City of Wichita 3 RFB #260155

1. OVERVIEW AND SUMMARY

The City of Wichita is the largest city in Kansas with a population of approximately 397,000 and is the seat of Sedgwick County. As of May 2024, the City’s total land area was approximately 167 square miles. Major highways, including the Kansas Turnpike (I-35), Interstate 135 and U.S. 54 (Kellogg Avenue) link the City with a large trade area that encompasses a population of more than 1.1 million people within a 100-mile radius. The City of Wichita employs approximately 3,100 employees providing a full range of municipal services, including police and fire protection, parks and recreation programs, libraries, public housing, municipal transportation, airports, water and sewer utilities, general administration, and other services.

Information regarding the City of Wichita can be found at wichita.gov. The legislative body of the City consists of a six-member City Council, elected by district, and a full-time Mayor elected from the City-at-large. The Council members and the Mayor serve four-year terms overlapping. The Council and Mayor establish general policies, which are executed by the City Manager.

The City of Wichita is soliciting request for bids from vendors and/or firms for Sale of Scrap Metal Collection, Removal, and Disposal for Various City Departments, Boards, & Agencies. The City reserves the right to award all, some, or none of the goods/services set forth in this Request for Bid (RFB) to any one proposer based on the City’s review and assessment of the bids meeting the criteria/specifications set forth herein.

The City of Wichita through its operation in various department activities generates scrap metal waste through cleaning, installation, and maintenance functions. These activities require the services of a vendor to purchase scrap metal generated by various City departments estimated to be six hundred (600) to seven hundred (700) tons annually. These quantities are estimates only and in no way guarantee the amount of scrap metal to be generated. The successful bidder must have the ability to legally facilitate collection, removal, and disposal of City scrap metal. An awarded firm will be expected to oversee the provision of scrap metal containers/collection sites on City property, routinely collect City scrap metal aggregated at determined sites, and ensure appropriate disposal in compliance with local, state, and federal law outlining environmental disposal practices and procedures.

2. SCOPE OF SERVICES

A. Estimated Usage & Locations:

The successful bidder will be required to furnish approximately eight (8) to ten (10) suitable containers for holding the scrap metal at the following locations:

• 1801 S. McLean Blvd Wichita, KS 67213 (Public Works & Utilities Department/Central Maintenance Facility);

• 4100 N. West St. Wichita, KS 67205 (Public Works & Utilities Department/Brooks Landfill Facility);

• 1825 S. McLean Blvd Wichita, KS 67213 (Public Works & Utilities Department/Water Distribution Facility);

• 3100 S. Grove St. Wichita, KS 67216 (Public Works & Utilities Department/Sewage Treatment Facility);

• 2305 E. 57th St. S. Wichita, KS 67216 (Public Works & Utilities Department/Sewage Treatment Facility);

• 1245 S. McLean Blvd Wichita, KS 67213 (Park & Recreation Department/Park Maintenance Facility);

• 777 E. Waterman Wichita, KS 67202 (Transit Department/Transit Maintenance Facility);

• Locations identified by the City throughout the duration of the agreement requiring services

Containers will be labeled for each site outlining address information.

B. Ongoing Usage & Service Requirements:

The containers should be of sufficient size to handle a normal accumulation of scrap metal between collections. Items too large to fit in the containers can be placed next to the containers for pickup by the https://www.wichita.gov/

Our Mission as an exceptionally well-run city, we will: Keep Wichita safe; Grow our economy; build dependable

City of Wichita 4 RFB #260155 successful bidder. The successful bidder will ensure ability to outline an itemized monthly statement that includes:

• Labeling each container and/or site location picked up;

• Identify the type of scrap metal/material collected at each container and/or sit location pick up in each.

The City will be responsible for seeing that the scrap metal is segregated and placed in the proper container.

