IV SPECIFICATIONS / STATEMENT OF WORK
Introduction
The State Department of the U.S. Government (USG), represented by the U.S. Mission to
Germany is seeking a vendor to provide timely and accurate processing of employee salary calculations, to handle mandatory reporting of employee data and information as required by the
German Social Security System, and perform miscellaneous other tasks in connection with
Locally Employed (LE) Staff compensation. The contractor shall have thorough long-term experience in and expert knowledge of the German Social Security system and compensation practices and be fully versed, in theory and practice, in the requirements employers in Germany are required to fulfill in connection with these employment aspects. The contractor shall have all expertise, resources, and means in place to handle the tasks described in Item1 through 3 below in this SOW.
The U.S. Mission not only has U.S. diplomatic and consular personnel in its service but also employs non-diplomatic staff who are permanent residents in Germany. These staff members are known as Locally Employed Staff (LE Staff) and the current number Germany-wide is 698 (the number will fluctuate between upper 600s and lower to mid 700s). The U.S. Mission to Germany consists of the U.S. Embassy in Berlin and the U.S. Consulates General in Frankfurt, Munich, Düsseldorf, Hamburg, and Leipzig.
The service scope will cover the non-diplomatic LE Staff members only; the U.S. diplomatic and consular personnel are not included.
Scope
The Contractor shall provide LE Staff employee salary and social security contribution calculations as they apply to the LE Staff in alignment with compensation and social security procedures as imposed by local law and by the State Department. The Contractor further shall handle all employer reporting responsibilities vis-à-vis the GSSS (including electronic transfer per Social Code: §28a, (1a), SGB IV).
The USG transferred responsibility for payment of social security contributions to the GSSS to its LE Staff; the employer’s shares to the GSSS are paid directly to the LE Staff employees.
The U.S. Mission will maintain this procedure.
The U.S. Mission has not made deductions for income tax; all matters regarding income tax liability have been entirely the LE Staff members’ responsibilities. The U.S. Mission intends to maintain this procedure; the Contractor thus will not be required to deliver respective calculations and/or handle pertinent responsibilities.
LE Staff are subject to local social security requirements; however, the U.S. Mission to Germany, as a diplomatic mission, has operational conditions that differ from those of local economy employers which will have to be considered by the Contractor.
The USG seeks Contractor support with regard to the employer’s reporting obligations per §28a SGB IV and the Data Collection and Transmission Ordinance (DEÜV). Per tacit understanding, the employees’ Health Carriers have handled the majority of the reporting tasks on a voluntarily and goodwill basis. It is the USG’s intent to become compliant with the mandate that data must https://www.gesetze-im-internet.de/sgb_4/__28a.html https://www.gesetze-im-internet.de/sgb_4/__28a.html https://www.gesetze-im-internet.de/sgb_4/__28a.html
Payroll & Salary Computation Outsource Page 9 of 83 be submitted electronically to the GSSS via payroll accounting programs that were tested and approved by the Information Technology Service Center of the German Statutory Health Insurance (ITSG).
STATEMENT OF WORK (SOW)
A. Payroll and Salary Computation Services
The USG requires payroll and salary computation services. The Statement of Work lists the goals and objectives of the contract.
B. Statement of Work (SOW)
The Contractor shall provide the U.S. Embassy Berlin and its U.S. Consulates General Frankfurt, Munich, Düsseldorf, Hamburg, and Leipzig (hereinafter referred to as Customer) with the below services.
1. Startup
1.1 Identify or design a system that can accommodate the unique challenges of calculating local social security for the Customer taking into account the following operational conditions that set the Customer’s operations apart from those of customary local economy employers:
• Salary payments are made on a bi-weekly basis (“Pay Periods”); these Pay Periods do not coincide with calendar months but regularly cross over the end and beginning of a month.
• In accordance with §28 m SGB IV, Sub-Section (1), the USG transferred responsibility for payment of social security contributions to the GSSS to its LE Staff the employees. The U.S.
Mission thus does not fulfill employer obligations per §28e SGB IV, Sub-Section 1, Sentence
1 and pays the LE Staff without such deductions. Instead, the USG transfers the employer’s share of the GSSS to the LE Staff together with their bi-weekly salary payments; the LE Staff are required to pay the contributions to the Health Carriers. The USG will not change that procedure.
• While the vast majority of the LE Staff are fully subject to the GSSS, there are groups who are partially subject to different requirements. A group of approximately 188 LE Staff of the
698 are subject to the U.S. Federal Insurance Contributions Act (FICA); the majority of employees in this group are also subject to U.S. income tax. Both liabilities are deducted at source; the Contractor shall only handle the employee’s liabilities vis-à-vis the GSSS:
o The aforementioned group of employees are enrolled only in FICA; they do not additionally participate in the German old age insurance system;
o For this group, participation in the Health and Care insurance scheme are voluntary; if they opt for health insurance, the employees are allowed to take out private health insurance regardless of whether they meet the local ceiling requirement otherwise required for eligibility;
o The employees must participate in the German unemployment insurance.

• A very small group of staff (<20) has a private old age insurance in lieu of being enrolled in the mandatory old age pension system. The Contractor shall need to be able to handle those cases.
