Questions and Answers set one 19GE5022R0042
RPSO has received eight (8) questions in response to solicitation 19GE5022R0042 and is providing the below answers.
1. Q: Is this SOW is actually being performed or is this a new requirement?
A: There is no contract in place for the performance of this exact same Statement of Work.
In U.S. Government contracting, every solicitation is considered a new requirement for the government. A previous contract may contain the same type of services; however, a new solicitation for the same type of services may contain a different scope of work for the government’s same need. If you choose to submit a complete, responsive proposal for this solicitation, please respond accordingly to the current Solicitation Number 19GE5022R0042.
2. Q: May I know how many personnel are needed for this project?
A: The requested support requirement is one (1) cleared laborer at any given time during the offseason (October through April) and three (3) cleared laborers at any given time throughout the busy season (May through September).
3. Q: Can we bid on this project on a monthly basis?
A: No. The solicitation is for a firm fixed price contract for a base and four option years. The price proposal shall include pricing for the entire contract period.
4. Q: Please clarify, who would drive the government furnished truck? If this has to be done by the contractor, which truck license is required?
A: U.S. Government employees will operate all vehicles and lift equipment.
5. Q: Do we have to provide all required materials to transport/ pack move all materials / furnishing, as ratchet straps, belts, boxes etc.? Please provide a list of materials and their dimensions, if available, to get a better understanding about quantities.
A: The Government will provide all moving equipment and materials to the Contractor as
"Government furnished property (GFP)" for performance of the contract.
6. Q: Considering the attached pricing sheet (costs per hour)- Why you require past performance for moving services, as this pricing structure seems to be in nature a personnel lease contract vehicle requiring a personnel lease permission according German labour law? This would put the
Contractor in a difficult legal position, if there should be any issues with the personnel….
Questions and Answers set one 19GE5022R0042
A: The solicitation does not intend to lease personnel. As per Section 1, I. Background, we are intending to issue a contract to a contractor to provide us with moving services.
Therefore, we are requesting that the contractor has relevant experience in providing the required services. This is common practice in Government contracting to determine contractor technical acceptability and responsibility (Section 4 – Evaluation Factors).
Additionally, to contractor past performance, the solicitation also requests a detailed resume and experience information on the Key Personnel - Project Manager.
The contract does not solely require a company to lease out personnel. By providing the moving services under this contract, the contractor shall also provide supervision and shall furnish all managerial, administrative, and direct labor personnel necessary to accomplish all work as required by this contract. Additionally, the contractor shall provide, as necessary, transportation for contractor employees to the primary work site and be responsible for work-site safety during the moves. The project manager shall work closely with the COR on a day-to-day basis to accomplish the required services.
7. Q: The estimated 3000 hours annually- considering “main season between May and September” shall this be considered for eg. 2 people working full time all year, or a group of four or more during the stated months? To provide skilled personnel the contract period is essential for accurate cost calculations and the nature of the labour contracts.
A: The requested support requirement is one (1) cleared laborer at any given time during the offseason (October through April) and three (3) cleared laborers at any given time throughout the busy season (May through September).
The 3000-hour estimate is based on this requirement, taking into consideration both German and U.S. holidays per annum.
8. Security Clearance- Are other EU member nations citizens than German are allowed to work under this contract, as this is an European labour regulation?
A: Any contractor personnel [US Citizens, Host Country Nationals (German citizens) and Third
Country Nationals (other than US or German citizens)] are allowed to work under this contract, subject to the condition they pass the U.S. Government background investigations conducted by the Regional Security Office at post.
Regarding Contractor Personnel requirements, see also Sub Section V. 4. Recruitment of Third
Country Nationals, FAR 52.222-50 Combating Trafficking in Persons (NOV 2021) and Section 5 -
DEFENSE BASE ACT - COVERED CONTRACTOR EMPLOYEES UNDER THE DEFENSE BASE ACT.