The City will also be responsible for not “overfilling” the containers. The successful bidder will provide the City definition and guidance of “overfilling” to ensure City compliance and safety standards are met. The City will notify the successful bidder when the container(s) are full so they can be picked up and replaced with another container. All containers must be picked up in a timely manner after notification by the City to avoid overfilling. Instances of delayed Contractor pickup after a period of 48 hours’ notice by City will be outside the City’s responsibility to transport or account for overfilling materials due to failure of Contractor pickup response time.

Prior to removing the scrap metal from any location, the Contractor’s driver must notify City personnel designated at each location. Upon return with the empty container, the successful bidder’s driver will leave a copy of an automated, machine stamped, pre-numbered weight ticket generated from the scale equipment.

This weight ticket must show the date, City Department and Division, address of pickup, type of scrap metal, weight, etc. A ticket with the same information must also be given to the City employee when scrap metal is taken to the successful bidder’s yard.

C. Reporting Requirements & Documentation Standards:

Awarded bidder must demonstrate ability to generate automated, machine stamped, pre-numbered weight ticket generated from the scale equipment. This weight ticket must show the Date of Service, City Facility Address (if picked up at City location; Contractor address for City transported material), Identification of Scrap Metal/Material Collected, Weight, etc. A ticket with the same information must also be given to the City employee when scrap metal is taken to the successful bidder’s yard. City employees will be expected to identify their name, department, and City employee number for recording purposes.

Vendor will provide automated ticket(s) generated from the prior month’s scrap metal activity that will accompany the monthly statement outlining itemized scrap metal activity each month. No handwritten tickets will be allowed.

When feasible, the City will provide clean metals. If “unclean metals” (scrap metal with concrete, asphalt, dirt, sand, or metal of no value) are received by the successful bidder, “a reasonable poundage or percentage deduction” will be allowed from the total scrap weight. The awarded bidder will note on the weight ticket the total poundage or percentage deduction taken, and the reason it was taken (concrete, asphalt, sand, dirt, metal of no value, etc.). The City will rely on the successful bidder’s determination what a fair deduction is for the “unclean metals.”

The monthly statement with associated scrap metal collection activity will be remitted each month with payment that may include Automated Clearing House (ACH) payment (preferred) or check. Revenue payment activity will include itemized tickets to allow reconciliation against detailed account activity sent to:

City of Wichita Treasury, 455 N. Main – 12th Floor, Wichita, KS 67202. City contracts awarded to the responsive bidder will be expected to outline language surrounding late fees, charges, and payments for

Our Mission as an exceptionally well-run city, we will: Keep Wichita safe; Grow our economy; build dependable

City of Wichita 5 RFB #260155 failures to remit timely revenue checks. Please account for this expectation in a submitted vendor response submission.

The City reserves the right to periodically conduct on-site visits of the successful bidder’s yard to ensure the certificate of inspection on the scale is inspected annually, as required by State law, to observe the weighing of scrap metal and to observe how the “poundage or percentage deduction” is determined on “unclean metals.” The City may also conduct periodic independent weight checks prior to pickup by the successful bidder to ensure reliability of their scales and services rendering processes. All scrap metal must be weighed on a certified public weight scale as the successful bidder will be held accountable for accuracy of the scrap metal’s weight.

D. Contract Pricing & Market Index Usage:

The successful bidder will reimburse the City monthly by the fifteenth (15th) of the following month through Automated Clearing House (ACH) payment. City contracts awarded to the responsive bidder will be expected to outline language surrounding late fees, charges, and payments for failures to remit timely revenue checks.

Please account for this expectation in a submitted vendor response submission. Alternative payment options may be entertained by the City’s Treasurer, but ACH payment is preferred. Contract pricing will be established upon the lowest bidder’s costs deducted from the prior 12-month average calculated at the point of contract execution (i.e. – If contract execution date is September 2026, the prior 12 months encompassing September 2025 – September 2026 will determine the price per ton distributed to the City (minus the lowest bidder’s costs proposed). The subsequent annual renewal periods will determine the next 12 months of pricing to be distributed to the City from the prior term’s 12 months of Federal Reserve Economic Data (FRED): Federal Reserve Bank of St. Louis – Producer Price Index by Commodity: Metal and Metal Products (WPU10) reporting, applicable to the specific groupings outlined below:

E. Scrap Pricing Example:

An example of industry standard scrap collection may be No. 2 Copper Scrap, including Wire is remitted by pound (lb). In this example, the City recently awarded a contract September 2026 and have requested their first pick up date at Brooks Landfill in October 2026. The net revenue disbursement to the City will be calculated by taking the abovementioned market rate average per ton minus the Contractor’s cost as awarded form this solicitation. The pricing for the Contractor’s cost will be awarded from their low bid meeting specifications subtracted from the market rate per ton for a net revenue disbursement to the City.

