The Period of Performance is 62 calendar days commencing upon issuance of the Notice to Proceed, with an anticipated window of August 31, 2026 through October 30, 2026, subject to coordination with the Refuge Manager based on weather conditions and water flow. The contractor must obtain a USFWS escort for site access through private property and comply with federal and state regulatory requirements, OSHA standards, and more stringent safety programs if applicable. Work shall be performed Monday through Friday, 7:30 AM to 4:00 PM Pacific Time, excluding Federal Holidays, with weekend work requiring 24-48 hours advance approval. Key deliverables include a project schedule (10 days after NTP), demolition plan (5 calendar days prior to demolition), Quality Control plan (5 calendar days prior to construction), material submittals, weekly daily construction reports, inspection and testing reports, as-built drawings, and a final completion package within 10 calendar days after project completion.

STATEMENT OF WORK
PARKER CREEK MEASURING WEIR REPLACEMENT
U.S. Fish and Wildlife Service
Modoc National Wildlife Refuge – Alturas, California
July 21, 2026
1.0. GENERAL INFORMATION
1.1 Contractor shall provide materials and services to remove and replace an existing two-bay, stop-board, weir structure located in the Parker Creek Diversion Canal. This project will replace the in-canal concrete water control structure required for managing water to the
Refuge and neighboring lands. The Project is located at the Modoc NWR in Alturas, Modoc
County, California.
1.2 Contractor’s Qualifications: Contractor shall be experienced and have demonstrated positive past performance with the design and construction of various concrete, “pour-in-place” water control structures.
1.3 Regulatory Requirements: It is the Contractor’s responsibility to complete the Project in compliance with applicable requirements of federal and state laws, codes, rules, regulations, ordinances, and standards.
2.0. WORK LOCATION AND PERIOD OF PERFORMANCE
2.1 Work Location: Modoc National Wildlife Refuge (MNWR), 5364 County Road 115, Alturas, California 96101.
• The Parker Creek Diversion Canal is the responsibility of USFWS, however, access to the project site is through private property, USFWS escort is required.
2.2 Period of Performance: The Period of Performance shall be 62 calendar days and will commence upon issuance of the Notice to Proceed (NTP). The Contractor shall receive the NTP within 10 calendar days after contract award. The anticipated Period of Performance is
August 31, 2026 - October 30, 2026.
The period of performance for this contract is tentative and subject to change. Actual project work window may be dependent on weather conditions and water flow in the canal.
Contractor shall coordinate with the Refuge Manager for a proposed project work window.
The final accepted work window will be mutually agreed upon between the Contractor and the Refuge Manger prior to work beginning.

3.0. BACKGROUND
The Modoc National Wildlife Refuge (MNWR) is owned and operated by the U.S. Fish and
Wildlife Service (USFWS). The Refuge is in the northeast corner of California, approximately
3.5 miles southeast of the town of Alturas. The next nearest town, Likely California, is approximately 13 miles south of the Refuge. The Refuge has identified a requirement to replace one (1) concrete, two-bay, stop-board water control structure. The existing structure has started to degrade over time and has reached the end of its life span. This water control structure is essential to the Refuge and neighboring landowners meeting their water right obligations.
The project includes but is not limited to the following elements:
• Mobilization and de-mobilization.
• Staging of any equipment and materials.
• Removal and proper disposal of existing structure.
• Pour-in-place new structure including all related components.
Please note, the above bullet list is not intended to be comprehensive, it is simply provided as a baseline.
4.0. SCOPE OF WORK
The Contractor shall provide all labor, supervision, materials, equipment, tools, transportation, permits, testing, and incidentals necessary to construct a replacement water control structure at
Parker Creek. The project shall be completed using a design-build strategy. A schematic of the completed structure and elevations is required, however, does not need to be fully engineered plans. The Contractor shall be responsible for verifying all field conditions, measurements, elevations, and dimensions necessary to prepare the final design and complete construction. The
Contractor shall provide an official strategy of all drawings, calculations, specifications, schedule, and other supporting information necessary to demonstrate that the proposed structure will meet the required function and performance of the existing structure.
5.1 The Contractor shall remove and dispose of the existing water control structure and construct a new reinforced concrete, two-bay stop-log water control structure with wing walls. The newly replaced structure shall maintain the same operational purpose, hydraulic capacity, approximate dimensions, and general location as the existing structure unless otherwise approved by the Fish
& Wildlife Service (FWS). The new structure shall include stop-log rails capable of supporting overlapping 2-inch-wide lumber, a staff gauge or metering gauge to monitor water levels, and a crossing platform or access feature over the structure to allow safe passage from one side of the canal to the other.

