The purpose of this amendment is to:

2. Revise Subsection A.1 PRICE of the Request for Quotations (RFQ). See the attached revised page 3 of the RFQ.

The quoter shall use this revised page 3 to prepare for and submit their Volume 2.

3. Revise Subsection E.1 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR

1984) of the RFQ. See the attached revised page 8 of the RFQ.

4. Revise Attachment 1 - Statement of Work (SOW) of the RFQ. See the attached revised pages 1 through 6 of the SOW.

Question Answer

Q1 Ceiling Work: After removing the existing ceilings in the kitchen, breakfast room, dining room, living room, and corridors, spray polyurethane foam insulation will be applied. Shall we protect the electrical wiring?

A1 Try to avoid the pipes and electrical wires to be buried with PUF and keep them visible. No need for special protection. If the contractor encounters wiring or piping that cannot be avoided, they must stop and coordinate with FAC before proceeding.

Q2 Breakfast Room Wall: What is the thickness of the insulation material (Styrofoam) to be used for the breakfast room wall?

A2 For exterior walls, they should be min 100 mm and

50mm for interior walls both wrapped in plastic.

Q3 2F Guest Room (1): After demolition of 2F Guest Room (1), is it acceptable to use glass wool as the insulation material for the restored ceiling work?

If so, what is the thickness (in millimeters) of the glass wool?

A3 Yes, if there is existing insulation. Use either 100mm or 50mm based on the thickness of the old insulation.

Q4 Wall:

• For the 1F (M107-side wall), should the walls of the dining room and kitchen be considered to be constructed using the GL method?

For restoration, is it acceptable to use Achilles Board?

• For the 2F guest bedroom (1) and guest room (2), should the existing walls on the M107 side also be considered GL construction, and is restoration using Achilles Board acceptable?

• Regarding Achilles Board, would you tell us the size?

• Currently, the wall was installed using GL bond method. For the construction, Achilles board should be used.

Achilles board cannot fit in the breakfast room due to the door frame, you can alternately use 15mm WR board (water resistant).

Other boards like moisture resistant board is12mm or follow what is currently installed.

Q5 Bathroom: For this work, is it correct to understand that the existing bathtub will be replaced with a new bathtub, and that the associated wall panels, floor tiles, etc. will also be replaced, along with the restoration and reinstallation of the related water supply and drainage piping and fixtures?

A5 Only the bathtubs will be replaced. Associated wall panels and floor tiles will not be replaced unless they are damaged during removal. If removal results in damage to any wall panel, the contractor shall notify

FAC/COR for direction on the appropriate restoration method.

Q6 Could you send cross-section and elevation drawings of the building? Do you have any MEP (mechanical/electrical/plumbing) drawings?

A6 The drawings are available in our office. If you want to access the drawings, you can visit our office. No digital copy is provided.

Q7 Can you provide any other drawings which describing details of the scope of works for each location?

A7 No digital copy of the drawing is provided, but if you need more information, you can visit our office and look at the drawing that you need.

Q8 Please provide drawings showing where the exhaust fan power will come from, the location of the distribution panel, and electrical plans for each floor.

A8 You can tap power for the exhaust fan from the nearest wall outlet (non-switch outlets). No need to make new circuit from the distribution panel.

Q9 The I-2 drawings you provide — P-1/5 and 2/5 (Duct Layout) — are hard to read. Could you send clear one (higher-resolution one) if possible?

A9 The original drawing is old and not clear, and this is the most clear drawing the Embassy can provide.

Q10 We are worried the ceiling and wall openings listed in the Statement of Work might not be enough to replace duct insulation in some area. Can we open it bigger?

A10 Yes, you can open as much as you want as long you restore them back. Please note that we only use anti-moisture resistant board for the restoration.

Q11 The Statement of Work says 115V single-phase and 240V three-phase are allowed to use. Does that mean the facility uses U.S. voltages only?

(No 100V/200V on site, just 115V and 240V?)

Also, should the fans we plan to install match those voltages?

A11 See paragraph G.6 Utilities in the revised SOW in

Amendment 0001.

The power supply in Mitsui Housing Compound is

120V/200V. You can use a step-down transformer for your equipment and tools.

Q12 The fan required UL code type of product? A12 Please refer to the manufacturer’s website for the information of the model.

Q13 Please tell us the required thickness for the mold-resistant boards and Achilles boards at each location.

