Summary

This is a Justification for Other Than Full and Open Competition (sole source justification) submitted by the U.S. Department of State for a Non-Intrusive Magnetometer Survey service contract. The U.S. Embassy in Chisinau, Moldova is acquiring a parcel of land for construction of a New Embassy Compound (NEC) and requires phase two of an unexploded ordnance (UXO) survey to ensure the site is free of environmental contamination, hazards, hidden structures, and obstacles that could impede construction and operations. The contractor shall perform a magnetometer survey and target investigation of approximately 33,000 square meters to a depth of three meters, identifying potential UXO targets and anomalies. Upon completion, the contractor will issue a Final Report and ALARP Certificate confirming that the explosive ordnance risk has been mitigated in accordance with International Mine Action Standards (IMAS). The estimated total contract value is $382,465.59 USD on a fixed-price (FFP) basis.

SafeLane Global, UK is the sole source recipient based on unique qualifications including its 30-year operational history delivering UXO services in 60 countries, proven track record conducting phase one's non-technical survey for this specific site, direct site knowledge and institutional understanding accumulated during phase one, and demonstrated capability to deliver quality work within required timeframes and below initial cost estimates. The statutory authority cited is 41 U.S. Code 1901 as implemented by FAR 12.000. The urgency of the requirement exempts it from posting an Intent to Sole Source notice per FAR 5.101(b)(2). Prior market research during phase one's full and open competition identified only three responsive companies, with two technically acceptable: Golden West Humanitarian Foundation ($62,211.00) and SafeLane Global Limited ($22,489.00), demonstrating SafeLane's superior cost and technical proposal.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING

ACTIVITY

Department of

State Contracting

Activity

☒ Acquisition Management

Requiring

Activity

OBO/PDCS

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING

APPROVED

This action is necessary to acquire Non-Intrusive Magnetometer Survey service (phase two) of the land for the NEC site in Chisinau. During the registration of ownership transfer with the

Government of Moldova, the land should be free of known environmental contamination, hazards, hidden structures, and other obstacles that could reasonably be expected to impede the construction and operation of Embassy Facilities.

Approval is requested to award a new contract on a sole source basis to SafeLane Global, UK for the supplies and/or services described in Section 3 on behalf of the Requiring Activity.

Order Type – FFP.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

Overseas Buildings Operations (OBO) and U.S. Embassy, Chisinau, are pursuing the acquisition of a parcel of land for the construction of an NEC.

A non-technical desktop EO contamination assessment was completed in September 2025. The report determined that the overall risk of EO contamination for the potential NEC site was

Medium.

The Contractor shall perform a Non-Intrusive Magnetometer Survey and target investigation of the greenfield portion of the land, which is approximately 33,000 square meters. The survey will identify any anomalies (potential UXO targets) to a depth of three meters.

On completion of Non-Intrusive Magnetometer Survey and Target Investigation of the UXO services, the contractor will issue a Final Report and ALARP Certificate for the completed works, confirming that the EO risk has been mitigated and managed in accordance with International

Mine Action Standards (IMAS) in the specific area.

The estimated value for the entire period of performance is $382,465.59 USD

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING

OTHER THAN FULL AND OPEN COMPETITION

This statutory authority permitting other than full and open competition is 41 U.S. Code 1901 as implemented by FAR 12.000; see also FAR 12.102(b).

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S

UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES

USE OF THE AUTHORITY CITED

As the Government moves toward performing construction on the site, services are urgently needed to identify any UXO or mines on the property in order to protect the life and safety of personnel working on the property. SafeLane is the one qualified vendor in a position to quickly execute the project.