5.2 The Contractor shall take all necessary elevation measurements, field surveys, and site observations required to establish proper placement and function of the new structure. The
Contractor shall ensure that all adjacent facilities, including nearby water control structures, canals, utilities, and other existing improvements, are protected from damage during demolition and construction activities.
5.3 The Contractor shall provide and submit basic design sketches, and any required calculations for Modoc National Wildlife Refuge (MNWR) – COR review and acceptance prior to beginning construction. Construction shall not begin until the submittals has been reviewed and accepted. Modoc National Wildlife Refuge (MNWR) and COR review does not relieve the
Contractor of responsibility for design accuracy, code compliance, structural adequacy, or performance of the project completed by state, federal, and government laws.
5.4 The Contractor shall perform all Quality Control (QC) inspections and testing necessary to ensure the completed work meets industry standards, applicable codes, manufacturer recommendations, and accepted engineering practices. Where specific technical standards are not identified, the Contractor shall comply with recognized industry standards and consensus-based standards for water control structures and reinforced concrete construction.
5.5 There is no-fill material available on site. The Contractor shall provide all gravel, fill, aggregate, and imported materials necessary to complete the project. All fill materials shall be clean, weed-free, and suitable for the intended application.
5.6 The Contractor shall take all precautions necessary to protect private property, fencing, gates, livestock, crops, existing roads, utilities, and any other features within or adjacent to the project site. The Contractor shall coordinate with the COR and Refuge Manager regarding access routes, work hours, and any special site restrictions.
• All vehicles and equipment shall cleaned of weeds and weed seeds prior to entering the premises.
5.7 Staging areas for equipment, materials, and temporary storage shall be coordinated with and approved by the COR and Refuge Manager prior to mobilization.
5.8 The Contractor shall maintain and remove all debris, waste materials, excess soil, and construction-related materials from the site. The Contractor shall restore all disturbed areas to pre-project conditions, including grading, smoothing, reseeding, or other restoration measures as necessary.

6.0 GENERAL REQUIREMENTS.
Contractor shall provide supervision, labor, materials, equipment, tools, and services necessary for proper execution and completion of this project.
6.1 Quality Assurance: Contractor shall implement a Quality Assurance/Quality Control
(QA/QC) Plan to verify products and services are free of errors or omissions.
6.2 Communications: Contractor shall direct contract related inquiries in writing or electronically to the Contracting Officer during the pre-solicitation, solicitation, and contract period of performance. Contractor shall direct technical-related inquiries in writing or electronically to the Refuge Manager or COR.
6.3 Pre-project Meeting: After contract award and prior to commencement of work, the Refuge will arrange for a pre-construction meeting. This meeting may be virtual or face to face at the
Modoc NWR Office. Meeting is expected to take place within fourteen (14) days after issuance of the contract award and take no longer than two (2) hours.

