About this file
This document is a Justification for Other Than Full and Open Competition (J&A) for the U.S. Department of State, seeking a sole-source contract with Eaton Electrical Services and Systems for electrical system upgrades at the U.S. Embassy in Islamabad. The contract, valued at $500,000, involves replacing hardware and software in five embassy substations, including installing new relays, Modicon PLC, electrical interlocks, breaker blocking plates, and a transformer to relocate a UPS system. Eaton is deemed the sole qualified vendor due to being the original designer and supplier of the embassy's low voltage switchboards and currently providing technical support for the power systems.
The contract was synopsized on August 12, 2025, with only one company (MKS Venture Tech) responding, but they did not provide a capability statement challenging the sole-source justification. The Contracting Officer determined the pricing to be fair and reasonable based on historical project information. The Facilities Management Office indicates no immediate plans to compete future contracts for these specialized electrical services, but will assess competition if another potential source emerges. The document is signed by Kevin R. Sessink, Senior Facility Manager, and Travis Keon, Acting Contracting Officer, with a certification date of September 2, 2025.

This statutory authority permitting other than full and open competition is 41 U.S. Code 1901 as implemented by FAR 13.501(a) and FAR 13.106(b); specifically, this authority permits contracting on a sole-source basis.
SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY
CITED
Eaton Electrical Services and Systems is uniquely qualified for these services to Islamabad based upon the following:
a) Eaton is the designer and supplier of the Low Voltage Switchboards installed in 5 substations of US Embassy Islamabad.
b) Eaton has extensive experience in designing, supplying, installing, and commissioning of Switchboard and switchgear systems equipped with PLC (programable logic control) and control wiring.
c) Eaton is currently providing technical support/advice for Low Voltage Power System and maintenance services to embassy for medium voltage equipment.
d) No one else is authorized or qualified to provide services to repair/upgrade the Switchboards.
SECTION 6. DESCRIPTION OF EFFORTS TO ENSURE THAT OFFERS WERE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR
WILL BE PUBLICIZED AS REQUIRED BY FAR SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION
UNDER FAR 5.202 APPLIES
The proposed contract was synopsized on Aug 12, 2025. One company responded to the notice (MKS Venture Tech (Pvt) Limited), but this vendor misunderstood that it was an intent to sole-source notice and only asked for the solicitation. No capability statement or evidence to counter the sole-reasoning was provided. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Eaton to provide the required supplies and services.
SECTION 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST
TO THE GOVERNMENT IS FAIR AND REASONABLE
The Contracting Office has determined that the anticipated price(s) will be fair and reasonable based on historical project information with similar requirements and with the IGCE. By signing the justification, the Contracting Officer makes the determination that the price to the Government is expected to be fair and reasonable.
SECTION 8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE
RESULTS OR A STATEMENT OF THE REASON A MARKET RESEARCH WAS NOT CONDUCTED
A market survey has not been conducted due to the restriction of our Switchboards, PLC and control system, being the proprietary items of Eaton feeding electricity to entire compound.
SECTION 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
None.
SECTION 10. LISTING OF SOURCES, IF ANY, THAT EXPRESSED A WRITTEN INTEREST IN THE
ACQUISITION
The proposed contract was synopsized on Aug 12, 2025. One company responded to the notice (MKS Venture Tech (Pvt) Limited), but this vendor misunderstood that it was an intent to sole-source notice and only asked for the solicitation. No capability statement or evidence to counter the sole-reasoning was provided.
SECTION 11. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR
THE SUPPLIES OR SERVICES REQUIRED
For the reasons set forth in Paragraph 5, the Facilities Management Office has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, the Facilities Management Office will assess whether competition for future requirements is feasible.
