PERFORMANCE WORK STATEMENT

Environment, Science, Technology, and Health (ESTH) Tradecraft (PE 305)

Facilitator

The U.S. Department of State’s (DOS) Foreign Service Institute (FSI) provides training and professional development to civilian per-sonnel of the DOS and the foreign affairs community. The School of Economic and Commercial Studies (ECON) Division of the School of Professional Studies (SPAS) at FSI provides members of the foreign affairs community with the knowledge, skills, and tools they require to analyze overseas economic and commercial developments and assist U.S. firms seeking advice, market access, trade and investment opportunities, defending investment and trade rights, and participating in overseas projects to promote the growth of U.S. jobs.

Environment, Science, Technology, and Health (ESTH) Tradecraft helps participants develop the knowledge, skills, attitudes, and tools required for ESTH officers abroad and in the United States to advance U.S. policy goals. The course presents an overview of major initiatives in multilateral and bilateral ESTH relationships and provides an opportunity for in-depth discussions with members of the Bureau of Oceans, and International Environmental and Scientific Affairs (OES), the Science Advisor to the Secretary and rep-resentatives from science, academia, non-governmental organizations (NGOs), industry groups, Congress, and other relevant parties.

The participants are mid-level Foreign Service Officers with three to ten years of work experience in the economic and commercial career path, Foreign Service National employees (residents of the host country working in U.S. embassies abroad) and U.S. Govern-ment Civil Servants who work in or preparing to work in, an ESTH officer position overseas or in Washington, D.C area with signific-ant responsibilities for monitoring and advocating U.S. Government’s ESTH policies in bilateral and multilateral settings.

Background The Foreign Service Institute (FSI) provides training and professional development to personnel of the Department of State and is the federal government’s primary training institution for Department personnel and other U.S. Government foreign affairs professionals.

FSI’s mission is to develop the men and women needed to advance and defend U.S. interests. FSI offers more than 700 classroom courses, including some 70 foreign languages, about 270 custom-developed distance learning products, and about 2,700 commercial distance learning courses available via Internet. Annual enrollment exceeds 100,000 students.

Contract Task FSI requires a course facilitator to provide services required by DOS and the FSI to facilitate delivery of the Environment, Science, Technology, and Health (ESTH) Tradecraft course.

This will include support for course design, materials and presentations for the course following an FSI approved course design; to handle administrative details for the course to include (but not limited to) scheduling presenters; to deliver the course; to review the design of the course and recommend improvements based in part on student evaluation; and to deliver lectures in the course. The course will be offered up to two times during the period of one year.

FSI will supply administrative support services as required for classroom set up. It will also supply a classroom for delivery of the En-vironment, Science, Technology, and Health (ESTH) Tradecraft course, equipped with tables and chairs for the students, an over-head projector, and a computer for the display of class materials, flip charts, and office supplies.

5.1 The period of performance will be one (1) base year and four (4) option periods.

5.2 The primary location will be SA-42. The Government will not provide local transportation costs, per diem or parking costs.

Primary location: U.S. Department of State, Building Annex SA-42 George P. Shultz National Foreign Affairs Training Center 4000 Arlington Boulevard Arlington, VA 22204

5.3 The Course Facilitator, in consultation with ECON, will:

Organize and conduct the Environment, Science, Technology, and Health (ESTH) Tradecraft course.

Provide weekly schedules for each class offering, detailing topics and presenters.

Invite and coordinate presentations by guest lecturers, ensuring they are informed as to the necessary scope and objectives for their presentations to fulfill the requirements of the course design.

Introduce guest lecturers, lead class discussions, and present study materials.

Make substantive lecture presentations as part of the course in areas of his/her own expertise and be prepared to substitute for any scheduled speaker or other activity in the event unforeseen circumstances prevent that speaker/activity from being presented as sched-uled.

Be present at FSI for the ten day duration of the course. In the event that a Course Facilitator cannot be present, he or she must provide the COR with a minimum of three weeks advance notice in the form of a written request for permission to be absent. The written re-quest must state a reason for the absence.

If a substitute for the Course Facilitator is suggested, that person must receive prior approval by the Economic and Commercial Stud-ies Deputy Director or Director, and all substitutes must have equivalent verifiable experience. Successful past performance in training for the U.S. Government is highly desirable.

If the request is approved, the Course Facilitator may invoice for the given session and must compensate the substitute from the funds he/she receives from the Contract.

5.4 Classroom Instruction

The contractor shall deliver the ten-day classroom based course, eight hours per day during normal FSI class hours for a class size of between 10-30 students.

5.5 Course Structure and Design

1. The course design should reflect the basic principles of adult learning theory, presenting material in highly interact-ive ways that build on the experience and knowledge that participants bring to the course, enabling them to general-ize from class material and apply their learning to their individual work assignment.

1. Learning objectives for each course segment should be clear, and training methodologies should be tailored so that they reinforce comprehension and absorption of the course content for each segment. For example, depending on the learning objective, student exercises, panel discussions, student interviews with experts, case studies, simula-tions or role-plays may be appropriate.

1. The course design should also make use of highly qualified and well-placed technical experts who are capable of presenting their knowledge in an interactive style.

1. The course design should also reflect the reality of serving at U.S. diplomatic missions overseas and the dynamics of the interagency process in Washington, D.C.

5.6 Personnel Qualifications

Subject matter expertise (SME): Instructors must have the following qualifications:

• A post-graduate degree in law, economics or other academic field directly related to ESTH issues or at least ten years of working in this field.

• Evidence of collaboration with diverse stakeholders in the foreign affairs and/or Government foreign policy environ-ment.

