About this file
This document is a Questions and Answers file addressing clarifications on a federal trash collection contract for an Embassy location.
The incumbent contractor (Contract #19MA1021C0003) holds a total contract value of MGA100,862,189.54 for the base period plus four option years. The scope of work differs from the previous contract with updates to General Safety and Security, Contract Administration, Quality Control, and Submittals sections. The standard service schedule requires bi-weekly trash collection; however, contractors must be prepared to accommodate weekly service during certain periods of the year as operationally required. The dumpsters contain exclusively non-hazardous municipal solid waste, with the Embassy responsible for waste segregation. Will-call pickups are driven by shipment activities with no guaranteed quantity; contractors should propose a unit rate per dumpster with a typical 72-hour lead time. Each pickup requires a different empty dumpster to be left on-site rather than removing and returning the same unit. Temporary additional services for special events outside normal workday hours must be performed by the prime contractor's direct employees and cannot be subcontracted; local direct-hire employees are acceptable. Documentation required consists only of signed collection receipts for each pickup. Personnel and vehicle clearance submissions require a 72-hour lead time prior to routine pickups; contractors should submit crew member lists and up to two fixed truck license plate numbers in advance for pre-approval. Defense Base Act insurance requirements and compliance with all local laws, labor standards, and regulations must flow down to any subcontractors, with the prime contractor remaining fully responsible for subcontractor performance. For offerors unable to register on SAM.gov due to Malagasy phone number issues, FAR Overhaul Sections 52.204-90 and 52.204-91 and FAR 52.204-7(c)(1) apply.

Questions and Answers:
Q1: 1) Is there an incumbent? If so, please provide the total contract value, length and number.
Yes, Total Contract Value is MGA100,862,189.54 for base + 4 option years.
Contract # 19MA1021C0003
Q2) Is the scope of work the same as the previous contract?
The current scope of work differs from the previous in that updates were made to the sections on General Safety and Security, Contract Administration, Quality
Control and Submittals.
Q3) Service frequency: The requirement states “bi-weekly (every two weeks)” trash collection, but also references a flat rate for “normal weekly pickup.”
Can you confirm the intended scheduled frequency (weekly vs. every two weeks), and whether pricing should assume bi-weekly service as the standard service?
The standard service schedule is bi-weekly (every two weeks) trash collection.
However, during certain periods of the year, weekly service may be required, which could result in more than two trash collections per month. In such cases, the
Contractor shall be prepared to accommodate increased service frequency as operationally required.
Q4) Will-call pickups: Is there an estimated number of will-call pickups per month/year, or should quoters propose a unit rate with no estimated quantity?
What is the typical lead time for a will-call request?
There is no estimated number of will-call pickups, as these requests are driven by shipment activities during which a large volume of boxes may be received, and the dumpster can become full immediately. Quoters should therefore propose a unit rate per dumpster (per will-call pickup) with no guaranteed quantity. The typical lead time for a will-call request is seventy-two (72) hours, subject to operational constraints.
Q5) Temporary Additional Services: The PWS states these are services outside the normal workday that support special events and “shall not be subcontracted.”
Can you confirm whether the Government’s intent is that these must be performed by the prime contractor’s direct employees (vs. a subcontractor)?
These services must be performed by the prime contractor
If local labor is used, can it be direct-hire employees of the prime (in-country) to meet this requirement?
Yes
Q6) Waste stream / exclusions: Are there any prohibited waste types (e.g., hazardous materials, medical waste, WEEE, etc.) that will not be placed in the dumpster? Will the Embassy segregate waste, or should the contractor assume mixed municipal waste?
The dumpsters will be used exclusively for non-hazardous municipal solid waste.
The Embassy does not place hazardous materials, medical waste or any other regulated or prohibited waste streams in the dumpsters. The contractor should assume mixed municipal waste only, limited to non-hazardous and non-regulated materials.
Q7) Disposal documentation: Is any disposal documentation required with invoices (e.g., landfill receipts, manifests, weight tickets), or only upon request?
The only documentation required is a signed collection receipt for each pickup, acknowledging that the service has been performed.
Q8) Dumpster swap logistics: The PWS states the dumpster must be replaced with an empty dumpster each pickup. Can the contractor remove the dumpster for emptying and return the same unit the same day, or must a different empty dumpster be left on site at pickup?
A different empty dumpster must be left on site at the time of each pickup. The contractor may not remove the dumpster for emptying and return the same unit later the same day.
Q9) Access & security processing timeline: For VAR/personnel and vehicle clearances, is there a standard lead time the COR requires for submissions prior to routine pickups?
The standard lead time required by the COR for personnel (VAR) and vehicle clearance submissions is seventy-two (72) hours prior to routine pickups. As a best practice, the contractor should submit a list of crew members and up to two fixed truck license plate numbers in advance, which can be pre-approved and added to an ongoing VAR to facilitate smoother and more efficient access for recurring services.
Q10) Insurance requirements for local subcontractor: If the on-site work is performed by a local subcontractor in Madagascar (with Lujo, LLC as the prime), are the insurance requirements the same for the subcontractor as they are for the prime contractor? If different, please confirm the minimum required coverages/limits and whether a local policy is acceptable.
The Department of Labor requires Defense Base Act insurance requirements to flow down to subcontractos. See https://www.dol.gov/agencies/owcp/dlhwc/ExplainingDBA. In addition, other requirements which must be flowed down to subcontracts are those listed in paragraph (e)(1) on pages 17 and 18 of the solicitation as well as DOSAR 652.205-
70, DOSAR 652.215-70. Under DOSAR 652.242-73 the prime contractor must ensure the subcontractors compliance with all laws, decrees, labor standards, and regulations of said country or countries during the performance of this contract, to include any local insurance requirements. The prime contractor must also ensure the compliance of any subcontractor with the NDAA under FAR 52.204-24 as well as certain other certifications listed in the PWS.
Q11) Prime contractor requirements when not performing on-site work:
If Company X serves as the prime contractor providing project management/contract administration and the on-site collection is performed by the local subcontractor, are the prime contractor requirements (including insurance and any personnel-related requirements) the same as if the prime were performing on-site services? If any requirements differ based on prime/subcontractor roles, please advise. Please see answer above detailing what requirements should be flowed https://gcc02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.dol.gov%2Fagencies%2Fowcp%2Fdlhwc%2FExplainingDBA&data=05%7C02%7CRajaonaRH%40state.gov%7C3503b62b6e6349c096d508de51abbd0d%7C66cf50745afe48d1a691a12b2121f44b%7C0%7C0%7C639037995212268623%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=qcDFiQGy%2FNNK8jswmOoWRUhUKSea1F%2Fhl%2B%2BlJqK9p4U%3D&reserved=0 down to the contractor. The prime contractor will be fully responsible for the performance of any subcontractors under this contract including compliance with all performance requirements.
Q12) As part of our registration on the SAM.gov website, we are experiencing an issue related to the Malagasy phone number.
Per AA 25-40, since it is not practicable to get registered in SAM.GOV, accordingly the following clauses apply and will be included in solicitation:
- FAR Overhaul Section 52.204-90, Offeror Identification,
- FAR 52.204-7 (c)(1) (entity level representations and certifications), if applicable, based on each provision prescription; and
- FAR Overhaul clause 52.204-91, Contractor Identification