To convert Copper pounds collected to tonnage, the awarded firm agreed to the 12-month average, rounded to the nearest hundreds decimal point from the most recently reported April 2025 – April 2026 market pricing.

The 12-month average is calculated through the following:

Month of Activity Market Price

(WPU10230102)

4/1/2025 $857.042 5/1/2025 $860.668 6/1/2025 $923.064 7/1/2025 $967.669 8/1/2025 $899.033 9/1/2025 $873.524

10/1/2025 $1,042.996 11/1/2025 $1,057.327 12/1/2025 $1,100.668

1/1/2026 $1,175.7 2/1/2026 $1,221.747 3/1/2026 $1,202.557 4/1/2026 $1,135.966

12 Month AVERAGE $1,024.458538

The 12-month AVERAGE price per ton can be converted to industry standard pounds (lbs) through the following:

• 1 U.S. Ton = 2,000 lbs https://fred.stlouisfed.org/series/WPU10230104 https://fred.stlouisfed.org/series/WPU103 https://fred.stlouisfed.org/series/WPU103103 https://fred.stlouisfed.org/series/WPU10310231

Our Mission as an exceptionally well-run city, we will: Keep Wichita safe; Grow our economy; build dependable

City of Wichita 7 RFB #260155

• Price per Lb Formula: $1,024.46/2,000 = $0.51223, rounded to $0.51/per lb for No. 2 Copper

The Lowest bidder awarded outlined a cost of $100/ton for No. 2 Copper. The City’s contract would outline a collection of one (1) ton for No. 2 Copper to remit $1,024.46/ton - $100/ton = $924.46/ton NET REVENUE to the City for a price of $0.46223, rounded to $0.46/lb for No. 2 Copper for the initial 1-year term of the contract pricing.

If 20 pounds of No. 2 Copper are collected by the Contractor, the City will expect a monthly statement outlining October 2026’s activity to reflect a revenue check owed from scrap metal collection at the Brooks Landfill facility amounting to $9.24 (20 x $0.46/lb).

F. Annual Renewal Pricing:

Contract pricing will be updated during the period of annual renewal exercised by mutual parties. The updated pricing for the next 12 months will be based upon the rotating average from the prior 12 months of pricing data published on the Federal Reserve Bank of St. Louis (FRED) Producer Price Index by Commodity:

Metals and Metal Products (WPU10) and the appropriate Commodity Subgroup listed above (101-103). This federal agency publication will determine the amount paid to the City per ton collected for scrap metal.

G. Additional Service Requirements & Considerations:

The following Conditions and Requirements for this project are outlined:

1. Fuel surcharges for transporting the material shall not be allowed. The low-cost bid shall be inclusive of all fees for contractor-provided containers and transportation, as applicable.

2. Contractor shall operate in compliance with OSHA and DOT regulations. Contractor shall possess and keep in force all licenses, business permits and other permits required to perform the services of this Agreement.

a. Scrap Metal processed in Kansas will require an awarded vendor to have a KDHE Solid

Waste Processor Permit. If an awarded bidder only recycles and is not processing scrap metal, no permit is required (See KDHE BWM Policy 2011-P3 for guidance).

b. Scrap Metal recycled will require licensure to operate within the City limits and have each collection vehicle inspected annually, as outlined in Chapter 7.08 of the Municipal Code. If an awarded vendor is not currently operating inside the city limits, the company may wait to obtain a license and pay for the vehicle inspections upon awarding before any executed City contract is provided.

