Addendum to FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (Jan
2026)
The Government will evaluate quotations in accordance with FAR Part 12 using a comparative evaluation approach to determine which offer represents the best overall value to the Government. All quotations received will first undergo a compliance review to assess completeness and conformity with the requirements of this solicitation. Quotations that are incomplete or fail to comply with solicitation requirements may be rejected in accordance with FAR 52.212-1(c).
Quotations determined to be compliant will be evaluated comparatively with one another under the stated evaluation factors to identify relative strengths, weaknesses, and price considerations. This acquisition is not conducted using a Lowest Price Technically Acceptable (LPTA) or trade-off source selection method. However, the Government may award to the lowest-priced quotation if it is determined to represent the best overall value based on the evaluation criteria.
Award will be made to the responsible quoter whose quotation conforms to the solicitation and is determined to be most advantageous to the Government, price and other factors considered. The following factors will be used in the evaluation:
1. Technical Capability: The Government will evaluate the extent to which the Quoter demonstrates a clear understanding of the project requirements and proposes a practical, complete, and technically sound approach for performing the design and construction work. The
Government will consider the proposed methods for field verification, design development, interdisciplinary coordination, construction execution, testing, commissioning, closeout, risk identification, and risk mitigation.
2. Project Schedule and Work Sequencing: The Government will evaluate the extent to which the proposed schedule is complete, realistic, and consistent with the required period of performance. The Government will consider the sequencing of design, Government review, procurement, construction, inspections, testing, commissioning, deficiency correction, and closeout activities, including the Quoter’s approach to minimizing disruption to Government operations.
3. Preliminary Quality Management Program: The Government will evaluate the extent to which the proposed quality-management approach provides effective control of design and construction quality. The Government will consider the proposed quality organization, design reviews, interdisciplinary coordination, inspection and testing procedures, control of subcontractors and suppliers, submittal control, deficiency tracking, corrective action, and final acceptance procedures.
4. Key Personnel: The Government will evaluate the qualifications, experience, availability, and proposed responsibilities of the key personnel. The Government will also consider the adequacy of the proposed project organization, on-site supervision, communication procedures, and coordination of subcontractors, deliveries, inspections, site access, safety requirements, and
Government operations.
5. Company Experience and Past Performance: The Government will evaluate the extent to which the Quoter has successfully performed design-build construction projects similar in size, scope, complexity, technical requirements, and operating environment. Greater consideration may be given to projects that demonstrate experience with renovation, repair, occupied facilities, multidisciplinary design, or work at secure or Government-controlled locations.
In addition, The Government will evaluate the quality and relevance of the quoter’s past performance. The Government may consider performance relating to quality, timeliness, schedule control, project management, safety, subcontractor management, responsiveness, deficiency correction, testing, commissioning, and closeout. The Government may obtain past-performance information from any available source.
6. Authorization to Perform in the Country of Performance: The Government will evaluate the extent to which the Quoter demonstrates that it possesses, or can timely obtain, all registrations, licenses, permits, professional certifications, work authorizations, and other approvals necessary to perform the contract in the country of performance. The Government will also consider the
Quoter’s plan and schedule for obtaining any outstanding authorizations before performance begins.
7. Price: Price will be evaluated based on the total price submitted in accordance with the pricing structure established in this solicitation. The Government will evaluate proposed prices to determine whether they are fair and reasonable.
Responsibility Determination:
The Government will determine contractor responsibility in accordance with FAR 9.104. The apparent successful quoter shall demonstrate adequate financial resources, the ability to meet performance requirements and schedules, a satisfactory performance record, integrity and business ethics, and the necessary organization, experience, technical capability, and resources to perform the requirement. The quoter must also be otherwise qualified and eligible for award under applicable laws and regulations.
Award Without Discussions:
In accordance with FAR 52.212-1(d), the Government intends to evaluate quotations and award a firm-fixed price contract without conducting discussions and may base its decision on the initial submissions.
The Government reserves the right to conduct discussions if the Contracting Officer determines that discussions are necessary.
