About this file

This document is a General Terms and Conditions specification issued by Waukesha County, Wisconsin for Bid #2026003 regarding the supply of Hot Patch and Cold Patch Asphalt. The county is seeking qualified vendors to provide hot patch and cold patch asphalt materials for both county and state use. The specification does not establish exact quantities but indicates that approximately $60,000 has been allotted for 2026 projects for county use, with state purchases to be made as needed. Bidders must submit responses electronically through Waukesha County's Bonfire website, with submissions accepted up to the deadline specified in the portal. The contract term will commence on April 1, 2026, and extend through March 31, 2027, with the option for four additional one-year renewal periods at the sole discretion of the county. Award may be made to multiple vendors to ensure appropriate coverage, and the county reserves the right to make cooperative purchasing available to other Wisconsin local government units through V.A.L.U.E. in Local Government.

Pricing must remain firm throughout the initial contract term. For subsequent renewal periods beyond the first year, pricing may be adjusted in accordance with the Bureau of Labor Statistics Producer's Price Index for Asphalt Paving Mixture & Block Manufacturing, using the 12-month percent change from the most recently reported month in the current year compared to the same month of the previous year, or three percent, whichever is lower. The county prefers payment via P-Card (VISA), with vendors required to include all credit card processing fees in their quoted prices. For vendors unable to accept credit card payment, the county will process payment within thirty days of acceptance of goods and receipt of a properly documented invoice. Foreign corporations and other business entities must obtain a Wisconsin Department of Financial Institutions certificate of authority or registration within ten business days of award but prior to contract execution to be eligible. All receipts for products must include the printed name, signature, and department name of authorized county personnel, and vendor failure to obtain this documentation will result in non-payment for those purchases.