SafeLane Global is uniquely qualified to provide these services to U.S. Embassy based upon the following:

a. SafeLane Global (SafeLane) supports and facilitates the explosive ordnance (EO) risk mitigation activities of governments, national armed forces, corporations, humanitarian actors and multinational organizations.

b. SafeLane Global detects, clears, and mitigates explosive threats, from mines to unexploded ordnance (UXO), improvised explosive devices (IEDs), and ammunition & explosive stockpiles. Established in 1989, SafeLane Global has successfully delivered over 30,000 contracts in 60 countries, including some of the world’s most hazardous and remote environments.

c. SafeLane has a proven track record delivering UXO Services in support of the US

Embassy Moldova's construction program, having conducted the initial comprehensive

Non-Technical Survey (NTS) and developed the explosive ordnance risk mitigation strategy for the proposed new Embassy site in Chisinau.

d. In the initial market research/RFQ of phase one, non-technical Chisinau NEC UXO survey, only SafeLane Global managed to demonstrate the capability of delivering a quality contamination assessment report within the required time frame and maintaining the costs below the initially evaluated IGCE with all the applicable standards.

e. SafeLane Global has already done the non-technical survey (site assessment) of the land required for the NEC during phase one of the project. The award was a result of full and open solicitation process. SafeLane Global knowledge and understanding of the already reviewed site and all the materials gathered will help expedite phase two and avoid duplicative work.

f. Additionally, use of SafeLane Global, as a follow-on acquisition, saves the Government both time and money:

1. The original order award (19MD7025P0195) was competed.

2. Continuity with Safelane: Awarding this requirement to a source other than Safelane would result in avoidable costs and programmatic risk to the Government.

Specifically:

o Duplication of Effort and Unnecessary Cost. Safelane has already completed a competitively awarded non-technical desktop survey of the site. Transitioning to a new contractor would require this survey to be redone in its entirety, at an estimated cost of $30,000, which would not be recovered through open competition of the requirements.

o Unique Site Knowledge and Continuity. Through its prior, competitively awarded non-technical survey, Safelane has developed direct, first-hand familiarity with the site's terrain, vegetation, access constraints, and other physical challenges relevant to safely and efficiently conducting the Unexploded Ordnance (UXO)

Survey and Target Investigation. This institutional knowledge cannot be readily or quickly replicated by another contractor without incurring the duplicative costs described above and is directly relevant to ensuring safety and technical accuracy during UXO clearance and investigation activities.

3. Probability of delays in fulfilling the agency requirement as a different company will require time to study the report and visit the physical site as part of the initial survey.

SECTION 6. DESCRIPTION OF EFFORTS TO ENSURE THAT OFFERS WERE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY FAR SUBPART 5.1 AND, IF NOT, WHICH EXCEPTION UNDER

FAR 5.101(B) APPLIES

The urgency of the requirement exempts it from the requirement to post an Intent to Sole Source

Notice, IAW FAR 5.101(b)(2).

SECTION 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT IS FAIR AND REASONABLE

The Contracting Office has determined that the anticipated price will be fair and reasonable based on historical prices paid for similar services.

By signing the justification, the Contracting Officer makes a determination that the cost of

$382,465.59 USD to the Government is expected to be fair and reasonable.

SECTION 8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE

PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON A MARKET

RESEARCH WAS NOT CONDUCTED

During the initial stage of the non-technical unexploded ordnance survey, a full and open competition notice was advertised of SAM.gov (19MD7025Q0005) with the full RFQ document posted on the US Embassy Chisinau web page. Also, several companies specialized in this field were contacted as part of the market survey and received an RFQ package to compete for this award.

Only 3 companies responded to the solicitation, and only two found to be technically acceptable:

• Golden West Humanitarian Foundation - $62,211.00

• SafeLane Global Limited - $22,489.00

SECTION 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER

THAN FULL AND OPEN COMPETITION

N/A

SECTION 10. LISTING OF SOURCES, IF ANY, THAT EXPRESSED A WRITTEN

INTEREST IN THE ACQUISITION

No interest in this particular requirement.

SECTION 11. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE

TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED

For the reasons set forth in section 5, neither OBO nor Post have plans at this time to award future contacts for the requirements covered by this document in Chisinau, Moldova. If another potential source emerges, the Office of OBO/PDCS will assess whether competition for future requirements is feasible.