• Each LE Staff member has his/her own employer identification number (Betriebsnummer) due to the fact that LE Staff are considered self-payers (Selbstzahler). To address this issue, the U.S. Mission will be able to obtain dummy employer identification numbers for each post.
• The actual payroll processing and initiation of salary payments to the LE Staff will be handled by the State Department payroll center, the Global Financial Service Center (GFSC) in
Charleston, South Carolina, USA.
• The State Department has a specifically designed internal time and attendance reporting and administration system. The U.S. Mission will be required to continue to use the system: the
Customer thus will prepare certain steps of the process in that system, turn the product over to the Contractor who will handle the scope of work defined in this SOW, and return the results to the Customer for further use.
1.2 In as much as the Contractor is required to access U.S. Mission premises during the start-up period, the representative(s) shall be escorted at all times. Representative(s) shall arrive in sufficient time to allow for security/entrance processing.
1.3 In as much as the representatives need to work with company laptops or other handheld electronic devices on U.S. premises, pertinent security and IT security procedures will have to be initiated and observed prior to permission to bring these devices into the U.S. Mission premises.
2. Ongoing Contractor Services
The Contractor shall
2.1 calculate the German social security contributions for all LE Staff members of the U.S.
Embassy and its five Consulates General.
2.2 provide monthly German social security reports for employees’ salaries for each Pay Period
(as defined in section 5.2).
2.3 based on notification by the Customer, where such notification is required, provide reporting to the pertinent social security entities as mandated by local social security law (§28 a SGB IV et al.) for all LE Staff covered under all or some of the branches of the GSSS (health insurance system, the care insurance, old age pension insurance and/or the unemployment insurance) per the following:
2.3.1 at the beginning of the employment relationship,
2.3.2 at the end of the employment relationship,
2.3.3 when salary payments temporarily stop,
2.3.4 one-time payments,
2.3.5 in the event of changes in the obligation to pay contributions, https://www.sozialgesetzbuch-sgb.de/sgbiv/28a.html
19GE5022R0020 US Embassy Berlin, Germany Payroll & Salary Computation Outsource Page 11 of 83
2.3.6 in the event of a change in Health Carrier,
2.3.7 when an employee applies for old age pension (German system), and/or,
2.3.8 handle other and additional reporting requirements as required by German law/regulations.
2.4 handle all reporting as required by the German Collection and Transmission Ordinance
(Datenerfassungs- und -übermittlungsverordnung, DEÜV) per the applicable deadlines.
2.5. handle general salary increases or other adjustments of salaries and/or social security contributions, as may be required by changes to local law and/or State Department regulations.
The Contractor shall handle all relevant calculations based on the Customer’s request and, where required, instruction and guidance.
2.6 prepare and submit the annual report for the German statutory accident insurance (German
“Workman’s Compensation”) for the reporting period January 1 to December 31.
2.7 render the following support: The U.S. Mission has a Defined Benefit Plan (DBP)
(Betriebsrentenplan 1). For purposes of premium payment calculations and issuance of annual
Leistungsnachweise, the U.S. Mission must report to the insurance company covering that Plan all members’ latest five salaries in effect on January 1 of the pertinent previous years. The report is due in June; the Contractor shall provide the Customer with the salary information every year in May. The Customer shall be able to record and match all relevant insurance information of each plan member in their system (the U.S. Mission will provide the information).
2.8 render the following support: The U.S. Mission also has a Defined Contribution Plan (DCP)
(Betriebsrentenplan 2); the DCP is handled by an outside insurance company. The Contractor shall support the monthly calculation of the employer’s contributions to the DCP for all Plan members (current, enrollments, and departures).
2.9 provide the Customer – upon request - with ad hoc reports and statistics in as much as these relate to LE Staff compensation and associated cost and information. Depending on complexity of the reports the turn-around time shall be between one work day and one week.
2.10 provide information on the LE Staff salaries and relevant contributions to the GSSS to the
U.S. Mission’s Financial Management Section to enable the same to prepare budget proposals and overviews. The requirement for the information is recurrent (generally on or about October
1st of a year) but can also be in the form of an ad hoc request, both mass and individual employee reports. The Contractor shall be able to provide information on the employees' basic annual salaries and the respective GSSS contributions in a specific format which needs to encompass a variety of employee data, leave status, and fiscal information; the exact information regarding that format and contents will be provided by the U.S. Mission. The
Contractor shall be able to generate and provide reports with an effective date in the past (no more than a year in the past).
2.11 provide customer service to LE Staff employees if and when there are questions and issues with social security payments and related issues that cannot be resolved by the Customer. The Customer shall assign points of contacts (POCs); the POCs shall speak German and English, and be able to serve as a customer service interface with individual
Payroll & Salary Computation Outsource Page 12 of 83 employees. Communications are to be via telephone, email, or other appropriate electronic communication platforms.
3. Requirements
3.1 The transmission of payroll and salary computation data between the Customer and the Contractor shall be via secure channels. The Contractor shall use the data to calculate social security contributions and return the Spreadsheet to the Customer (designated points of contacts (DPOC) in the Human Resources Office at the Embassy Berlin with a copy to the DPOCs in the Human Resources Office at the Consulates General Frankfurt and Munich) for processing of the actual salary payments and payments of the employer’s shares to the GSSS.
