About this file
This is an Administrative Code document from the City of Palm Bay, Florida, establishing procedures for the donation of surplus City-owned single-family lots to Community Housing Development Organizations (CHDOs) for the development of affordable housing. The code outlines the City Manager's approval authority and assigns responsibilities to the Community & Economic Development Director, City Council, and City Attorney's Office for identifying, evaluating, and processing surplus properties. The procedures require annual reviews of City-owned real estate by the CED Director to identify properties zoned for single-family development that are not needed for future municipal use, parks, stormwater management, or conservation purposes. Properties must be presented to the City Manager with supporting documentation including market value assessments from the Brevard County Property Appraiser, acquisition and maintenance costs, and projected tax revenue from future single-family home construction.
City Council approval is required before property donation or sale and must consider the public purpose of the transaction, estimated market value in both current and developed conditions, City costs incurred, and projected revenue generation. Upon approval, the CED Director coordinates with the City Attorney's Office to execute contracts that include construction commencement timelines, performance requirements, affordability periods, and clawback provisions for non-performance. The administrative code, which became effective August 1, 2024, replaces AC-72 and establishes a streamlined process for facilitating affordable single-family housing development in Palm Bay through qualified CHDOs designated by the U.S. Department of Housing and Urban Development.