Meeting will address the contract requirements and identify and resolve any ambiguities or discrepancies. Other topics include matters of significant interest, including who has authority to decide matters such as contractual, administrative (e.g., security, safety, and fire and environmental protection) and project responsibilities. This meeting will also address area access, staging areas for equipment and materials, and any other questions or concerns that may arise.
6.4 Diligence: Contractor shall perform all project activities efficiently and with the requisite expertise, skill, and competence to satisfy the requirements of the contract documents. The contractor shall, at all times, exercise complete and exclusive control over the means, methods, sequences and techniques used for this project.
6.5 Supervision: Contractor shall provide a Project Supervisor on-site at all times while work is underway. Supervisor shall have a good working knowledge of the project work.
6.6 Project Safety: Contractor shall always be ultimately responsible for health and safety on the worksite.
a. Contractor shall provide barricades and warning devices as necessary to safeguard the public, workers, and Government personnel.
b. Contractor shall initiate and maintain, throughout the performance of this contract, an effective health and safety program that provides adequate policies, procedures, and practices to protect workers from (and allow them to recognize) job-related health and safety hazards.
c. Each employee (Contractor or subcontractor) must be instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment.
d. The contractor shall adopt the Occupational Health (SOH) Program as a starting point for
Safety Program requirements. In the event a more stringent Safety Program exists, the more stringent Safety Program shall be applied to the Contract / Project by the Contractor.
6.9 Site Cleanup: Contractor shall remove trash and debris from the worksite daily. Before completing the contracted work, Contractor shall remove any rubbish, tools, equipment, and materials that are not the property of the Government. Upon completion of work, Contractor shall leave the work area clean, neat, and in the same condition as prior to the project.
6.10 Material, Equipment, Transportation, Handling and Storage:
a. Government-owned equipment will not be made available to the Contractor for use within

Modoc National Wildlife Refuge – Alturas, California this contract. Government buildings and other facilities are not available for storage of the
Contractor’s materials, equipment, and tools. The Government will designate areas for use during the project for materials and equipment. These areas will be discussed at the pre-bid site visit and during the pre-project meeting. Government dumpsters will not be used by contractors for this project.
b. Contractor shall have a representative onsite to receive material deliveries. Contractor will be responsible for all material deliveries, whether or not their representative is on-site at the time of delivery.
c. Contractor shall transport, handle and store materials and equipment in a secure manner and in accordance with the manufacturer’s written instructions.
d. Contractor shall promptly remove from the worksite any material(s) and equipment which are damaged or are otherwise unsuitable.
7.0 GOVERNMENT FURNISHED ITEMS.
No Government Furnished Material or Government Furnished Equipment will be provided.
7.1. General: The Contractor shall furnish all materials, supplies, equipment, facilities, and services required to perform work under this contract.
8.0 CODES AND STANDARDS.
8.1 Safety Standards: Contractor shall adhere to Occupational Safety and Health Administration
(OSHA) 29 CFR 1910 and 1926, as well as other applicable DOI, USFWS, State and local regulations. In the event of a conflict, the most stringent laws, codes, regulations, standards, and provisions shall apply.
9.0 INSPECTION AND ACCEPTANCE.
9.1 Inspection and acceptance will be determined by the USFWS.
9.2 Acceptance of the work is contingent on compliance with the requirements set forth in the specifications, and other documents awarded with (or referenced by) the contract for this project.
10.0. FINAL WALK THROUGH.
10.1 The USFWS will perform the final walk through as promptly as practicable.

10.2 The time required for such walk through shall be requested within 24-48 hours and for making any corrections as a result thereof shall be included in the contract performance scheduled and time.
10.3 The Contractor’s representative responsible for the work will be present at the final walk through.
11.0.GOVERNMENT AVAILABILITY.
12.1 Government is available Monday through Friday from 7:30 AM to 4:00 PM (Pacific
Time), excluding Federal Holidays. Availability outside those dates/hours shall be coordinated with the Refuge Manager at least two business days in advance.
12.0. WORK HOURS.
13.1 Work shall be performed between Monday and Friday, 7:30 AM to 4:00 PM (Pacific Time), excluding Federal Holidays. Work outside those dates or hours shall be coordinated with the Refuge Manager at least two business days in advance.
13.2 Weekend work shall be requested within 24-48 hours for approval by Contract Officer
Representative (COR) and Refuge Manager.
13.3 USFWS escort is required unless previously arranged with the COR and Refuge Manager.