A13 12mm for moisture resistant board, 20mm for Achilles boards. For locations where 20mm Achilles board is not usable due to space, use 15mm WR board as alternate.

Q14 We understand another contractor is setting up scaffoldings for exterior repairs. Can we use that scaffolding for the fan installations?

A14 It is the Contractor’s responsibility to provide their own scaffolding or any other way to access the working are, for example, a gondola or ladder) to perform the required services.

Q15 Is there a temporary area to store construction waste?

A15 Yes. You can use the vacant garage.

Q16 Can we park the vehicles next to the site for materials delivery and waste disposal time?

A16 Yes, if it does not interfere with the traffic depending on the situation. If it interferes with traffic, you can park in front of the MHC Towers.

Q17 How many construction vehicles can we park inside property?

A17 Maximum 2 vehicles.

Q18 The work period is 30 days, which is about 20 working days excluding weekends/holidays — Can we request time extension?

A18 Construction period is extended from 30 calendar days to 45 calendar days. See attached pages to Amendment

0001 for the following revised sections:

I-1 Statement of Work

Q19 This project might happen during the busiest year-end season, so it might be hard to get some skilled labors. Could NTP be delayed and work moved to April or later?

A19 No. The Contractor shall commence the on-site work under this contract 14 days after the issuance of Notice to Proceed.

Q20 We understand bonds aren’t required for U.S.

government construction jobs under $150,000. Is that right?

A20 This project does not require bonds.

Q21 If a bond is needed, does it have to be from a surety on the U.S. Treasury list? Can we use Bank L/C or bank cashier’s check instead?

A21 This project does not require bonds.

Q22 Will QC and SSHO certificates be required for this project?

A22 No

Q23 Can the government please specify the required product type, model and thickness for “Achilles Board” referenced in the SOW.

A23 12mm for moisture resistant board, 20mm for Achilles boards. For locations where 20mm Achilles board is not usable due to space, use 15mm WR board as alternate.

Q24 In SOW parts B1. & B2., Do walls need new insulation? Or Achilles board?

A24 Achilles boards on the M107 side and wool glass insulation on the other sides.

Q25 Is floor protection required? A25 Yes.

Q26 Please confirm the Government’s desired performance period and target completion period/date.

A26 The Contractor shall commence the on-site work under this contract 14 days after the issuance of Notice to

Proceed and complete the entire work for use no later than 59 calendar days.

Q27 For Mold damage restoration and abatement work, what standards should the contractor follow?

A27 Walls and ceiling specified in the SOW shall be replaced as mentioned.

Q28 Should we use primer before applying the rust killer?

A28 No. The rust killer will act as primer.

Q29 Regarding the bathtub replacement, should the Corian plates be new or can we reuse the existing plates?

A29 You can re-use the old Corian panel but should be replaced with brand new if the vendor damaged it during the removal.

Q30 Do we need to install scaffolding for drilling holes and installing Aerofan?

A30 You can use scaffolding, ladder or Gondola. I leave it up to the Contractor but keep safety first.

SECTION A: PRICING

A.1 PRICE

The Contractor shall complete all work, including furnishing all labor, material, equipment and services required under this Purchase Order for the following firm fixed price and within the time specified.

This price shall include, but not limited to, all labor, materials, all insurances, overhead, and profit.

A.2 PAYMENT

A.2.1 Offers and Payment in U.S. Dollars:

U.S. firms are eligible to be paid in U.S. dollars. U.S. firms desiring to pay in U.S. dollars should commit their offer in U.S. dollars. A U.S. firm is defined as a company which operates as a corporation incorporate under the laws of a state within the United States.

Any firm that does not meet the above definition of U.S. firm shall submit its prices and receive payment in Japanese Yen.

A.2.2 Japanese Consumption Tax

The U.S. Embassy Tokyo is exempt from Japanese consumption taxes; therefore, such taxes shall not be included in the price nor charged on invoices. After receipt of the Contractor’s invoice, the Government will provide the Contractor with a signed Certificate of Tax Exemption Purchase for Foreign Establishments.

SECTION E: DELIVERIES AND PERFORMANCE

E.1 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR

1984)

The Contractor shall be required to:

(a) commence work under this contract from the date specified on the Notice to Proceed (NTP),

(b) prosecute the work diligently, and,

(c) complete the entire work ready for use no later than 59 calendar days after the date stated on the Notice to Proceed (NTP).

