Embassy of the United States of America October 14, 2020

Embassy of the United States of America Paseo de la Reforma No. 305, Colonia Cuauhtémoc, 06500 Mexico City.

Minutes from Pre-Proposal Conference of September 28, 2020

This meeting was held in Spanish and English.

Introduction

The Contracting Specialist welcomed all attendees, introduced COR, C.O. Payroll & Allowance Manager, Human Resources Officer and Contracting Specialists.

Discussion of the Solicitation Package

Speakers: Contracting Specialist, Daenne Guevara Contracting Officer Representative, Christian Alvarez-Maciel Payroll & Allowance Manager, Fernando de la Cruz

Purpose:

The purpose of this pre-quotation conference is to brief all prospective offerors about the solicitation. In this meeting, you will notice how doing business with the U.S. Government differs from commercial practice because the solicitation and award processes are regulated under FAR.

Pre-proposal conference minutes will be posted on Contracts Opportunities in BETA.SAM website. We post the minute so other vendors won’t have a disadvantage for not being able to join this virtual meeting.

Before we go through the solicitation, I would like to point out the following important notes:

Statements

The statements made here do NOT change the solicitation. All changes will be made by written amendment to the solicitation.

Amendment.

It may be necessary to amend (change) the solicitation during the solicitation period for such reasons as:

•Issues raised by prospective offerors, either in a pre-proposal conference or otherwise;

•The need to change the closing date for receipt of offers;

•The need to correct ambiguities; or •Changes in quantity, specifications, or delivery schedules.

All amendments will be posted on Contracts Opportunities in BETA.SAM website. The U.S. Government implements the Fair Release of information, in other words, what you tell one, you must tell all.

Questions

I have received few questions. We will take note of additional questions that are made here today and will add them in the list of questions that will be published after submissions deadline for questions.

The Q&A will be posted on Contracts Opportunities in BETA.SAM website.

Solicitation

The solicitation is divided into to 4 Parts:

Part I – The Schedule

Part I is divided into the following 8 sections (A through H):

Section B – Supplies or service and price/costs

· The Contractor shall provide the Health Insurance services described herein to employees of the Government of the United States of America in the Embassy and Consulates in Mexico.

· Riders are also employees of the Government; however, the DOS shall not be responsible, nor liable, for any riders.

· Excess Coverage (C.1.1.21) is included under this contract only as rider benefits; the Contractor shall bill the individual covered separately, at the rates specified below.

· Employee responsible for paying 100% of premium for Excess Coverage

· Type of Contract. This is a fixed-price with economic-price adjustment-requirements type contract.

· Currency. U.S. firms are eligible to be paid in U.S. dollars. U.S. firms desiring to be paid in U.S. dollars should submit their offer in U.S. dollars. A U.S. firm is defined as a company which operates as a corporation incorporated under the laws of a state within the United States. Local companies are eligible to be paid in U.S. dollars provided that such company has a bank account in U.S. dollars at a Local Bank.

· Value Added Tax (VAT) for offers in Pesos, Mexican currency, is not included in line item rates. Instead, it will be priced as a separate amount in the contract and on the Invoices. Local law dictates the portion of the contract price that is subject to VAT; this percentage is multiplied only against that portion.

· VAT shall not be included in the CLIN rates or Invoices for U.S. firms as this is not applicable to U.S. based vendors

· Premium Rates. The fixed prices/premium rates for the health insurance services as specified in Section C. DOT INCLUDE RIDERS IN SECTION B.

· The table for excess coverage applies the same way.

· *estimated number of employees does not include any Riders (B.1.1)

· **does not include any premiums for Riders.

· Administrative Retention Amounts. The retention amount is part of the premium and may include, but not be limited to, such costs as overhead and general and administrative costs. It will also include any profit. Essentially, it includes all costs except the actual portion of the premium intended to fund claims paid to the claimant/health care provider.

· Economic Price-adjustment – For health insurance, prices may be adjusted upward or downward based on the experience rating of the Mission(s) covered by this contract, and it specifically excludes all riders in B.5.1. No adjustment will be allowed during the first twelve months. After such time, the Contractor or the Government may request an adjustment in premiums on an annual basis. Adjustments are not retroactive to previous contract terms. Before any such adjustment is made, the Contractor agrees to provide the Government a balance sheet showing three main components for the time period: (1) receipts (premiums received) minus the retention amount, (2) number of insurance plans and (3) claims paid. The information shall be provided per type of premium, ie per line item. The retention amount is not subject to adjustment. The Government reserves the right to select an independent third party to review the balance sheet and claims and make recommendations regarding the appropriateness of the requested adjustment. Any adjustment shall be subject to mutual agreement of the parties and shall result in a written modification to the contract.

Section L – Instructions, conditions, and notices to offerors

· Will not go into detail, however, it is very important that each proposal contains all of the requirements stated herein. The contractor must send their proposal in 3 volumes as outlined herein.

· L.4.3. Volume III -- Technical Proposal Part 1, Health Insurance Benefits and Coverages:

Section C.1 defines the required minimum benefits and corresponding coverages. These are the minimally acceptable levels of coverage. If offerors choose to include additional benefits or higher coverages than the required minimums this is acceptable; however, evaluations will be based on meeting the stated minimums only. For each benefit listed, proposals must clearly state its coverage. Any proposal that reduces a benefit definition or offers lower than the minimum required coverage may be determined technically unacceptable. The resultant contract will contain the actual proposed coverages or increased benefit offerings if they exceed the solicitation’s minimum requirements.

(a)Multiple proposals - If an offeror has multiple plans available that meet or exceed the minimum benefit levels and wants to propose them, a separate proposal with its respective prices must be submitted individually for each.

(b)Suggested format – It’s the offeror’s responsibility to ensure their proposal is clear and meets all requirements. An example of an acceptable format for Part 1 is to submit a table that lists the Section C benefit definitions in one column and in the adjoining column list the proposed coverage.

Section M – Evaluation Factors for Award

· This section explains how each proposal will be evaluated.

· Proposals will be evaluated in two phases: a technical evaluation to determine the acceptability of the offer to the solicitation technical requirements; and a price evaluation to determine the total evaluated price proposed by each offeror.

· The award selection will go to the lowest priced, technically acceptable, responsible offeror.

Last important notes:

· Brokers may participate in this competition, however, they must involve the insurance company in all stages of the solicitation and award processes. Meaning, they must share all the information we have provided so they are aware and understand our requirements.

· The representative signing the contract must have high level of authority.

· The USG will not provide any other information that is not stated in this solicitation. We will not provide information related to the condition of each employee or habits (smoker or non-smoker).

· The contractor shall provide all the personnel necessary to perform to the highest standards possible.
