About this file
This is an Amendment of Solicitation/Modification of Contract (Standard Form 30) issued by the Department of State, American Embassy Contracts Office in Paris, France. The amendment modifies RFQ 19FR6326Q0059 for janitorial services in Lyon, France, with an effective date of February 4, 2026. The requisition number is PR#15813315, and the amendment number is 0001. The amendment does not extend the deadline for offer submission. Contractors must acknowledge receipt of this amendment prior to the hour and date specified in the original solicitation using one of three methods: completing items 8 and 15 and returning one copy of the amendment, acknowledging receipt on each copy of the offer submitted, or sending a separate letter or telegram referencing the solicitation and amendment numbers. Failure to acknowledge receipt may result in rejection of the offer.
The amendment adds two substantive modifications to the original RFQ. First, it incorporates additional information and requirements on mandatory French local labor laws related to personnel management, including compliance with Convention Collective No 3343 governing janitorial services in France. Key requirements include that the incoming contractor must maintain 100 percent of the incumbent cleaning personnel allocated to the contract in accordance with Article 7 of the bargaining agreement, provide amended employment contracts showing the change of employer while maintaining identical initial clauses, and acknowledge the right of first refusal of employment provisions. Second, the amendment adds a new requirement (item 8) to Section 3, Solicitation Provisions A.2, requiring offerors to provide a statement declaring compliance with French labor laws and the French janitorial services Collective Convention No 3343 relating to the transfer of personnel. The amendment also modifies subcontracting plan requirements to include similar compliance and labor law provisions for any subcontractors, including evidence of existing partnerships of at least three years and past performance in providing janitorial services.

ADDITIONAL INFORMATION ON MANDATORY LOCAL LABOR LAWS TO THIS CONTRACT
To be included in page 12 of the RFQ
COMPLIANCE WITH THE LOCAL LABOR LAWS
The following information is provided with the intention of providing general guidance but is in no way a comprehensive guide to labor laws and wage agreements in France. It is the responsibility of each offeror to thoroughly acquaint themselves with the pertinent business laws and regulations affecting company operations in
France.
In France the provision of janitorial services is strictly controlled by law and falls under the “Convention
Collective” No 3343 (Convention collective nationale des entreprises de propreté et services associés). The
‘Convention Collective’ is a bargaining agreement between the Department of Labor, Employers Organizations and Labor Unions, which provides information on minimum basic salaries by professional category and their salary coefficients, premium pay, benefits, etc.
In accordance with the “Accord 1990-03-29 en vigueur le 23 juin 1989 étendu par arrêté du 6 juin 1990 JORF 9 juin 1990” detailed in Article 7 of the bargaining agreement “Convention Collective Nationale des Entreprises de propreté et services associés”, 100 % of the cleaning personnel allocated to the contract shall be maintained by the incoming contractor.
Therefore, if the contract award entails a change in Contractor, French labor laws require the incoming Contractor to take over 100% of the incumbent workforce falling under article 7.2 conditions.
It is advisable for Offerors to acquaint themselves with the exact details of these labor laws before submitting their offers. Also take note of H.9, Right of First Refusal. Exhibit E contains a list of incumbent employees and their employment history.
Full details of the “Convention Collective Nationale des Entreprises de propreté et services associes” No 3343 can be found in French on www.legifrance.gouv.fr
RIGHT OF FIRST REFUSAL OF EMPLOYMENT
In accordance with the Janitorial French Collective Convention, the new contractor shall provide an amended employment contract showing the change of employer while keeping the initial clauses identical.
An employee may stay employed by the outgoing contractor after agreement with both parties and the incoming contractor shall be informed of this agreement after contract award and prior to the transfer of all employees to the new contractor.