The time stated for completion shall include material order, production, site preparation, fabrication, and final cleanup of the premises.

E.2 FAR 52.211-12 LIQUIDATED DAMAGES – CONSTRUCTION (SEPT 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, or any extension, the Contractor shall pay liquidated damages to the U.S. Government in the amount of ¥100,000 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor’s right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Default clause.

E.3 CONTRACTOR’S SUBMISSION OF CONSTRUCTION SCHEDULES

(a) The time for submission of the schedules referenced in FAR 52.236-15, "Schedules for Construction Contracts", paragraph (a), is hereby modified to reflect the due date for submission as "10 calendar days after receipt of an executed contract."

(b) These schedules shall include the time by which shop drawings, product data, samples and other submittals required by the contract will be submitted for approval.

(c) The Contractor shall revise such schedules (1) to account for the actual progress of the work, (2) to reflect approved adjustments in the performance schedule, and (3) as required by the Contracting Officer to achieve coordination with work by the Government and any separate contractors used by the Government. The Contractor shall submit a schedule, which sequences work so as to minimize disruption at the job site.

Statement of Work

Mold Damage Restoration Services for Apartment M108

Scope of Work

The Contractor shall perform the following restoration work to repair the damaged ceiling and wall and to control mold growth in apartment M108 at the Mitsui Housing Compound in Tokyo, Japan.

A.1 Living and Dining room removals

1. Full removal of ceiling in the living and dining room including hallway.

2. Full removal of the side wall that shares with M107 (M107 side) in the dining room.

A.2 Living room restorations

1. Spray foam installation on the ceiling plate at 50mm minimum thickness.

2. Full application of Chalade brand rust killer or equivalent brand on the steel plate.

3. Installation on mold-resistant board on the ceiling.

4. Installation of Achilles board on the dining room wall.

5. Putty work.

6. Restore items back to original state.

B.1. Kitchen and breakfast room removals

1. Full removal of the ceiling in the kitchen and breakfast room.

2. Full removal of the M107 side wall in the kitchen.

3. Full removal of all walls in the breakfast room.

4. Partial removal of the wall above the kitchen cabinets on the M109 side.

B.2 Kitchen and breakfast room restorations

1. Restoration on all removed boards using mold-resistant board.

2. Full application of Chalade brand rust killer or equivalent brand on the steel plate.

3. Spray foam installation at 50mm minimum thickness on the ceiling plate.

4. Putty work.

5. Restore items back to original state.

C.1. Removals on bedrooms

1. 2F guest bedroom 1- Remove half of the ceiling and the wall on the M107 side.

2. 2F guest bedroom 2- Replace sidewall on the M107 side.

3. 3F master bedroom- Remove about 60 cm of the ceiling near the window.

C.2. Restoration on bedrooms

1. Restoration on all removed boards using mold-resistant board.

2. Putty work.

3. Restore items back to original state.

D. Bathtub replacement on 3 bathrooms.

1. The 3 bathtubs shall be replaced with brand new US government supplied bathtubs and drain set.

2. The vinyl sidewalls and the floor tiles shall be replaced if they are affected during the replacement work.

3. The existing vinyl spacer shall be replaced with Corian plate and proper wooden support shall be made to hold the new Corian spacer.

4. The dry board around the bathtub shall be replaced with new dry board.

5. The glass wool insulation around the bathtub shall be replaced with new

Insulation.

6. A thin Corian spacer shall be installed between the bathtub apron and the floor tiles if there is a gap during the bathtub replacement.

7. All plumbing fixtures shall be restored to original after the work.

8. Putty work.

E. Full replacement of the AC duct insulation inside the residence.

See Attachment I-2: Drawing for the layout.

1. The old insulation shall be removed and replaced with Aeroflex rubber insulation or equivalent with minimum thickness of 20mm.

2. The spaces inside the ceiling and walls where the duct is running shall be isolated from air entry using glass-wool insulation, dry boards, mortar or Styrofoam.

3. All boards that will be opened for the duct insulation work shall be restored with mold-resistant boards.

F. Exhaust Fans

1. Installation of 4 airflow fans with central remote control. Fan units shall be Sasaragi Airflow fans and RC shall be Sasaragi VMPX-AQ https://passivenergie.co.jp/ or equivalent.

2. Locations of installation will be 2 on the front wall facing the street, 1 on the wall on the M109 side and 1 on the wall facing the trees.

