About this file

This is a Supplementary Conditions document that amends the Standard General Conditions of the Construction Contract for the City of Leander Pond Maintenance 2027 Project in Texas. The supplementary conditions modify provisions related to document furnishing, site conditions, bonds and insurance requirements, contractor responsibilities, wage rates, unit price work adjustments, and work stoppage conditions. The Owner will provide up to two printed copies of drawings and project manuals plus one electronic set, with additional copies available at reproduction cost. The contractor must acknowledge that the Owner has no reports or knowledge of subsurface explorations, physical site conditions, or hazardous environmental conditions at the site.

Insurance requirements are substantially modified, mandating workers' compensation coverage with statutory limits under the Texas Workers' Compensation Act, employer's liability coverage of $1,000,000, general liability with per-occurrence limits of $1,000,000 and aggregate limits of $2,000,000, and automobile liability of $1,000,000 per occurrence for both bodily injury and property damage. The contractor must maintain builder's risk all-risk property insurance for the full replacement cost of the work at the site. The Owner is exempt from Texas sales and compensating use taxes on materials incorporated into the work. Prevailing wage rates apply per Texas Government Code Chapter 2258, with penalties of $60 per worker per day for non-compliance. Unit price work is subject to reevaluation if bid price amounts to five percent or more of contract price and quantity varies by more than 20 percent from estimates. The contractor must maintain adequate housekeeping, prevent spoil materials in public rights-of-way, obtain authorization for street closures, and comply with all project permits, with failure to do so constituting cause to stop work. The contractor must preserve all contracting information per Texas Government Code Subchapter J, Chapter 552, for the duration of the agreement and either provide it to the Owner at no cost upon completion or maintain it per applicable records retention requirements.
