About this file
This is a Proprietary Information directive from the City of Arlington, Texas, Office of Procurement, applicable to a Request for Proposal (RFP) for Kayak and Paddleboard Self-Service Rental Units and Program Management. The solicitation establishes a contract for a turnkey self-service kayak and paddleboard rental program encompassing design, fabrication, delivery, installation, operation, maintenance, customer service, and removal or relocation of equipment at City-designated park locations. The City of Arlington strongly encourages electronic submission of proposals but accepts sealed paper submissions labeled with company name, solicitation number, and title. All solicitations are disseminated exclusively through Bonfire, and the City assumes no responsibility for solicitations received through alternative channels. Late proposals will not be accepted.
The document outlines the City's requirements regarding proprietary information designations. All material submitted becomes public property subject to the Texas Public Information Act upon receipt. Vendors may designate specific pages or sections as proprietary by clearly marking them with the word "PROPRIETARY" in all capitals and highlighted yellow on the bottom center of each page at submission time. The City will endeavor to protect such information to the extent allowed by law, though final disclosure decisions rest with the Texas Attorney General. Notably, pricing information cannot be marked proprietary and will be publicly released in bid/proposal tabs following review of all submittals. Failure to properly identify proprietary information will result in unmarked sections being deemed non-proprietary and available upon public request.

1.0 PROPRIETARY INFORMATION
i. All material submitted to the City becomes public property and is subject to the Texas Public Information Act upon receipt.
ii. If a Vendor does not desire information that it believes to be proprietary in the submittal to be disclosed, the Vendor must list each page number in the chart below and must clearly mark and identify each page by including the word “PROPRIETARY” in all caps and highlighted yellow on the bottom center of each page at the time of submittal. The City will, to the extent allowed by law, endeavor to protect such information from disclosure. The final decision as to the information that must be disclosed lies with the Texas Attorney General. Note: Pricing may not be marked proprietary and will be made publicly available in the form of a bid/proposal tab following review of all Submittals. By submitting a response, Vendors agree that pricing is not proprietary and may be released.
iii. Failure to identify proprietary information will result in all unmarked sections being deemed non-proprietary and available upon public request.
