B. SERVICES AND PRICES

B.1. SCOPE OF SERVICES

The Contractor shall provide translating and interpreting services as required by the US Government (USG) to support the training needs of the Kingdom of Saudi Arabia, Ministry of the Interior. This contract shall be func-tionally managed by the US Embassy Riyadh's Office of Program Management - Ministry of Interior

(OPM-MOI-US).

B.2. TYPE OF CONTRACT

This is a multi-award, fixed-price indefinite quantity/indefinite delivery (IDIQ) contract with a base year and 4 (four) one-year options.

(a) The Contractor shall provide the services for the base period of the contract, and any exercised option years, at the rates shown in the Schedule of Supplies (beginning on page 3) and any option years exercised by the Government.

(b) The quantities of supplies and services specified in the Schedule are estimates only and are not guaran-teed by this contract.

(c) The unit quantity SHEET (SH) in CLINs 0001, 1001, 2001, 3001, and 4001 is synonomous with the quantity PAGE and shall be defined as 250 words of English text as counted by the MicroSoft Office applica-tions.

(d) The Contractor shall furnish to the Government, when and if ordered, the supplies or services as spe-cified in the Schedule. The Government may issue orders requiring delivery to multiple destinations or per-formance at multiple locations. Except as specified in the Delivery-Order Limitations clause or in the paragraph below, there is no limit on the number of orders that may be issued/ordered.

(e) Prices shall remain firm and fixed for the entire duration of the contract. Price adjustments are author-ized only in clause below.

(f) The prices listed below shall include all labor, materials, overhead, and profit.

(g) VALUE ADDED TAX. (VAT). The Contractor shall include VAT as a separate charge on the Invoice and is listed as a separate line item in the Schedule.

B.3.2. CONTRACT MINIMUM AND CEILING

During the entire period of the contract, the Government shall, as a minimum, order services in an amount of at least $10,000 (or equivalent in Saudi Riyals). The Government makes no guarantee as to the number of orders or actual amount of services that will be requested above the guaranteed minimum. The maximum dollar value of all task orders is $8,000,000 (or equivalent in Saudi Riyals).

C. PERFORMANCE WORK STATEMENT

C.1. The Contractor shall provide interpreters and translators as may be from time to time required for the fol-lowing purposes:

C.1.1. Translate course materials from English to Gulf Arabic, using the same format as materials provided, typically in MicroSoft Word, Excel, or PowerPoint.

C.1.2. Interpret training courses during classroom presentation to include English to Arabic trans-lation of presentation of course material and Arabic to English and English to Arabic interaction between students and instructors to facilitate understanding of the material. Courses may vary in duration, but generally are conducted on a daily basis for a period of from one-to-five weeks and may be conducted for up to eight hours daily. The hours are not restricted to any particular time of day. The Government may require interpreting assistance outside the classroom to facilitate other instructor communication requirements on any day that the classroom instruction is less than eight full hours to complete the eight-hour day.

C.1.3. Perform simultaneous or consecutive interpretation from English to Arabic and from Arabic to English in a variety of settings which may include, but is not limited to, private meetings between two or more OPM-MOI team members and other American or Saudi interlocutors and events in a conference room, auditorium, or other open area with one or more principal speakers and/or interactions with multiple participants. The Government does not require the Contractor to provide specialized equipment for these events. The program or organizers of particular events will provide or arrange for any specialized equipment such as microphones, ear phones, interpretation booths, etc, as may be needed for any particular event, but any lack or inadequacy of such equip-ment should not stop the interpreters and translators from making a good faith effort to interpret at such events.

OPM-MOI will specify the need for the number of interpreters needed in any given task order requesting inter-preting services.

C.2 FORMAL SIMULTANEOUS INTERPRETATION

C.2.1. Interpret from and into English, using the consecutive or simultaneous technique, in structured or un-structured settings, in private or in public, with high-level officials on difficult or sensitive assignments, using a wide range of standard or technical terminology, for official or unofficial statements. The Contractor shall per-form instant analysis in order to understand correctly the substance of the words and information to be inter-preted, including attention to detail and nuances. The Contractor shall adapt to constantly changing circum-stances, personalities, and work environments. OPM-MOI will make every effort to make topic materials avail-able to the Contractor in advance of the dates of interpretation events and will endeavor to schedule advance meetings between OPM-MOI subject-matter experts on the topics to be interpreted and Contractor interpreters.