3. The successful bidder will be required to furnish a certificate of insurance certifying insurance coverage as required by the City, including the City’s listing as additionally insured as outlined in 5. INSURANCE REQUIREMENTS.

4. Attached are spreadsheets from 2024 & 2025 Scrap Metal Payments and quantities with product that the City of Wichita turned in for scrap metal.

5. The quantities outlined have been adjusted to show an estimate of quantities expected annually.

These quantities are estimates only and in no way guarantee the amount of scrap metal to be generated.

6. All bidders are expected to comply with the following, or bids will not be considered (copies of the below referenced items may be submitted electronically as part of a bid submission):

a. A sample automated, machine stamped, pre-numbered weight ticket must accompany the bid. No handwritten tickets will be allowed.

b. Proof of certified public weight scales must be submitted with the bid (certificate, letter, etc.).

Challenges A challenge is defined as a written objection by any party interested in responding to either a bid or proposal (collectively referred to as solicitations), when that party wishes to have the City consider an addition, substitution or modification to the specifications stated in the outstanding solicitation.

The written challenge of the solicitation specifications must be filed with the Purchasing Manager located on the 12th Floor, Finance Department at City Hall, 455 N Main, Wichita, KS 67202, telephone number

(316) 268-4636, at least five (5) business days before the solicitation opening due date and time as listed on the solicitation documents. Any challenge to solicitation specifications received after the five (5) business days deadline will not be considered by the City. The Purchasing Manager will acknowledge receipt of the challenge. The written challenge is to include the name, address, email address and telephone number of the interested party, identification of the solicitation number and project title, a detailed statement of the reasons for the challenge, supporting evidence or documentation to substantiate any arguments, and the form of relief requested, e.g. the proposed addition, substitution or modification to the specifications. The Purchasing Manager will investigate the written challenge and any evidence or documentation submitted with the challenge.

In the event of a timely challenge of the solicitation specifications to the Purchasing Manager, the affected pending solicitation shall not proceed further until the challenge is resolved by Purchasing Manager decision. Our Mission as an exceptionally well-run city, we will: Keep Wichita safe; Grow our economy; build dependable

City of Wichita 12 RFB #260155

A protest is defined as a written objection to a proposed award, or the award of a contract, with the intention of receiving a remedial result. In order to be considered valid, a protest must 1) come from an actual bidder or proposer for the contract, 2) who claims to be the rightful award recipient, 3) whose economic interest may be affected substantially and directly by the award of a contract or by the failure to award a contract. Suppliers or subcontractors to a bidder or proposer cannot file a valid protest. A valid protest can only be filed by a bidder or proposer which can show that it would be awarded the contract if the protest were successful. Therefore, all conditions numbered 1 through 3 listed above in this paragraph must be met.

The written protest for bids must be filed with the Contract Compliance Officer located on the 12th Floor, Finance Department, City Hall, 455 N Main, Wichita, KS prior to 9:00 a.m. of the Tuesday immediately following the posting of the notice of intent to award on the City’s Purchasing Bid Results site wichita.gov/purchasing. Failure of a protestor to file a written protest related to the award of a contract prior to the 9:00 a.m., Tuesday deadline will invalidate that protest and cause it not to be considered.

The written protest for proposals must be filed with the Contract Compliance Officer located on the 12th Floor, Finance Department, City Hall, 455 N Main, Wichita, KS prior to 5:00 p.m. on the third business day following the day of issuing an email or written notification of award. Failure of a protestor to file a written protest related to the award of a contract prior to 5:00 p.m. on the third business day deadline will invalidate that protest and cause it not to be considered.

The Contract Compliance Officer will acknowledge receipt of the written protest. The written protest is to include the name, address, email address and telephone number of the protestor, identification of the solicitation number or contract number and project title, a detailed statement of the reasons for the protest which justify the relief sought, supporting evidence or documentation to substantiate any arguments, and a concise statement of the form of relief requested (e.g. reconsideration of the offer). All the above required information must be included in the protest at its submission. Untimely protests will be returned unopened. Incomplete protests will be rejected without consideration.

