About this file

This document is an Amendment (0001) to a Combined Synopsis and Solicitation for a Radio Tower Repeater and Microwave Link Project for the U.S. Embassy in Dili, Timor-Leste. The solicitation, issued by the U.S. Consulate General Frankfurt's Regional Procurement Support Office, seeks a contractor to supply, deliver, and install radio tower repeaters and microwave link sites at multiple locations, with ancillary services including end-user training. The project provides humanitarian assistance to the Timor-Leste government in conjunction with the Office of Defense Cooperation.

The solicitation is structured as a two-phase Request for Quotations (RFQ) with specific requirements for Motorola brand equipment. Offerors must demonstrate technical compatibility with existing network infrastructure, ability to access remote mountainous work sites, and provide comprehensive documentation. The government intends to award a single, firm fixed-price purchase order, with delivery required within 60 days of award and all installation and training services to be completed within 90 days. Quotations are due by August 5, 2025, with a potential down-select process limiting Phase 2 participants to no more than five offerors. The procurement is subject to World Trade Organization Government Procurement Agreement guidelines and will evaluate offers based on technical capability, past performance, and price.

Extent of Competition:

Competition is full and open, subject to WTO GPA guidelines.

Contract Type:

The Government intends to award a single, firm fixed-price purchase order for acceptance by the

Offeror. The total price shall include all labor, equipment, delivery charges, materials, overhead, profit, insurance, warranty, customs clearance, and all other expenses necessary to deliver and install the required equipment and provide end-user guides and training. No additional sums will be payable on account of any escalations in the cost of materials, equipment, or labor, or because of the Contractor’s failure to properly estimate or accurately predict the cost or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctuations in currency exchange rates.

Term of Contract:

This ensuing contract shall be effective from the date of the Contracting Officer’s signature and shall remain valid until all items are received and accepted by the Government.

Compliance with Specifications:

Offerors shall also provide with their offer, at a minimum, existing product literature substantiating the acceptability of its offered product in accordance with this solicitation’s specifications. Failure to provide this information will result in an ‘unacceptable’ offer and exclusion from further consideration.

Descriptive Literature Required:

Definition: (a) "Descriptive literature" means information (e.g., cuts, illustrations, drawings and original manufacturers' brochures) that is submitted as part of an offer. Descriptive literature is required to establish, for the purpose of evaluation and award, details of the product offered that are specified elsewhere in the solicitation and pertain to significant elements such as (1) design;

(2) materials; (3) components; (4) performance characteristics; and (5) methods of manufacture, assembly, construction, or operation. The term includes only information required to determine the technical acceptability of the offered product. It does not include other information such as that used in determining the responsibility of a prospective contractor or for operating or maintaining equipment. (b) Descriptive literature must be (1) identified to show the item(s) of the offer to which it applies and (2) received by the time specified in this solicitation for receipt of offers. (c) Data displaying more than one model or size shall be clearly marked so as to indicate the specific item being offered. (d) Offers which do not present sufficient information to permit complete technical evaluation by the Government may be rejected. It is the offeror’s responsibility to prove that their proposed solution meets the requested specifications, subject to any limitations elsewhere in this solicitation.

Other Specific Requirements:

1. Compatibility with existing systems (Coordination with incumbent) o To ensure compatibility with existing systems, offerors shall design and propose equipment capable of interfacing with the data management architecture currently in place at the installation sites. This system was developed and is currently maintained by a separate contractor under a foreign-government-funded contract.

Offerors may propose one of the following:

▪ A solution that is inherently compatible with the existing system; or

▪ A solution that includes a plan for achieving interoperability, including technical steps and costs associated with any necessary software licensing, API access, or data rights acquisition.

o Any required technical coordination with the incumbent shall be conducted solely by the Offeror. The Government does not warrant the availability of proprietary system components or guarantee cooperation by third parties.

o Offerors are strongly encouraged to initiate early engagement with the incumbent contractor and must include in their quotations:

▪ A description of the coordination conducted or planned;

▪ Any licensing or rights costs included in their proposal; and

▪ A risk mitigation strategy if access is delayed or denied.

o Any agreement reached between the Offeror and the incumbent shall be at the

Offeror’s expense.