• Experience in delivering adult learning courses which actively engage students, or willingness to work with ECON and FSI’s instructional designers as needed to create appropriate experiential elements given the technical content.

The contractor shall use the key person or persons identified as the course instructors in its proposal to the U.S. Government. Substitu-tions shall not be made without prior notification and approval of the Contracting Officer. Request for substitutions shall meet or ex-ceed the qualifications of the person to be replaced. The Contracting Officer shall be notified in writing of any requests no later than forty-five days prior to the start date. Requests to substitute shall include:

(a) The Contractor acknowledges that it has taken steps reasonably necessary to ascertain the nature and loca-tion of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertain-ties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during work perform-ance. The Contractor also acknowledges that it has satisfied itself as to the character, quality, and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascer-tainable from an inspection of the site, including all exploratory work done by the Government, as well as from the drawings and specifications made a part of this contract. Any failure of the Contractor to take the actions de-scribed and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.

(b) The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of its officers or agents before the execution of this contract, unless that understanding or representation is ex-pressly stated in this contract.

The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workmen, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by the Contracting Officer.

(b) The Contractor shall protect from damage all existing improvements and utilities (1) at or near the work site, and (2) on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

52.236-5 Material and Workmanship (Apr 1984)

(a) All equipment, material, and articles incorporated into the work covered by this contract shall be new and of the most suitable grade for the purpose intended, unless otherwise specifically provided in this contract. Refer-ences in the specifications to equipment, material, articles, or patented processes by trade name, make, or cata-log number, shall be regarded as establishing a standard of quality and shall not be construed as limiting com-petition. The Contractor may, at its option, use any equipment, material, article, or process that, in the judgment of the Contracting Officer, is equal to that named in the specifications, unless otherwise specifically provided in this contract.

(b) The Contractor shall obtain the Contracting Officer's approval of the machinery and mechanical and other equipment to be incorporated into the work. When requesting approval, the Contractor shall furnish to the Con-tracting Officer the name of the manufacturer, the model number, and other information concerning the per-formance, capacity, nature, and rating of the machinery and mechanical and other equipment. When required by this contract or by the Contracting Officer, the Contractor shall also obtain the Contracting Officer's approval of the material or articles which the Contractor contemplates incorporating into the work. When requesting ap-proval, the Contractor shall provide full information concerning the material or articles. When directed to do so, the Contractor shall submit samples for approval at the Contractor's expense, with all shipping charges prepaid.

Machinery, equipment, material, and articles that do not have the required approval shall be installed or used at the risk of subsequent rejection.

(c) All work under this contract shall be performed in a skillful and workmanlike manner. The Contracting Of-ficer may require, in writing, that the Contractor remove from the work any employee the Contracting Officer deems incompetent, careless, or otherwise objectionable.

The Contractor shall fur-nish, at its own expense, all stakes, templates, platforms, equipment, tools, materials, and labor required to lay out any part of the work. The Contractor shall be responsible for executing the work to the lines and grades that may be established or indicated by the Contracting Officer. The Contractor shall also be responsible for main-taining and preserving all stakes and other marks established by the Contracting Officer until authorized to re-move them. If such marks are destroyed by the Contractor or through its negligence before their removal is au-thorized, the Contracting Officer may replace them and deduct the expense of the replacement from any amounts due or to become due to the Contractor.

(a) Quantity surveys shall be conducted, and the data derived from these surveys shall be used in computing the quantities of work performed and the actual construction completed and in place.

(b) The Government shall conduct the original and final surveys and make the computations based on them. The Contractor shall con-duct the surveys for any periods for which progress payments are requested and shall make the computations based on these surveys.

All surveys conducted by the Contractor shall be conducted under the direction of a representative of the Contracting Officer, unless the Contracting Officer waives this requirement in a specific instance.

(c) Promptly upon completing a survey, the Contractor shall furnish the originals of all field notes and all other records relating to the survey or to the layout of the work to the Contracting Officer, who shall use them as necessary to determine the amount of progress payments. (2) Unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inhering in work of the character provided for in the contract.

(b) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the condi-tions do materially so differ and cause an increase or decrease in the Contractor's cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.

(c) No request by the Contractor for an equitable adjustment to the contract under this clause shall be allowed, unless the Contractor has given the written notice required; provided, that the time prescribed in paragraph (a) of this clause for giving written notice may be extended by the Contracting Officer.

Before taking possession of or using any work, the Contracting Officer shall furnish the Contractor a list of items of work remaining to be performed or corrected on those portions of the work that the Govern-ment intends to take possession of or use. However, failure of the Contracting Officer to list any item of work shall not relieve the Contractor of responsibility for complying with the terms of the contract. The Government's possession or use shall not be deemed an acceptance of any work under the contract.

(b) While the Government has such possession or use, the Contractor shall be relieved of the responsibility for the loss of or damage to the work resulting from the Government's possession or use, notwithstanding the terms of the clause in this contract entitled "Permits and Responsibilities". If prior possession or use by the Govern-ment delays the progress of the work or causes additional expense to the Contractor, an equitable adjustment shall be made in the contract price or the time of completion, and the contract shall be modified in writing ac-cordingly.

This notice, when delivered to the Contractor or the Contractor's representative at the work site, shall be deemed sufficient notice of the noncompliance and that corrective action is required.

After receiving the notice, the Contractor shall immediately take corrective action. If the Contractor fails or re-fuses to promptly take corrective action, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor shall not be entitled to any equitable ad-justment of the contract price or extension of the performance schedule on any stop work order issued under this clause.
