About this file
This is a Questions and Answers (Q&A) document for RFQ No. 19KU2026Q0010 issued by the U.S. Agency for Global Media (USAGM) for the procurement of a mini bus and high-roof passenger van for the U.S. Embassy Kuwait.
The document addresses nine clarifications regarding solicitation requirements. Key determinations include: (1) commercial passenger vehicles lacking official crash-test ratings from Euro NCAP, Australasian NCAP, Japan NCAP, NHTSA, or IIHS will be acceptable if offerors provide manufacturer or authorized dealer documentation confirming the absence of such ratings; (2) the Toyota Coaster (21-passenger) is acceptable despite lacking crash-test ratings, provided all other technical specifications are met; (3) automatic transmission is a mandatory minimum salient characteristic for the mini-bus, and manual-transmission vehicles will be rejected; (4) offerors may satisfy authorized representative eligibility by submitting written authorization from the manufacturer's authorized dealer in Kuwait confirming authority to supply, deliver, register vehicles, and provide warranty services; (5) offerors must submit quotations in accordance with solicitation requirements, completing the pricing schedule for all applicable Contract Line Items (CLINs), with the Government retaining discretion to make single or separate awards; (6) vehicles must include all required equipment at delivery and Government acceptance, though authorized dealer-installed equipment is permissible if completed before inspection and compliant with Kuwait requirements; and (7) manufacturer or authorized dealer compliance letters are acceptable supporting documentation when standard brochures do not separately list all required characteristics. The Q&A explicitly states these responses do not modify the solicitation, and in any inconsistency, the solicitation as amended shall govern.

Notice Regarding Questions and Answers
The responses provided in this Questions and Answers (Q&A) document are intended solely to clarify the requirements of RFQ No. 19KU2026Q0010 for the purchase of a Mini Bus and High-Roof Passenger Van.
Unless expressly stated otherwise in a formal amendment to the Request for Quotations, these responses do not modify, revise, or supersede any requirement, specification, vehicle requirement, delivery schedule, term, or condition of the solicitation.
If the Government determines that a change to the solicitation is necessary as a result of the questions received or for any other reason, the change will be issued through a formal written amendment to the RFQ. Offerors should rely only on the solicitation, including any officially issued amendments, when preparing and submitting their quotations.
In the event of any inconsistency between this Q&A document and the solicitation, the solicitation, as amended, shall govern.
# Question Answer
Our proposed vehicle is the Toyota Coaster (21-passenger), and the manufacturer has confirmed that the Coaster is classified as a commercial vehicle and is therefore not subject to NCAP testing. As a result, no NCAP, NHTSA, IIHS, or equivalent crash test rating is available for this model.
The Government acknowledges that commercial passenger vehicles in the required seating capacity may not be evaluated by Euro NCAP, Australasian NCAP, Japan NCAP, NHTSA, or IIHS. Therefore, the absence of an official crash-test rating alone will not render an otherwise compliant offer unacceptable.
If no official crash-test rating is available for the offered vehicle model, the Offeror shall provide documentation from the manufacturer or authorized dealer confirming that no official crash-test rating is available. Acceptable documentation may include manufacturer safety certification, vehicle type approval, or a formal letter from the manufacturer or authorized dealer.
Could you please confirm whether the Toyota Coaster would still be considered acceptable for this requirement despite the absence of an official crash test rating, provided that it meets all other technical specifications outlined in the solicitation?
Yes. The Toyota Coaster will be considered acceptable despite the absence of an official crash-test rating, provided that it complies with all other technical requirements of the solicitation and the required supporting documentation is submitted.
Crash-test rating requirement The minimum salient characteristics require both the mini-bus and the high-roof passenger van to have a minimum four-star crash-test rating from Euro NCAP, Australasian NCAP, Japan NCAP, NHTSA, or IIHS.
Commercial passenger vehicles in the required capacity classes may not always be evaluated by the listed assessment programs.