The Contractor will not charge additional costs for reviewing such materials and/or attending such advance meetings prior to interpreting events. Nonetheless, the Contractor’s interpreters should be familiar with special-ized terminology and vocabulary made available in advance of scheduled interpreting events in accordance with this paragraph.

C.2.2. Display fluent spoken and/or written English and Arabic, covering a wide range of terminology in many fields, as well as thorough knowledge of the government, history, and culture of the United States and the King-dom of Saudi Arabia and of the cultural differences between the languages. The Contractor shall also possess sufficient specialized knowledge to be able to handle, with personal research and/or topical briefings by the Government, any technical subject of high complexity, and be able to bridge terminology gaps, incongruent methodologies, different measurement systems, and similar disparities.

C.2.3. Perform interpreting with clarity, accuracy, and professional, poised delivery. The Contractor shall per-form interpreting services with the desired tenor of a public statement or the goals to be reached in a negoti-ation.

C.2.4. Trace, analyze, and define previously unknown concepts and theories, developing equally sophisticated counterparts that have the equivalent meaning and impact in a different cultural environment.

C.2.5. Adjust to the demands of diplomatic protocol, protective security requirements, and similar considera-tions. The Contractor may be required to take on a public relations or mediating role as part of the interpreting, so as not to jeopardize policies and program objectives and in order to obtain the desired results. The Contract-or may be required to consult with the OPM-MOI-US Language Services Unit to ensure consistency of termino-logy and the lexicon of the OPM-MOI Program.

C.2.6. Serve as official note taker, when needed.

C.3 SERVICE TYPES

The Contractor shall provide a quotation for the following types of services:

C.3.1. Translate course materials on a per page basis (defined to be 250 words of English text as counted by MicroSoft Office applications) from English to Gulf Arabic, using the same format as materials provided, typically in MicroSoft Word, Excel, or PowerPoint.

C.3.2. Interpret training courses during classroom presentation. Courses will vary in duration, but will generally be from four-to-eight hours of classroom time daily and from one-to-five weeks in duration. Course hours are not restricted to any particular time of day or day of the week.

C.3.3. Perform simultaneous or consecutive interpretation on a per-hour basis.

C.4. INSTRUCTIONS

C.4.1 The Saudi Ministry of Interior (MOI) and/or the State Security Presidency may require security clear-ances and the U.S. Embassy may require background investigation of Contractor staff to gain access to Saudi Government or Embassy facilities for each task under this contract. In cases of such requirements, the Con-tractor shall complete the necessary actions to obtain such clearances or access before its interpreters will be permitted such access.

C.5 PLACE OF PERFORMANCE/LOCATIONS

C.5.1. The Contractor may perform translations at Contractor facilities, unless specific materials as may be des-ignated by the Government require internal controls. The Contractor may only handle such materials in accord-ance with Government and OPM-MOI policies and instructions. The COR will inform the Contractor when such controls are necessary and the Contractor will perform translations accordingly at designated locations only.

C.5.2. The Contractor will conduct interpreting assignments at various OPM-MOI, MOI, SSP, or United States Government sites in the Riyadh area, hereby defined as the place of performance.

C.5.3. Transportation. The Contractor is responsible for transportation to and from all locations and events in the Riyadh area (defined to be within 50 miles (80 km) of the center of Riyadh), unless the Contracting Officer's Representative (COR) specifies otherwise in writing. If assignments are at locations more than 50 miles (80

km) outside of Riyadh, the Government may at its option provide transportation or request the Contractor to provide transportation in accordance with paragraph C.19. Reimbursable travel shall only be allowed for travel originating from the contract's place of performance (Riyadh) to the temporary duty location outside of Riyadh.

Lodging and meal expenses shall not exceed the per diem rate specified at US Department of State Foreign Per Diem Rates table found at https://aoprals.state.gov/web920/per_diem.asp. Travel expenses shall be payable un-der CLIN 0004, 1004, 2004, 3004, and 4004, at a cost reimbursement basis, but shall not exceed the amount specified on each respective task order.

C.6 ADMINISTRATIVE RECORDS

The Contractor shall maintain administrative files, which shall include, at a minimum, time and attendance re-cords for all employees furnished under the contract. The COR is authorized to examine the Contractor's ad-ministrative files. The Contractor shall maintain and the COR may review daily time and attendance records.