The Human Resources Officer shall review and sign off on the accuracy of the payments and contributions. The Customer and the Contractor shall transmit and exchange files via an agreed upon system that maintains the security of sensitive data. The Customer is responsible for transferring actual salary and contributions payments to the employees in accordance with USG procedures.
3.2 The Contractor shall process the payroll and salary computation data (Section 3.1) and return them to the Customer within seven (7) calendar days.
3.3 The Contractor shall prepare bi-weekly and monthly reports using salary and GSSS contribution calculations from previous Pay Periods that are assigned to a particular calendar month. Note: The 26 Pay Periods are spread over 12 calendar months; the Customer will, for the sole purpose of the payroll and salary computation administration, assign the Pay Periods to particular calendar months. The Customer will provide the information to the Contractor at the beginning of each calendar year. The Customer will work with the Contractor to establish a method of salary reporting and computation that addresses the unique challenges presented by the different pay system used by the USG and which suits the Contractor’s systems as best as possible.
3.4 The Contractor shall correct errors in calculations that result from an internal Contractor error or when the Customer provides incorrect input.
3.5 The Contractor shall prepare and provide all required forms such as, but not limited to, the following:
3.5.1 Salary information upon expiration of 42 days employer’s continued compensation in case of an employee’s incapacitation for duty;
3.5.2 Information for presentation to the German Unemployment Office (Bundesagentur für Arbeit);
3.5.3 Information for presentation to the German Elterngeldstelle for employees on Parental Leave; and/or,
3.5.4 Any form or certificate an employee may request for presentation to an authority or entity which requires the statement and proof of the employee’s income.
3.6 The Contractor shall closely coordinate with the U.S. Mission’s designated points of contacts on all matters related to the work requirements.
3.7 The Contractor shall maintain the capability to store, retrieve, and provide all Contractor work products (e.g. administrative documents, electronic files, etc.) that the Contractor created during the contract period including the base and all option years.
19GE5022R0020 US Embassy Berlin, Germany Payroll & Salary Computation Outsource Page 13 of 83
3.8 Within 30 days of the expiration or termination of this contract, the Contractor shall furnish to the Customer digital copies of all records/files related to the contract.
3.9 The Contractor shall destroy all data provided by the Customer upon expiration or termination of the contract. However, this shall not happen until the Customer has confirmed by signed letter to the Contractor that they have satisfactorily performed the requirements of section 3.8.
3.10 The Contractor shall monitor German Social Security regulations and laws to provide up-to-date advice on appropriate and required adjustments to employee social security contribution calculations that the Customer needs to make.
4. Deliverables
To ensure the data prepared by the Contractor is compatible with the report that the U.S.
Mission needs to send to its payroll center GFSC, the Contractor shall submit draft data submissions for a testing period as determined by the Customer (see below). The Contracting Officer shall issue a Notice To Proceed (NTP) to the Contractor to inform him/her once the test phase was successfully completed.

5. Notes
5.1 The Customer has six posts in Germany. The payroll work for the Embassy Berlin and the Consulates General Hamburg, Leipzig, and Düsseldorf are handled by the HR Office in Berlin;
the payroll work for the Consulates General Frankfurt and Munich are handled by the respective local HR Offices at the two posts. While geographically separate, the posts and their HR Offices do not function as independent, separate entities; rather, all operations are to be understood as being on one Mission Germany platform. The Contractor shall provide all services for the Customer to these sites via designated points of contacts at posts Berlin, Frankfurt, and Munich.
Payroll & Salary Computation Outsource Page 14 of 83
5.2 A Pay Period encompasses 14 calendar days, and the first day of a Pay Period is Sunday.
There are 26 Pay Periods in a year; in very rare circumstances there are years with 27 Pay Periods. The Pay Periods do not coincide with calendar months but regularly cross over the end and beginning of a month. The normal workweek has Saturday and Sunday as rest days.
5.3 The standard full-time work week of the U.S. Mission covers 40 hours per week, five days, eight hours a day, with some work weeks encompassing more hours (42 to 54). The U.S.
Mission has a few sections with extended work schedules or shift schedules; a certain number of Sections have On Call duty requirements. The U.S. Mission does not have employees in mini-jobs, or work-on-demand schedules (Arbeit auf Abruf). 5.4 The U.S. Mission observes local holidays according to the official holidays declared for the individual Federal States (Berlin, Hamburg, Saxony-Anhalt, Bavaria, Hesse, North-Rhine- Westphalia) and U.S. Federal Holidays. Each year, the Customer will provide the Contractor with the list of the observed holidays.
5.5 While the LE Staff payroll processing is predominantly governed by local law and to some extent by U.S. Law is as much as U.S. Citizens are concerned, there are a few State Department requirements that need to be complied with. To that end, the Customer will provide the Contractor with copies of all relevant policy documents and information as they apply to payrolling LE Staff compensation and will designate a point of contact to provide guidance and be available for questions as the Contractor may encounter them.