Where no rating is available for the offered model, will the Government:
a. Accept the vehicle without a rating, provided that all other minimum salient characteristics are met, or
b. Accept alternative safety evidence, such as manufacturer safety certification, vehicle type approval, compliance with applicable vehicle safety standards, or a formal letter from the manufacturer or authorized dealer?
Yes. Where no official crash-test rating is available for the offered vehicle model, the Government will accept the vehicle without such a rating, provided that it complies with all other technical requirements of the solicitation.
The Offeror shall provide documentation from the manufacturer or authorized dealer confirming that no official crash-test rating is available. Acceptable documentation may include manufacturer safety certification, vehicle type approval, or a formal letter from the manufacturer or authorized dealer
Mini-bus transmission The minimum salient characteristics require the mini-bus to have an automatic transmission.
Please confirm whether automatic transmission is a mandatory pass/fail requirement, or whether the Government may consider a manual-transmission mini-bus if all other minimum salient characteristics are satisfied.
Automatic transmission is a mandatory minimum salient characteristic for the mini-bus.
Offers proposing a manual-transmission mini-bus will not be considered acceptable.
Authorized representative eligibility The RFQ permits participation by a direct distributor, manufacturer, authorized dealer, licensed dealer, or authorized representative in Kuwait. The successful offeror must also be authorized to register, deliver, and provide manufacturer-supported warranty services for the offered vehicles.
Would an offeror satisfy this requirement by submitting formal written authorization from the manufacturer’s authorized dealer in Kuwait confirming that the offeror is authorized, for this procurement, to:
a. Sell and deliver the offered vehicles.
b. Arrange registration in the name of the U.S. Embassy Kuwait.
c. Provide access to manufacturer-supported warranty and repair services through the dealer’s authorized service facilities in Kuwait.
Yes. An offeror may satisfy this requirement by submitting written authorization from the manufacturer's authorized dealer in Kuwait confirming that the offeror is authorized, for this procurement, to supply and deliver the offered vehicles, arrange vehicle registration in the name of the U.S. Embassy Kuwait, and provide access to warranty and repair services through the manufacturer's authorized service facilities in Kuwait.
The Government reserves the right to verify the authenticity and validity of the submitted authorization and supporting documentation during the evaluation process.
Quotations for individual vehicles The RFQ states that the Government may make one award for both vehicles or separate awards for each vehicle.
May an offeror submit a quotation for only one of the two required vehicles, or must each quotation include pricing and technical information for both vehicles?
Offerors shall submit quotations in accordance with the requirements of the solicitation, including completion of the pricing schedule for all applicable CLINs. The Government will evaluate quotations as provided in the solicitation and reserves the right to make a single award or separate awards, whichever is determined to be in the best interest of the Government, based on the evaluated price and the evaluation criteria set forth in the solicitation.
Authorized dealer-installed equipment Where a required characteristic is not included as standard factory equipment on the offered vehicle, may the manufacturer’s authorized dealer install the required equipment before registration and delivery, provided that:
a. Installation is completed before Government inspection and acceptance.
b. The installation complies with Kuwait registration and safety requirements.
c. The installed equipment is identified in the technical proposal.
d. The installation is supported by the authorized dealer’s warranty.
The vehicle delivered to the Government shall include all required equipment and features specified in the solicitation at the time of delivery and Government acceptance.
Supporting technical evidence The RFQ requires technical brochures, manufacturer data sheets, and confirmation of compliance with all salient characteristics. It also states that insufficient technical documentation may result in a quotation being found technically unacceptable.
Where a standard manufacturer brochure or data sheet does not separately list every required characteristic, will the Government accept a signed manufacturer or authorized dealer compliance letter confirming the required features and configuration?
This may include confirmation of front and rear air-conditioning, three-point safety belts, adjustable head restraints for all seating positions, ABS, VSC, cameras, parking sensors, curtains, and other required equipment.
Yes. The Government will accept a signed manufacturer or authorized dealer compliance letter, together with the available technical brochures and manufacturer's data sheets, provided the submitted documentation clearly demonstrates that the offered vehicle complies with all requirements of the solicitation.