C.7 GOVERNMENT-FURNISHED EQUIPMENT, BADGE, KEYS, AND FACILITIES

For Contractor staff who regularly perform duties under this contract in Government facilities in KSA and who have MOI and/or SSP clearance, OPM-MOI may provide a badge, with COR approval that will allow access to OPM-MOI’s Building 81 in the Diplomatic Quarter.

C.8 PERIOD OF PERFORMANCE

The contract shall be effective as from the date of Notice to Proceed and shall remain in effect for twelve (12) months, with four (4) option years in accordance with FAR 52.217-9.

The Contracting Officer may also extend this contract for an additional six (6) months, if required by the Gov-ernment, in accordance with the FAR clause 52.217-8 OPTION TO EXTEND SERVICES, in SECTION 2 of this contract.

C.9 TASK ORDERS

The Contracting Officer will issue task orders to the Contractor to perform any work under this contract. The method used to place orders against this multi-award contact will depend of the overall value of each independ-ant task order.

C.9.1. Orders less than or equal to $250,000:

Task orders with an estimated order value of less than $250,000 will be made on a Fair Opportunity basis. The government will issue task orders amongst the contract holders, throughout the course of the contract's period of performance, such that overall the overall amount awarded on all task order is proportional between all the con-tract holders. In determining which contract holder to award individual task orders to, the government will take into consideration the following:

• Whether individual contract holders have received sufficient orders to meet the contracts guaranteed min-imum (IAW paragraph B.3.2);

• Endeavor to have one contractor perform services for identical training courses that are offered multiple time over the course of the year in order to maintain continuity between courses;

• Minimize instances whereby different contract holders are performing services at the same location at the same time

The government has no obligation to contact each contract holder for every requirement less than $250,000.

C.9.2 Orders greater than $250,000:

Task orders with an estimated value greater than $250,000 will be awarded on a competitive basis. The govern-ment will email requirements for services to each contract holder. The requirements email will state:

• the type of service,

• the number of interpreters ,

• the location and

• dates the service is required.

Each contract holder has three (3) days from the date/time the email is sent to respond with a price quotation.

The order will be awarded to the contract holder who has the lowest priced quote.

C.9.3 Past Performance In the event that there are repeat customer complaints against a contract holder, as identified through the Quality Assurance and Surviellance Plan (para C.11), the Government retains the right to not award further task orders to said contract holder until such time as the Government is confident that the Contractor's quality problems have been addressed and resolved.

C.10 TRANSLATED DOCUMENTS:

Translated documents may not be published on any website. All source and translated documents are the prop-erty of the Government and shall not be distributed or used for any purpose except for that which is expressly authorized by the OPM-MOI.

C.11 QUALITY ASSURANCE AND SURVEILLANCE PLAN (QASP)

This plan provides an effective method to promote satisfactory Contractor performance. The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Con-tractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory perform-ance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to monitor quality to ensure that contract standards are achieved.

Failure to comply with the performance thresholds indicated below will be grounds for terminating this con-tract. The Contracting Officer may, at his or her option, require the Contractor to take corrective action prior to determining that the contract will be terminated.

C.11.1 Surveillance. The COR will receive and document all complaints from Government personnel regarding the services provided. If appropriate, the COR will send the complaints to the Contractor for corrective action.

C.11.2 Standard. The performance standard is that the Government receives no more than one (1) customer complaint per month. The COR shall notify the Contracting Officer of the complaints so that the Contracting Officer may take appropriate action to enforce the inspection clause (FAR 52.246-4, Inspection of Services – Fixed Price (AUG 1996)), if any of the services exceed the standard.

C.11.3. Procedures

If any Government personnel observe unacceptable services, either incomplete work or required services not being performed they should immediately contact the COR.

The COR will complete appropriate documentation to record the complaint.

If the COR determines the complaint is invalid, the COR will advise the complainant. The COR will retain the annotated copy of the written complaint for his/her files.

If the COR determines the complaint is valid, the COR will inform the Contractor and give the Contractor addi-tional time to correct the defect, if additional time is available. The COR shall determine how much time is reasonable.

The COR shall, as a minimum, orally notify the Contractor of any valid complaints.

If the Contractor disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the Contractor will notify the COR. The COR will review the matter to determine the validity of the complaint.

The COR will consider complaints as resolved unless notified otherwise by the complainant.

