About this file

This document is a Justification and Approval for Other Than Full and Open Competition for hotel room procurement by the Department of State. The contract is for 140 room nights at the Western Liwa Hotel in Abu Dhabi, United Arab Emirates, to support a U.S. Secret Service (USSS) visit from December 5-15, 2025, with an estimated cost of AED 165,000 ($44,922.41). The procurement is being conducted under an unusual and compelling urgency exception due to strict security protocols, last-minute travel authorization, and the need to protect a high-level delegation. The selected hotel was chosen by the security detail lead officer based on its meeting security standards, accommodating the required motorcade size, and offering facilities suitable for a VIP visit, with a daily rate that falls within the post per diem despite high regional demand during a summit period.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

I recommend that the Department of State use other than full and open competition for the acquisition of Hotel Rooms including internet facilities in support of the U.S. Secret Service

(USSS) visit from December 5, 2025, to December 15, 2025, tentatively. Estimated Amount for the services is AED 165,000 ($ 44,922.41).

1. Nature and/or description of the action being approved.

Hotel accommodation in a good, secured location in Abu Dhabi, United Arab Emirates, in support of the VIP visit. The Western Liwa Hotel, located at Liwa Plot P59 - Mzeerʻah - Mahdar

Dhafeer - Abu Dhabi, UAE, has been cleared by security detail after their assessment on safety and security, logistics, and other Compelling urgency requirements being considered for the VIP visit based.

2. A description of the supplies or services required to meet the agency’s needs.

Total 140 Room Nights (estimated) are required with internet/Wi-Fi facilities. A Purchase Order

(PO) will be awarded to Western Liwa Hotel Abu Dhabi, marking the period of performance from December 5, 2025, to December 15, 2025, for the same. The PO will be modified later for additions and/or deletions as the check-in/check-out dates are tentative, and rooming list is still not final which is to be confirmed later. The hotel shall bill for actual room nights but shall not exceed the period of performance and/or total number of room nights to be confirmed via the

PO. In case additional room nights are required as per the final rooming list, which is to be confirmed later, then the hotel shall request a new or modified PO or written confirmation from the Contracting Officer before providing such additional room nights.

3. An identification of the statutory authority permitting other than full and open competition.

41 U.S.C. 253 (c)(2). FAR 6.302-2; Unusual and Compelling Urgency.

Due to strict security protocols, the Department of State cannot provide advance notice of VVIP travel sufficient to allow full and open competition. Authorization to engage Posts and vendors is only granted at the last moment, leaving minimal time to secure lodging and transportation.

Rapid, last-minute changes to itineraries and security requirements demand immediate action to protect the delegation and fulfill mission objectives. These circumstances create an unusual and compelling urgency under 41 U.S.C. 3304(a)(2) and FAR 6.302-2, making full and open competition impracticable.

Disclosure of the agency’s needs in advance, or public posting in advance, would compromise the compelling urgency requirements.

4. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

The selection of the Western Liwa Hotel, Abu Dhabi was made by the security detail lead officer. The hotel meets all the requirements in support of VIP visit with its unique requirements for safety, security, logistics, and other factors not to compromise national security. The hotel covers some serious square footage with best class facilities and is equipped to cater any needs for such high-level VIP visits.

5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a SAM notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

Due to Compelling Urgency and exception in FAR 5.202.(a)(1) this solicitation cannot be posted but the JOFOC may be published in SAM.gov (GPE) if required. However, contacted few leading hotels that meets USG security standards and requirements, but none of the are available due to blackout dates.

6. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Western Liwa Hotel, Abu Dhabi has provided best possible rate during this period to meet the security requirements for the hotel room/facilities. The daily rate falls within the post per diem, despite the high demand in the region due to the VVIP summit and the limited availability of hotels and rooms. Given these unique requirements and circumstances, the rate is fair and reasonable for such unique requirements and facilities during such time. The USSS team Lead has technically cleared the hotel and accepted the booking rate.

7. Any other facts supporting the use of other than full and open competition.

This hotel meets and exceeds the security standards for high-level visits. Additionally, the hotel can accommodate the size of motorcade required for this visit.

8. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

None

9. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

None.