Note: The Government will not mediate access to proprietary information held by non-U.S. Government contractors or assume liability for such coordination.

▪ Obtaining necessary permits and clearances from local or national authorities;

▪ Coordinating with host-nation officials as required for equipment delivery and installation; and

▪ Ensuring compliance with applicable labor, tax, and customs laws.

Note: Offerors shall include any anticipated legal, regulatory, or transactional costs associated with site access in their pricing.

3. The successful Offeror shall coordinate quality control testing with Timor-Leste government, Australian advisors and CSE Crosscom, the incumbent contractor.

4. All required coordination with the Australian contractor, CSE Crosscom, must be demonstrated in the quotation. CSE Crosscom owns the IP Key and manages data on the network and thus requires such coordination to be accomplished. Any rights that need to be acquired to make the system functional are at the cost of the

Offeror/Contractor and must be included in the quotation price.

5. Price is inclusive of any legal requirements associated with negotiating site access with the National and local level officials.

3) Site name(s) and date(s) on which Pre-proposal Site Visits (if any) were conducted by the

Offeror.

4) Project-specific Comprehensive Plan of Action. The plan shall not exceed 10 A-4 pages and shall include-

a. Technical compatibility of Offeror’s proposed solution with current IP keys and data management network provided by current Australian Government vendor

CSE Crosscom. Prior coordination is necessary; the Offeror shall contact CSE

In addition to the Offeror-supplied Past Performance Information, the Government may use any of the Offeror’s past performance information at its disposal pursuant to FAR

13.106-2(b)(3).

Advisory Down-select

The Government will evaluate the Phase 1 submissions and provide advisory notifications to

Offerors. For those Offerors that are rated most highly and advised to proceed to Phase 2 of the quotation submission process, the Contracting Officer will include the Phase 2 submission instructions on the advisory notification, including the date and time for the submission. Offerors that were not among the most highly rated will be advised that they are unlikely to be viable competitors, along with the general basis for the Government’s advisory recommendation.

The intent of this advice is to minimize quotation development costs for those Offerors with little to no chance of receiving an award.

The Government intends to provide no more than five (5) Offerors with an advisory notification to proceed. However, the Government’s advice will be a recommendation only, and those

Offerors who are advised not to proceed may elect to continue their participation in the procurement.

Failure to participate in Phase 1 of the procurement precludes further consideration of an

Offeror. Phase 2 submissions will not be accepted from Offerors who have not submitted Phase 1 quotaions by the due date and time stated in this solicitation. For those Offerors that are rated most highly and advised to proceed to Phase 2 of the quotation submission process, the

Contracting Officer will include the Phase 2 submission instructions on the advisory notification, including the date and time for the submission. The Government recommends Offerors begin preparation of Phase 2 quotations only after receipt of the Phase 1 advisory down-select notice.

Those Offerors that received advisory notification not to proceed to Phase 2, but regardless choose to proceed to Phase 2, shall send an email to MambaKG@state.gov and

FrankfurtRPSO@state.gov, not later than 24 hours after receipt of the advisory recommendation not to proceed, indicating their intent to participate in Phase 2. After the Contracting Officer receives a notice from the Offeror stating its intent to participate in Phase 2 despite the

Government’s advisory notification not to proceed, the Contracting Officer will send a separate email with Phase 2 submission instructions within five business days.

PHASE 2: Comparative Evaluation and Best Value Determination.

Offerors invited to Phase 2 will be invited to submit the following:

mailto:ken.griffiths@afp.gov.au mailto:MambaKG@state.gov mailto:FrankfurtRPSO@state.gov

Volume 1 (Price Volume):

• Completed Attachment 5 - Detailed Price Proposal Breakdown

Volume 2 (Technical Volume):

• Completed Attachment 6 - Technical Compliance Matrix

• Descriptive Literature

• Any updates or clarifications requested by the Contracting Officer.