Repeat customer complaints are not permitted for any services. If a repeat customer complaint is received for the same deficiency during the service period, the COR will contact the Contracting Officer for appropriate ac-tion under the Inspection clause.

C.12 CONTRACTOR AND KEY PERSONNEL / QUALIFICATIONS AND CAPABILITIES

C.12.1 CONTRACTOR QUALIFICATIONS

The contractor shall have sufficient human resources (availability of interpreters and translators) and organiza-tional capabilities to be able to ensure adequate and smooth fulfilment of the volume of the services as required by this contract.

C.12.2 KEY PERSONNEL / QUALIFICATIONS AND CAPABILITIES

Key personnel under this contract are:

Contractor's Project Manager – the contractor shall provide a project manager who shall be responsible for the administration, supervision, and coordination of the contractor’s Government operations. The Project Man-ager shall have extensive experience in the management of translating and interpreting services. The project manager shall be the person to organize the translators/interpreters assigned to work under this contract, distrib-ute work to individual translators/interpreters, see to it that they deliver translations on time, control arrivals/ hours of interpreters,etc. He/she is to be cosidered the Contractor's POC for the Gvernment and part of the Con-tractor's operating costs included in the translating and interpreting unit firm fixed price ( page/day/hour) and shall not be reimbursed by the Government.

Translators/Interpreters – for the performance of the services under this contract, the contractor shall assign the number of translators and interpreters it considers necessary for the performance of the work set forth in this contract.

All translators and interpreters, who will perform services under this contract, shall first successfully pass a lan-guage competency test given by OPM-MOI, and thereby obtain OPM-MOI certification. The COR will main-tain a list of all certified OPM-MOI certified translators and interpreters.

C.12.3 EDUCATION / QUALIFICATIONS

C.12.3.1 The Interagency Language Roundtable (ILR) skill level descriptions shall be used to define the lan-guage skills of individual translators and interpreters. (http://govtilr.org)

C.12.3.2. For native speakers of Arabic, the minimum educational requirement is a Kingdom of Saudi Arabia secondary education diploma or other international equivalent to the American High School Diploma and evid-ence of successful completion of professional interpreter/translator training.

C.12.3.3. For non-native speakers of Arabic who shall have native-level Arabic language proficiency, the min-imum requirement is a university-level bachelor’s degree in Arabic language studies and evidence of successful completion of professional interpreter/translator training.

C.12.3.4. English Language Full professional proficiency (Interpretation and Translation Level 3) in English documented with relevant degrees, professional training and certifications.

C.12.3.5. Three (3) years of experience in translation or consecutive/ simultaneous interpretation. Previous em-ployments shall be referenced, description of the work done and information on previous employers provided.

C.12.4 ADDITIONAL REQUIREMENTS / SKILLS

• Good knowledge of the Middle Eastern and Saudi Arabian geography and culture and adequate knowledge of American culture.

• Basic computer skills: Microsoft Word, Excel and PowerPoint.

• Interpreters shall display fluent spoken Arabic and English and be capable to perform instant analysis in or-der to understand correctly the substance of the words and information to be interpreted, including attention to detail and nuances. They shall adapt to constantly changing circumstances, personalities, and work en-vironments.

• Interpreters and translators shall master a wide range of terminology in many fields, as well as have a thor-ough knowledge of the Government, history, and culture of the United States and the Kingdom of Saudi Ar-abia and of the cultural differences between the languages.

• Interpreters and translators shall also possess sufficient specialized knowledge to be able to handle, with personal research and/or topical briefings by the Government, any technical subject of high complexity, and be able to bridge terminology gaps, incongruent methodologies, different measurement systems, and similar disparities.

• Perform interpreting with clarity, accuracy, and professional, poised delivery. Interpreters shall perform in-terpreting services with the desired tenor of a public statement or the goals to be reached in a negotiation.

• Capability to trace, analyze and define previously unknown concepts and theories, developing equally soph-isticated counterpart terms in the other language that have the equivalent meaning and impact in a different cultural environment.

C.13 STANDARDS OF CONDUCT

(a) General. The Contractor shall maintain satisfactory standards of employee competency, conduct, clean-liness, appearance and integrity and shall be responsible for taking such disciplinary action with respect to em-ployees as required. Each Contractor employee is expected to adhere to standards of conduct that reflect credit on themselves, their employer, and the United States Government. The Government reserves the right to direct the Contractor to remove an employee from the worksite for failure to comply with the standards of conduct.

