Two (2) Sport Utility Vehicles (SUVs)

1. Business Registration in Thailand

We are a U.S. (overseas) vendor with operational presence in Southeast Asia based in Malaysia with a company representative in Chiang Mai. We do not have a Thai business registration. Section 3 of the solicitation requests evidence that the offeror operates an established business with a permanent address in Thailand, and DOSAR 652.242-73 references authorization to operate in the country of performance.

We intend to partner with a Thai-registered, Toyota-authorized dealer who will supply and service the vehicles. Do we, as the SAM-registered U.S. prime contractor of record, satisfy the Thailand business presence requirement through its authorized Thai dealer partner — or is a Thai business registration required of the prime offeror itself?

This solicitation is open to all qualified offerors. If an offshore vendor chooses to subcontract with a local vendor, that arrangement is between both entities. The procurement order resulting from this solicitation will be awarded in Thai Baht (THB) and is subject to Value Added Tax (VAT) exemption under Thai law and regulations. However, only awards made in Thai currency (THB) are eligible for the VAT exemption, and only a local VAT-registered vendor is eligible to receive that exemption. Offshore vendors are not eligible for the VAT exemption; therefore, they must absorb the 7% VAT. The local vendor should be SAM registered too.

2. Authorized Dealer Requirement

The solicitation requires the contractor to be an official authorized distributor of or partner with the OEM. We are coordinating with an authorized Toyota dealer in Thailand who will provide vehicles, warranty service, registration support, and delivery. Will a signed letter from the authorized Toyota dealer confirming their partnership with us for this specific RFQ satisfy the authorized dealer requirement under Section 3?

You must provide proof that all requirements are met. Please refer to Section 1 (The Schedule), Item IV, Contractor Requirements and the Statement of Work, Terms and Conditions.

3. The SOW states that the contractor shall deliver the vehicles to U.S. Embassy Bangkok to process registration in Bangkok, “if needed.” Could you please clarify under what circumstances registration in Bangkok would be required, and whether the contractor should include the associated registration process and delivery to Chiang Mai in the quotation?

Registration for diplomatic license plates is processed at a specific Land Transportation Office in Bangkok. Consequently, registration in Bangkok is required whenever a vehicle is purchased either in Bangkok or Chiang Mai, as the license plates cannot be issued elsewhere.

Vehicle inspection, which is a required step prior to registration, is also conducted in Bangkok.

While waiting for the registration to be completed, the vehicle must be parked within the U.S. government compound, either in Bangkok or Chiang Mai. Once registration is finalized, the contractor is responsible for delivering the vehicle to its final destination in Chiang Mai.

Vendors should include the following in their quotation:

1. The vehicle inspection process and associated costs in Bangkok;

2. The registration process and associated costs at the Land Transportation Office in

Bangkok; and

3. The cost of final delivery from Bangkok to Chiang Mai.

The final delivery address for all vehicles, regardless of purchase location, must be Chiang Mai.