In this Phase, 2, the Government will conduct a comparative evaluation of quotations in accordance with FAR 13.106-2(b)(3). This includes an assessment of both price and non-price factors to determine which quotation represents the best value to the Government.

Award Notification

The Government will publicize the contract award on SAM.gov pursuant to FAR 5.301(a)(1)(i).

Debriefing

The Government will not provide debriefings but will address unsuccessful Offerors’ requests for information pursuant to FAR 13.106-3(d).

3(g)(4)(ii) on SAM is not applicable to this solicitation, the Offeror must complete the representation at FAR 52.212-3(g)(4)(ii) in Attachment 3.

• While the Contracting Officer may rely on the Offeror’s representation regarding TAA compliance, Offerors are reminded that the Contracting Officer may also conduct due diligence and request evidence of compliance with the Act. End of Addendum to Instructions to Offerors

Addendum to FAR 52.212-2 Evaluation – Commercial Products and Commercial Services

(Nov 2021)

Compliance Review – Phase 1. The Government will perform an initial review of quotations received to determine completeness and compliance with the terms of the solicitation.

Incomplete quotations may be rejected and excluded from further consideration pursuant to FAR

52.212-1(b)(11).

Following the preliminary/compliance review of quotations received in Phase 1 and possible exclusion of incomplete quotations, the quotations that remain in Phase 1 will be subject to the advisory down-select process.

Compliance Review – Phase 2. The Government will perform an initial review of quotations received to determine completeness and compliance with the terms of the solicitation. After preliminary consideration of all quotations in this Phase, the Government will no longer consider quotations that do not meet basic standards to be eligible for award.

Following the preliminary/compliance review of quotations received in Phase 2, quotations that remain will be subject to Comparative Evaluation.

The Comparative Evaluation will be performed in accordance with FAR 13.106-2(b)(3).

Comparative evaluation is defined as the act of comparing two or more offers in response to the

RFP. The item-by-item comparison is performed by comparing each quotation directly to one another to determine which provides the best value to the Government utilizing technical, past performance criteria and price as described below. While this is not a lowest-priced, technically acceptable (LPTA) or trade-off process, the process does not prohibit or rule out award on a low-priced quotation.

Evaluation Criteria

Technical: Technical capability will be evaluated based on a direct comparison to other quotations to discern if there is any kind of technical quality superiority that would support an award to a higher-priced quotation. Technical discriminators include:

• Company’s experience in providing similar equipment and services.

• Key Personnel’s qualifications and experience in providing similar equipment and services.

• Offeror’s project-specific Comprehensive Plan of Action for the supply, delivery and installation of equipment and provide end-user training.

• Offeror’s compliance with the requirement for an active OEM reseller/channel status.

Past Performance: In the case of an offeror, subcontractor, or teaming partner without a record of relevant past performance or for whom information on past performance is not available or is so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” Past performance will be evaluated based on a direct comparison to other quotations to discern if there is any significant past performance superiority that would support an award to a higher priced offer.

Past performance as a discriminator may be appropriate where based on the Offeror’s performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Price: Price will be evaluated to ensure the proposed price is fair and reasonable. The

Contracting Officer's selected method of determining price reasonableness will be informed by the degree of competition.

Responsibility Determination: The Government will determine contractor responsibility by analyzing whether the apparent successful offeror complies with the requirements of FAR 9.1, including:

• Adequate financial resources or the ability to obtain them;

• Ability to comply with the required performance period, taking into consideration all existing commercial and governmental business commitments;

• Satisfactory record of integrity and business ethics;

• Necessary organization, experience, and skills or the ability to obtain them;

• Necessary equipment and facilities or the ability to obtain them; and

• Be otherwise qualified and eligible to receive an award under applicable laws and regulations