In the event of a valid, timely protest, the City shall not proceed with the execution of the contract until all City administrative remedies have been exhausted or waived, or until a determination is made that a contract award is required to protect the interests of the City.

The decision of the Contract Compliance Officer, based on review of the written protest and information available from City sources, will be rendered within ten (10) business days after receipt of protest, will recite the reasons for the decision, and be provided to the protestor by email or written notification.

The protestor may seek reconsideration of the decision of the Contract Compliance Officer’s decision in writing to the Internal Auditor on the 13th Floor, City Manager Office, City Hall, 455 N Main, Wichita, KS prior to 5:00 p.m. on the third business day following the day of issuing an email or written notification of decision. Failure of a protestor to file a written reconsideration request related to the Contract Compliance decision prior to 5:00 p.m. on the third business day deadline will invalidate that protest and cause it not to be considered. The Internal Auditor decision will be issued by email or written notification, within ten (10) business days after receiving the written reconsideration, unless this time for a response is extended in writing and agreeable by both parties.

The Internal Auditor’s decision will be final, unless the protestor seeks a hearing before the City Council, Our Mission as an exceptionally well-run city, we will: Keep Wichita safe; Grow our economy; build dependable

City of Wichita 13 RFB #260155 by written request filed with the City Clerk, located on the 13th Floor, City Hall, 455 N Main, Wichita, KS, prior to 5:00 p.m. on the third business days after issuance of the Internal Auditor written decision.

Failure of a protestor to file a written reconsideration request related to the internal Auditor’s decision prior to 5:00 p.m. on the third business day deadline will invalidate that protest and cause it not to be considered.

If there is a timely written reconsideration request, the protestor may seek reconsideration of the decision of the Internal Auditor by means of a hearing before the City Council. This hearing must be in aid of the City Council’s legislative authority to approve contracts for goods, services, and public improvements on behalf of the City, and does not imply any due process right of the protestor in an unawarded, unexecuted contract. The hearing must be scheduled as soon as practicable according to the City Council’s calendar. The hearing must be granted only upon such facts and issues as are presented in writing to the City Clerk for submission to City Council at or before noon on the Thursday preceding the scheduled hearing. No documents or other evidence must be accepted at the hearing. The protesting party must have available no more than 20 minutes for presentation of argument, followed by no more than 20 minutes of argument presented by City staff. The City Council may deliberate in executive session to seek the assistance of the City Attorney, but must deliver its decision from the bench during the City Council meeting.

If a written protest is made against any proposed award or the award of a contract that relies in part on federal funding, then the Contract Compliance Officer must notify the Granting Authority in writing with all information regarding the protest. A protestor must exhaust all administrative remedies with the City of Wichita before pursuing a protest with the Granting Authority. Protestors are put on notice that according to federal regulations, certain determinations made at the local level are not subject to appeal to the Granting Authority. If a review is granted by the Granting Authority, it will be limited to:

1. the City of Wichita’s failure to have or follow its protest procedures, or its failure to review a complaint or protest; or

2. violations of Federal law or regulations.

The Contract Compliance Officer will provide notice to the Granting Authority Regional Office or Headquarters Office of any request for reconsideration before the City Council, and also provide notice of the decision rendered by the City Council, or any alternative resolution reached.

4. CONTRACT PERIOD AND PAYMENT TERMS

The term of this contract shall be for a one (1) year period with up to four (4) one (1) year options to renew under the same terms and conditions by mutual agreement of both parties. Specific project details (Statement of Work, Milestones, etc.) will be negotiated prior to execution of contract. Once goals as outlined are met and parties mutually agree that terms have been satisfied, the contract shall be complete.

Either party may cancel its obligations herein upon thirty-day (30) prior written notice to the other party. It is understood that funding may cease or be reduced at any time, and in the event that adequate funds are not available to meet the obligations hereunder, the City reserves the right to terminate this agreement upon thirty (30) days prior written notice to the contracted party.
