Bid Item will be the product of the estimated quantity of each item and the corresponding unit price. The final quantities and Contract Price will be determined in accordance with Paragraph 11.03 of the General Conditions.
C. The Bid for all Allowance Bid Items shall be included in the Total Base Bid.
D. The Bid price shall include such amounts as the Bidder deems proper for overhead and profit on account of allowances, if any, named in the Contract Documents as provided in Paragraph 11.02 of the General Conditions.

The price for each alternate will be the amount added to or deleted from the Total Base Bid if Owner selects the alternate.
14.04 Comparison of Bids
LEHIGH COUNTY AUTHORITY ̶ KLINES ISLAND WWTP April 2026
002113 – 7
A. For determination of the apparent low Bidder, Bids will be compared on the basis of the Total Base Bid, plus, in the order of priority listed on the Bid Form, the additive/deductive alternate Bid prices for determination of the apparent low Bidder.
ARTICLE 15 - SUBMITTAL OF BID

15.02 A Bid shall be submitted no later than the date and time prescribed in the Advertisement, Notice to Bidders and on PennBid.
ARTICLE 16 - MODIFICATION AND WITHDRAWAL OF BID
16.01 A Bidder may withdraw his Bid from consideration after the Bid opening without forfeiture of the cashier's check, surety bid bond or other security filed with the Bid if the price bid was submitted in good faith, and the Bidder submits credible evidence that the reason for the price bid being substantially lower was a clerical mistake as opposed to a judgment mistake, and was actually due to an unintentional and substantial arithmetical error or an unintentional omission of a substantial quantity of work, labor, material or services made directly in the compilation of the Bid.
Withdrawal is allowed only if (i) notice of a claim of the right to withdraw such Bid is made in writing with the Owner within two (2) business days after the opening of Bids; and (ii) the withdrawal of the Bid would not result in the awarding of the contract on another Bid of the same Bidder, his partner, or to a corporation or business venture owned by or in which he has a substantial interest. No Bidder who is permitted to withdraw a Bid shall supply any material or labor to, or perform any subcontract or other work agreement for any person to whom a contract or subcontract is awarded in the performance of the contract for which the withdrawn Bid was submitted, without the written approval of the Owner.
16.02 If a Bid is withdrawn in accordance with the provisions of §16.01, the Owner may award the contract to the next lowest Bidder or reject all Bids and resubmit the project for bidding. In the event the Owner resubmits the project for bidding the withdrawing Bidder shall pay the costs, in connection with the resubmission, of printing new contract document, required advertising, and printing and mailing notices to prospective Bidders, if the Owner finds that such costs would not have been incurred but for such withdrawal. In no event shall the withdrawing Bidder be permitted to resubmit a Bid for the Project.
16.03 Prior to the Bid opening date and time a Bidder may modify or withdraw its Bid at anytime via PennBid’s “
Bid Form” tabs.
ARTICLE 17 - OPENING OF BIDS
17.01 Bids will not be opened and read aloud publicly. An abstract of the amounts of the Total Base Bid and major alternates, if any, will be made available to Bidders after the opening of Bids using PennBid’s “Award” tab.
ARTICLE 18 - BIDS TO REMAIN SUBJECT TO ACCEPTANCE
18.01 All Bids will remain subject to acceptance for the period of time stated in the Bid Form, but Owner may, in its sole discretion, release any Bid and return the Bid security prior to the end of this period.
ARTICLE 19 – EVALUATION OF BIDS AND AWARD OF CONTRACT
LEHIGH COUNTY AUTHORITY ̶ KLINES ISLAND WWTP April 2026
002113 – 8
19.01 Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to not be responsible or responsive. Owner may also reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder.
Owner also reserves the right to waive all informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder.
19.02 More than one Bid for the same Work from an individual or entity under the same or different names will not be considered. Reasonable grounds for believing that any Bidder has an interest in more than one Bid for the Work may be cause for disqualification of that Bidder and the rejection of all Bids in which that Bidder has an interest.
19.03 In evaluating Bids, Owner will consider whether or not the Bids comply with the prescribed requirements, and such alternates, unit prices and other data, as may be requested in the Bid Form or prior to the Notice of Award.
19.04 In evaluating Bidders, Owner will consider the qualifications of Bidders and may consider the qualifications and experience of Subcontractors, Suppliers, and other individuals or entities proposed for those portions of the Work for which the identity of Subcontractors and Suppliers must be submitted as provided in §12.01.
