About this file

This document contains questions and answers related to a solicitation for facility management and security monitoring services at the U.S. Embassy in Bratislava, Slovakia. The successful contractor will be responsible for building management, maintenance of building automated systems including HVAC and climate control, and 24/7 monitoring of security cameras and fire detection systems. The contractor must also periodically monitor the building's perimeter. A site visit is scheduled for February 22, 2024. While the incumbent contractors will provide inspections and reports, no manuals for the existing systems will be provided. The contractor must determine how to maintain existing software and systems. A U.S. company on the GSA schedule registered in SAM may serve as prime if it demonstrates qualified licensed local Slovak subcontractors. Historical logs and reports from the existing systems will not be provided to the winner. Current employees do not have right of first refusal. Acceptable compliance documentation for human trafficking prevention is included. Invoices can only be issued to the company named on the contract. Defense Base Act insurance is only required for U.S. citizens or residents hired.

Questions and Answers

Q1: Will there be a list of all systems and software in use in the building to include access control, cctv and other building management systems to monitor various items such as climate control, water pressure, electrical, fire etc?

A1: The software for the management and monitoring of the Collector, and building automated systems (heating, HVAC, cooling) are the original systems that were purchased by Allianz. They remain in operation, but there are no instructions available. It will be up to the contractor to determine how the software and systems will be maintained. The systems can be operated manually, but this is inefficient. The contractor can reach out to the software developers, Sauter and Siemens on monitoring and further servicing.

Q2: Will a US company currently on GSA schedule and registered in SAM be permitted to be the prime if it shows qualified and licensed local Slovak subcontractors as part of its technical section as part of its transition plan, past performance and management plan?

A2: Yes, but as the Government must work directly the prime contractor and not directly with the sub-contractor, it is necessary that the identified key personnel work directly for the prime contractor.

Q3: Will the winner be provided a time period of historical recent logs of all building control systems, manuals and historical reporting required by the USG?

A3: The current contractors will hand over all professional inspections of building systems in accordance with the current legislation of the Slovak Republic. As mentioned above, there are no manuals, it is up to the operator to ensure economical operation.

Q4: Will the current incumbent employees have right of first refusal to be hired by the winner in the event the incumbent is not chosen as the winner?

A4: No, unless this right otherwise stipulated in Slovakian law.

Q5: We have the official license for security services required by Slovak law as specified in Act 473/2005 Coll. on the Provision of Services in the Field of Private Security and on Amendments to Certain Laws (Private Security Act), but unfortunately do not have some licenses required for facility management.

According to Slovak law you cannot subcontract the services for which the license is required. The contract must be signed directly with the supplier who is authorized for security services.?

A5: If a contractor lacks one of the required licenses, the USG has no issue with that contractor teaming/partnering with a contractor that has the license they are missing.

As for the insurance concerns, the USG is self-insured. Therefore, a potential insurance claim is a non-issue.

Q6: In the documents for the competition there are tables for the price part of the offer in pdf format. It is necessary to send tables in xls, word format.

A6: It must be sent as a PDF, Word document, or Excel file.

Q6: Do the documents "Trafficking in Persons (TIP) Compliance Plan Checklist" and "Certificate of Foreign Contracting Party Receiving Federal Procurement Payments" need to be documented in the price offer?

A6: The checklist is for information only. Its inclusion is intended to help ensure that the Trafficking in Persons Compliance Plan submitted as part of the technical proposal has all the required content.

Q7: The price offer also includes documents from Section K - Representations, Certifications, and Other Statements of Offerors or Respondents (pp. 28-50). Please provide more information about the documents involved. Do these documents replace registration with SAM.gov.

A7: These provisions are in addition to what is provided in SAM.GOV, as they are specific to each solicitation.

Q8: In PART I - TECHNICAL CAPABILITY PROPOSAL, point no. 3. Management Plan, letter g) is stated, if the offer is higher than $550,000, it is necessary to document a plan for compliance with the rules related to human trafficking.

Please specify which certificate 52.222-56 it is. Is the applicant's declaration of compliance with the conditions of 52.222-56 sufficient??

A8: Something similar to the following:

I, as duly authorized representative of __________________________ (name of the company), hereby certify that the Contractor I am representing has implemented a compliance plan to prevent any prohibited activities identified in paragraph (b) of the clause at 52.222-50, Combating Trafficking in Persons, and to monitor, detect, and terminate the contract with a subcontractor engaging in prohibited activities identified at paragraph (b) of the clause at 52.222-50, Combating Trafficking in Persons; and After having conducted due diligence, either- [ ] To the best of the offeror’s knowledge and belief, neither it nor any of its proposed agents, subcontractors, or their agents is engaged in any such activities; or [ ] If abuses relating to any of the prohibited activities identified in 52.222-50(b) have been found, the offeror or proposed subcontractor has taken the appropriate remedial and referral actions.

Q9: Is the price offer and the technical offer submitted together to one email address machendd@state.gov?

A9: Yes, but not required.

Q10: On the basis of the current tender conditions, the contracting authority requests to have one joint contract concluded for the management and maintenance of buildings and the performance of security services.

Is it possible for suppliers to conclude a "supplier group" contract on the basis of which they will provide and invoice services?

A10: Invoices can only be made to the company named on the contract (specifically the company entered in Standard Form 1449, Block 17a of the proposal). Only joint ventures or a Prime-Sub arrangement is allowable.

Q11: There is a line in the price table section:

"DEFENSE BASE ACT (DBA) INSURANCE

Reimbursement of DBA Insurance, in accordance with paragraph 2.6.

Type of Contract Pricing: FFP"

Please indicate what kind of insurance is involved.

A11: This is basically workers compensation if a worker is injured on the job site. As there is a waiver in place for Slovakia, this insurance is only required for U.S. citizens or residents, or anyone hired directly out of the U.S.