The Contractor shall immediately replace such an employee to maintain continuity of services at no additional cost to the Government.

(b) Uniforms. The Contractor's employees shall wear clean, neat and identifiable uniforms, although not necessarily identical uniforms.

(c) Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words, actions, or fighting shall not be condoned. Also included is participation in disruptive activities that interfere with normal and efficient Government operations.

(d) Intoxicants and Narcotics. The Contractor shall not allow its employees while on duty to possess, sell, consume, or be under the influence of intoxicants, drugs or substances that produce similar effects.

(e) Criminal Actions. Contractor employees may be subject to criminal actions as allowed by law in certain circumstances. These include but are not limited to the following actions:

-- Falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or re-cords or concealment of material facts by willful omission from official documents or records;

-- Unauthorized use of Government property, theft, vandalism, or immoral conduct;

-- Unethical or improper use of official authority or credentials;

-- Security violations; or, -- Organizing or participating in gambling in any form.

(f) Neglect of duties shall not be condoned. This includes sleeping while on duty, unreasonable delays or failures to carry out assigned tasks, conducting personnel affairs during duty hours and refusing to render assist-ance or cooperate in upholding the integrity of the work site security.

C.14 PERSONNEL HEALTH REQUIREMENTS

All employees shall be in good general health without physical disabilities that would interfere with acceptable performance of their duties. All employees shall be free from communicable diseases.

C.15 LAWFUL OPERATION, PERMITS, AND INDEMNIFICATION

(a) Bonds. The Government imposes no bonding requirement on this contract. The Contractor shall provide any official bonds required, pay any fees or costs involved or related to the authorization for the equip-ping of any employees engaged in providing services specified under this contract if such bonds or payments are legally required by the local government or local practice.

(b) Employee Salary Benefits. The Contractor shall be responsible for payment of all employee wages and benefits required by host country law or agreements with its employees. The Government, its agencies, agents, and employees shall not be part of any legal action or obligation regarding these benefits which may sub-sequently arise. Where local law requires bonuses, specific minimum wage levels, and premium pay for holi-days, payments for social security, pensions, sick or health benefits, severance payments, child care or any other benefit, the Contractor is responsible for payments of these costs and must include them in the fixed prices in this contract.

(c) Personal Injury, Property Loss or Damage (Liability). The Contractor assumes absolute responsibility and liability for any and all personal injuries or death and property damage or losses suffered due to negligence of the Contractor's personnel in the performance of this contract. The Contractor's assumption of absolute liab-ility is independent of any insurance policies.

(d) Amount of Insurance. The Contractor is required to provide whatever insurance is legally necessary.

The Contractor shall, at its own expense, provide and maintain during the entire performance period the follow-ing insurance amounts:

General Liability

(1) Bodily Injury, On or Off the Site, in US Dollars Per Occurrence 500,000 USD Cumulative 500,000 USD

(2) Property Damage, On or Off the Site, in US Dollars Per Occurrence 500,000 USD Cumulative 500,000

USD

The types and amounts of insurance are the minimums required. The Contractor shall obtain any other types of insurance required by local law or that are ordinarily or customarily obtained in the location of the work. The limit of such insurance shall be as provided by law or sufficient to meet normal and customary claims.

For those Contractor employees assigned to this contract who are either United States citizens or hired in the United States or its possessions, the Contractor shall provide workers' compensation insurance in accordance with FAR 52.228-3.

The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to:

Any property of the Contractor, Its officers, Agents, Servants, Employees, or Any other person, arising from, and incidental to, the Contractor's performance of this contract.

The Contractor shall hold harmless and indemnify the Government from any and all claims arising, except in the instance of gross negligence on the part of the Government.

The Contractor shall obtain adequate insurance for damage to, or theft of, materials and equipment in insurance coverage for loose transit to the site or in storage on or off the site.

(e) Permits. Without additional cost to the Government, the Contractor shall obtain all permits, licenses, and appointments required for the prosecution of work under this contract. The Contractor shall obtain these permits, licenses, and appointments in compliance with applicable host country laws. The Contractor shall provide evidence of possession or status of application for such permits, licenses, and appointments to the Con-tracting Officer with its proposal. Application, justification, fees, and certifications for any licenses required by the host government are entirely the responsibility of the Contractor.