G. General Requirements

1. Materials, Workforce, and Workmanship: Unless otherwise stipulated, the Contractor shall provide all materials, labor, tools, equipment, transportation, and other facilities necessary for the execution and completion of the work. All materials and workmanship shall meet or exceed industry standards, Japan Industrial Standards (JIS), and Japan Architectural Specification Standards (JASS).

2. Schedule of Work: Work shall be performed Monday through Friday from 08:30 to 17:30, excluding American and Japanese holidays, unless otherwise specified by the Contracting Officer’s Representative (COR).

Commencement of work shall start in 2 weeks after the NTP issuance and the work shall be completed in 30 calendar days.

3. Contractor’s Submittals: The Contractor shall submit shop drawings, material samples, and personnel/vehicle numbers to the COR for approval prior to commencing work.

4. Inspection and Acceptance: The COR or the Contracting Officer’s Technical Representative (COTR) may inspect and test work in progress or completed. Should any work fail to meet contract requirements or specifications, the Contractor shall correct deficiencies at no additional cost.

5. Guarantee: The Contractor shall guarantee all work completed under this contract against defects resulting from workmanship or materials for a period of one (1) year following final inspection and acceptance by the COR. Any defects identified during the guarantee period shall be corrected by the contractor at no additional cost.

6. Utilities: Electricity (240V 3-phase and 115V single phase, 50 Hz) and city water are available at the housing compound site at no cost; these utilities are to be used solely for the contracted work.

7. Debris and Site Cleanliness: Debris, waste, used materials including the old bathtub shall be disposed daily in accordance with applicable local industrial waste disposal codes and the U.S. Embassy compound

Amendment No. 0001 - Page 5 of 6 requirement. The Contractor shall always maintain a clean site, ensuring that waste materials, rubbish, or debris are not allowed to accumulate.

H. Contractor Responsibilities

1. The Contractor shall perform all work in accordance with applicable regulations, while upholding the highest standards of safety, professionalism, and site sensitivity throughout the project lifecycle. The Government expects excellence not only in deliverables, but in the conduct, care, and courtesy shown to personnel and occupants.

2. Safety and Chemical Controls:

The contractor must abide by U.S. Mission to Japan hazardous communication program policy No. 2025-005. Before commencing work, the Contractor shall submit anticipated chemical hazards along with a risk mitigation strategy and provide material safety data sheet (MSDS) for the chemicals they intend to use to the COR. Under no circumstances shall a chemical be introduced or used without express written approval from the Contracting Officer’s Representative (COR). Safety documentation shall be thoroughly reviewed and approved prior to mobilization, and the Contractor shall remain vigilant about protecting health and safety throughout execution.

3. Occupied Space Sensitivity and Conduct:

All work shall occur in actively occupied, functional living or working environments. The Contractor shall take all reasonable and proactive steps to preserve comfort, privacy, and daily continuity for building users.

Disruptions—including noise, dust, odor, and restricted access—shall be minimized through thoughtful scheduling and coordination with facility personnel. The Contractor shall present a professional and courteous presence at all times, recognizing that respectful interaction and attention to detail are essential to protecting the integrity of Government spaces and the well-being of occupants. Contractor performance will be evaluated not only on task completion but on the quality of occupant experience and minimal disruption.

4. Noise Management and Acoustic Compliance:

The Contractor shall implement robust noise mitigation measures to ensure work activities remain within sound thresholds appropriate to the facility type. In residential or sensitive areas, sound levels shall not exceed 45 dB without explicit written authorization. The Safety Plan shall clearly define methods to limit acoustic impact, including the use of dampening equipment, barriers, and scheduling adjustments. In the event that noise-producing activities are unavoidable, the Contractor shall provide advance written notice to facility management and affected occupants, and coordinate any required accommodations.

I. Superintendence by Contractor

The Contractor shall designate a representative who shall supervise the Contractor's workforce and be the Contractor's liaison with the Government. The entire operation of the contracted services shall be superintended by the Contractor's liaison. The designated superintendent shall be located on the work site designated by the Contracting Officer during normal working hours (see Subsection E.6 WORKING HOURS) and shall have supervision during the times while on duty. The superintendent shall also supervise the performance of the contracted services on Saturdays, Sundays, and holidays when approved. The Contractor's employees shall be on site only for contractual duties and not for any other business or purposes.