C.16 ORDERING OFFICIAL

The designated ordering individual under FAR 52.216-18 is the Contracting Officer.

C.17 CERTIFICATE OF INSURANCE

The Contractor shall furnish to the Contracting Officer a current certificate of insurance as evidence of the in-surance required. In addition, the Contractor shall furnish evidence of a commitment by the insurance carrier to notify the Contracting Officer in writing of any material change, expiration or cancellation of any of the insur-ance policies required not less than thirty (30) days before it is effective. When coverage is provided by self-insurer, the Contractor shall not change or decrease the coverage without the Contracting Officer's approval.

C.18 DEFINITIONS

"Calendar Day" means the twenty-four hour period from midnight to midnight. Saturdays, Sundays and all holi-days are considered calendar days.

"Client" means all United States mission personnel for whom the required services are to be rendered.

"COR" means the Contracting Officer's Representative, appointed in accordance with Section G of this contract.

"Government" means the Government of the United States of America unless specifically stated otherwise.

"Services" means the services performed, workmanship, and material furnished or utilized in the performance of the services.

C.19 REIMBURSABLE TRAVEL

(a) Allowable costs for a contractor's travel and transportation allowances are governed by the Federal Acquisi-tion Regulation (“FAR”) travel cost principle at FAR 31.205-46.

(b) The Contractor shall obtain the express approval of the Contracting Officer’s Representative (COR) prior to incurring any travel related costs.

(c) The Contractor shall be reimbursed for its reasonable actual travel expenses, excluding profit or fee, in ac-cordance with its usual accounting practices consistent with FAR Subpart 31. All travel shall be directly related to and required for performance under this contract.

(d) The Contractor shall include a breakdown of all authorized travel expenses as an attachment to each invoice.

In no event shall travel expenses be burdened with profit or fee. The COR may require submission of additional supporting documentation (such as ticket stubs or receipts) before authorizing payment for invoiced travel costs.

(e) Regular commuting expenses of Contractor personnel shall not be reimbursable.

(f) Notwithstanding business class travel authorizations permitted by the Federal Travel Regulations, the Gov-ernment will only reimburse the Contractor for economy (coach) class airfare for all travel conducted under this contract. Any airfare costs beyond economy class will be at the Contractor’s own expense, and shall not be dir-ectly reimbursable under this contract.

(g) The Contractor shall be responsible for timely and complete submittal of the necessary information and forms directly to the appropriate entity for all required passports, visas, licenses, and permits.

C. 20 DEFENSE BASE ACT (DBA) INSURANCE

DBA insurance is required for all United States citizens or residents and individuals hired in the United States, regardless of citizenship for any construction and services for U. S. overseas contracts over US$3,500.00. DBA insurance is also required for all Host Country Nationals (HCNs) and Third Country Nationals (TCNs) working overseas unless waved by the Department of Labor (DOL). Only the countries listed currently on the DOL’s Active DBA Waivers are not required to have DBA insurance for Host Country Nationals (HCNs) and Third Country Nationals (TCNs). See website for country waivers: ht-tps://www.dol.gov/owcp/dlhwc/dbawaivers/dbawaivers.htm). The waiver is only valid if alternative worker’s compensation benefits are provided to the waived employees pursuant to applicable local law. If there are no local worker’s compensation laws, the waiver has no effect and HCN and TCN (if applicable by local law) working under a U. S. contract shall be included and covered under the DBA.

The DBA insurance may be obtained from any authorized DBA insurance broker, see FAR52.228-3 WORK- ER’S COMPENSATION INSURANCE (DEFENSE BASE ACT) (APR1984). New DBA insurances policies can be purchased directly from any DOL approvedinsurance carrier. A list of DOL approved carriers may be found at http://www.dol.gov/owcp/dlhwc/lscarrier.htm.

The Contractor will be reimbursed for DBA only to the extent the contractor provides documentary proof that DBA has been paid and only to the extent quoted in the Pricing Schedule.

DBA insurance cost will be evaluated as part of the total evaluated fixed price and included in the fixed price of the contract. Where DBA is applicable, the Contractor will be required to provide evidence of insurance (certification of coverage and a paid invoice) within 15 calendar days from the date of award.

Due to the fact that Saudi Arabia is not on the DOL’s active waiver list, DBA insurance is required for all per-sonnel performing under this contract.
